Dear Ms. Kramer:
The Southold Town Board of Trustees reviewed the survey prepared by Stanley J.
Isaksen, Jr. dated January 30, 2003 and determined the proposed in-ground swimming
pool to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code
and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, or within 25' landward from the top of the bluff, without
further authorization from the Southold Town Board of Trustees pursuant to Chapter 97
and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area b(itween the tjdalwetLand jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.

However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.

Dear Mr. Herrmann:
The South old Town Board of Trustees reviewed the survey prepared by Stanley J.
Isaksen, Jr. last dated November 11, 2003 and determined the proposed additions to
the existing single-family dwelling to be out of the Wetland jurisdiction under Chapter 97
of the Town Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or

We represent Sally and Terence McLaughlin, who plan to construct additions to an existing one-family
dwelling located on the captioned parcel, all as depicted on the site plan prepared by Stanley 1. Isaksen,
last dated November II, 2003 (copy enclosed),
Because the entire subject parcel is located more than 100 feet from the nearest wetlands, those
adjacent to the bulkheaded shoreline of James Creek to the east, all work will occur beyond the
jurisdiction of the Southold Trustees pursuant to Southold Town Code Chapter 97. Therefore, we
respectfully request that you issue a letter of non-jurisdiction for the project.
Also enclosed for your reference is a copy of a portion of the Suffolk County Tax Map, which depicts
the parcel. I thank you for your attention to this matter.
