at 4300 Soundview Avenue, Southold, New York, hereinafter
r~ferred to as the Declarant, as the owner of premises described
in Schedule "A" annexed hereto (hereinafter referred to as the
Premises) desire to restrict the use and enjoyment of said
Premises and has for such purposes determined to impose on said
Premises covenants and restrictions and does hereby declare that
said Premises shall be hold and shall be conveyed subject to the
following covenants and restrictions.
1. Declarant has made application to the Suffolk County
Department of Health Services (hereinafter referred to as the.
Department) for a permit to construct, approval of plans or
approval of a subdivision or development on the Premises
2. As a condition for approval of the Department for said
subdivision or development application, the Declarant agrees the
leaching pools for the sewerage disposal systems must be
installed pr,or to the issuance of a permit to construct by the
Suffolk County Nealth Department.
3. The Declarant, its successors and/or assigns shall set
forth these covenants, agreements and declarations in any and
all leases to occupants, tenants and/or lessees of the
above-described property and shall, by their terms, subject same
to the covenants and restrictions contained herein. Failure of
the Declarant, its successors and/or assigns to so condition the
leases shall not invalidate their automatic subjugation to the
covenants and restrictions.
~. All of the covenants and restrictions contained herein
shall be construed to be in addition to and not in derogation or
limitation upon any provisions of local, state and Tederal laws,
ordinances and/or regulations in effect at the time of execution
of this agreement, or at the time such laws, ordinances and/or
regulations may thereafter be revised, amended or promulgated.
5. This document is made subject to the provisions of all
laws required by law or by their provisions to be incorporated
herein and they are deemed to be incorporated herein and made a
part hereof, as though fully set forth.
6. The aforementioned Restrictive Covenants shall be
enforceable by the County of Suffolk or any agency designated.by
the County of Suffolk, State of New York, by injunctive relief
or by any other remedy in equity or at law. The failure of said
agencies or the County of Suffolk to enforce the same shall not
be deemed.to affect the validity of this covenant nor impose any
liability whatsoever upon the County of Suffolk or any officer
or employee thereof.
7. These covenants and restrictions shall run with the land
and shall be' binding upon the Declarant, successors and assigns,
and upon all persons or entities claiming under them, and may be
terminated, revoked or amended by the owner of the premises only
with the written consent of the Department.
8. If any section, subsection, paragraph, clause, phrase or
provision of these covenants and restrictions shall, by a Court
of competent Jurisdiction,

LAW CONCERNING THE OFFERING, GIVING OR RECEIVING OF A GRATUITY TO OR
BY AN OFFICIAL. OF A POLITICAL PARTY.
WHEREAS, there was duly presented and introduced to this County Legislature
at a regular meeting held on December 9, 1908, a proposed local law entitled "A
LOCAL LAW CONCERNING THE OFFERING, GIVING OR RECEIVING OF A GRATUITY TO OR BY
AN OFFICIAL OF A POLITICAL PARTY," and said local law in final form is the same
as when presented and introduced; now, therefore, be it
RESOLVED, that said local law be enacted in form as follows:
LOCAL LAW NO. 32 YEAR 1980, SUFFOLK COUNTY NEW YORK
LOCAL LAW CONCERNING THE OFFERING, GIVING OR RECEIVING OF A GRATUITY TO OR
BY AN OFFICAL OF A POLITICAL PARTY.
BE IT ENACTED BY THE COUNTY LEGISLATURE OF THE COUNTY OF SUFFOLK AS
FOLLOWS:
Section 1. Definitions.
(a) As used herein, the word "agreement" means any written or oral
contract, or any implied contract, including, .but not limited to, a contract
for the sale of goods or services, a construction contract or a lease or
contract relating to real or personal property. The term "agreement" shall
also include any transaction whereby a person agrees to sell goods or services
or both to the County pursuant to a successful bid.
(b) As used herein, the word "gratuity" means any money, benefit,
entertainment, gift, or any other consideration whatsoever.
(c) As used herein, the phrase "official of a political party" shall mean a
party officer as defined by Section 1-104(5) of the Election Law.
(d) As used herein, the work "person" means any individual, partnership,
firm, corporation, or other legal entity, as well as their rmployees, agents or
representatives.
(e) As used herein, the phrase "political party" shall mean a party as
defined by Section 1-104(3) of the Election Law.

Section 2. Prohibitions.
(a) It shall be a crime for any person to offer or give any gratuity to an
official of any political party, with the purpose or intent of securing or
obtaining an agreement with the County of Suffolk, securing favorable treatment
with respect to the awarding or. amending of such agreement, or the making of
any determination with respect to the performance of an agreement.
(b) It shall be a crime for an official of a political party to solicit,
receive or accept a gratuity in connection with securing or obtaining an
agreement with the County of Suffolk, securing faborable treatment with respect
ito the awarding or amending of such agreement, or the making of a determination
with respect to the performance of such agreement.
Section 3. Mandatory Contract Clause. In all agreements with the County of
Suffolk, made after the effective date of this Law, there shall be a written
representation by the person entering the agreement with the County that he has
not offered or given any gratuity to any official, employee or agent of Suffolk
County, New York State, or of any political party, with the purpose or intent
of securing an agreement or securing favorable treatment with respect to the
awarding or amending of an agreement, or the making of any determinations with
respect to the performance of an agreement, and that such per'son has read and
is faliliar with the provisions of this Local Law.
Section 4. Penalties.
(a) Criminal. A violation of Section 2 of this Local Law shall be a Class
A Misdemeanor and shall be punishable by a sentence of not more than one (1)
year in prison or a fine of not more than one thousand dollars, or by both such
fine and imprisonment.
(b) Civil Remedies. A violation of Section 2 or 3 of this Local Law shall
give the County the option, among other civil remedies, of either terminating
the agreement or deducting the value of the gratuity from any amount due or to
become due from the County thereunder.

Letter of Credit in your favor up to the aggregate amount of SIXTY THREE
THOUSAND EIGHT HUNDRED TWENTY FIVE AND 00/100 ($63,825.00) U.S. Dollars
available by your drafts at sight accompanied by:
A certified copy of the Resolution of the Town Board,
certified by the Town Clerk, which indicates:
"Robert Jensen has failed to complete all of the improvements in connection
with the subdivision map entitled 'Beachwood Acres'.heretofore approved by the
Planning Board, Town of Southold, and that as a result of said failure, there
is due and owing an amount equal to the face amount of our attached draft.
Said resolution should also indicate that the amount drawn hereunder is for
the sole purpose of completing those items of improvement which were to have
been completed by Robert Johnsen."
This Letter of Credit remains in force in Mattituck, New York and must be
presented for payment at our counters at 9025 Main Road, Mattituck, New York
11952, by the beneficiary not later than August 3, 1990 and all drafts drawn
thereunder must be negotiated on or before that date.
Each draft must state that it is "Drawn Under Letter of Credit No. M-89092 of
The North Fork Bank and Trust Company, dated August 4, 1989" and the amount
endorsed on this Letter of Credit.
We hereby agree with the Drawers, endorsers and bona fide holders of drafts
drawn under an in compliance with the terms of this Letter of Credit that such

The design of the fire wells within the Southold Fire District shall be ap-
proved by the Board of Fire Commissioners of the Southold Fire District,
and will conform to the following minimum standards:

York Board of Fire Underwriters and the Towo of Southold where ap-
plicable.
B. Installation shall be ooderground froth Ltl.CO distribution facilities.
C. Power requirements will be 3 phase 240 voit delta with a minimum
service switch of 150 Ampere.
D. An enclosure shall be constructed around the electrical equipment which
will be weather-tight and capable of being locked.
E. Additional electrical equipment to be installed will be: a circuit
breaker panel, 115 volt duplex receptacle, switch and inside light,
on and off switch for pump, magnetic starter switch of 60 amp rating,
double pole double throw 3 phase main disconnect, 3 phase plug to fit
Fire Department generator.
4. When 3 phase electric service is uot available, the following will be in-
stalled, in addition to Section #3:
A. Power requirements will be 1 phase 240 volt delta with a miuimum service
switch of 150 Ampere.
B. Install roto-phase motor sized to operate pump.
C. Roto-phase motor will be installed on a cement foundation.
D. Roto-phase motor must be enclosed.
The Board of Fire Lonmissloners of the Southold Fire District will not accept any
installation not in the best interest of the Fire District. Any questions
should be directed to the Chairman of the Southold Fire District.

the Health Department from the test well, which the applicant
has indicated that he is in the process of providing for them.
And that we keep on top of them and see what information we get.
Mr. Orlowski: That is about all we can do right now. The ball is
in their court. We will have to just keep an eye on it. Does the
Board have any questions on it?
Board: No
Mr. Orlowski: Is there anyone here representing Beachwood Acres?
O.K. I will go on to the new road specifications in the minor
subdivision. After meeting with the Highway Committee and going
over everything and arguing and hashing things out. I believe
the Planning Board has one more recommendation to put before the
Town Board for their blessing. This would be minimum standard
road construction within a residential subdivision, so be that
of a major subdivision specifications set forth in Chapter Al08
of the Town Code with the following changes:
There shall be no curbs, the subgrade width shall be 22
feet, the finegrade width shall be 21 feet, the binding
course shall be 20 feet and shall be composed of either A.
one and a half inches of asphalt or B. double sealed coat
consisting of two layers of bluestone chips penetrated with
oil inaccordance with the State code. The latter option
would result in road having an appearance of a gravel road f
while retaining all the benefits of a solid road base.
I think this answers the question of aesthetic in this second
option. I believe cost wise it is not that much more, is it Dick?
Mr. Ward: Probably a little less.
Mr. Orlowski: Probably less!-~So, all and all I think they are
pretty good recommendations. I would like to send this to, I
guess we will send this to Jean Cochran of the Highway Committee
for her to present to the Town Board for their approval. I would
like to send it over and make it in a form of a motion to do
that.
Mr. Latham: So moved.
Mr. Ward: Second.
Mr. Bruer: Would the Board appreciate a comment on the matter?
Mr. Orlowski: Well, you can talk all you want.
Mr. Bruer: I know we have hashed it over and I know my comments
will be brief. I think, personally, and on behalf of a few
clients, that this is probably one of the most significant
things that is going on before the Town Government today. You
people have sat. up there and spat out cost and things like that,
I don't think a~ything has real~been on any particular record
nor has anybody really had an oppertunity to rebut you with
respect to cost and stuff like that. Normally I wouldn't make a
comment, but personally I think that this is such of great
~lanning Board

importance and will have such a great impact on subdivisions in
this Town. I think that very possible either you or the Town
Board should possibly give the public an idea of what is going
on. I don't think the public out there, who is going to be
affected by this, really knows the true cost and consequences or
have been given an oppertunity to really give their input to
this. I think I have already given to the Board, on various
occasions, on various applicatiohs, my clients and my own
objections to what the Board is doing. I can appreciate some of
the reasonings of the Board. I don't think they out weigh, I
think, the punitive damage that the Board is causing by the
strict recommendations that you are coming forth with. I believe
at the prior conversation with the meeting with the Town Board,
Highway Committee I believe some suggestions were made there
asking that the Board with that down a little bit.with respect
to the road requirements that you just read.
Mr. Orlowski: To these here.
Mr. Bruer: Yes, I think that is the same thing that you
submitted to them two or three weeks before.
Mr. Orlowski: We have come up with a second top coat.
Mr. Bruer: What was there different?
Mr. Orlowski: Double Seal Coat.
Mr. Ward: Instead of the final inch and a half of asphalt you
can put a double seal coat of stone chip down.
Mr. Orlowski: Which comes out cheaper than asphalt.
Mr. Ward: What it concerns with is looking like rural roads.
Mr. Bruer: We are talking about minor subdivisions, and again we
are talking about roads that I think everyone agrees will never
be part of the Town Highway system or it is not supposed to be.
O.K. but you are supposed to take the rules that exist. Not use
them in one instance for your benefit and in another not use
them. I think the situation that is here in a minor subdivision,
the use of these standards are going to kill a lot of minor
subdivisions.
Mr. Orlowski: I don't believe that.
Mr. Bruer: Well that Mr. Orlowski, I would appreciate something
more then just "I don't believe that". I think you could do.
that. You have all these public hearings and I know you don't
have to have it here but I think it would be beneficial to the
community to get public input here and then make up your mind.
Mr. Orlowski: You know right now we are only talking about a
policy. Number 6ne there is no s~h thing as minor subdivision
road. We would like to make something. We would like to lessen
the standards that do exist. In doing that and making it safe we
feel we have come up with something very fair. We have used

have figured out that we are running ten dollars to maybe
fifteen dollars a foot more. Which we don't think figure that is
much greater. When we say go to a major road you are talking one
hundred to one hundred and fifty dollars more per foot. We feel
that the life and safety in these minor subdivision is much more
appreciated then somebody comin~ in and just putting down a
substandard road. If you want to go out some day on an
inspection with me and the rest of the Board and see some of
these fifteen foot wide roads that we now have, well you get
your four wheel jeep and we will go out and take a look at them.
I think that we are looking for something so when somebody comes
we are going to say here it is, here is your application, here
is the road you have to put in. There is no if's, ands or butts
or there is no sending an engineer out at five hundred dollars
an inspection to tell them what to put down. It is costing the
town money. We have ten different standards of roads out there
now. Out of the ten I think eight of them are so full of pot
holes and destroyed. I think it is a joke. I don't think the
third or forth owner down the road appreciates it much and we
can sit here and argue all day long as we had before and before
and before. But I think in the long run, I think you are way off
with your numbers and you probably think I am off with mine.
This is what we have come up with.
Mr. Bruer: I don't really express numbers, but I have been
informed that there are a lot more than what you are saying
there are. What you are saying is that you really have something
there that is really affecting zoning. It is being decided
without public input. I think it is that important. I think
either this Board or the Town Board should sit down and based
upon you have said, have public input into this.
Mr. Mullen: Suppose we make our recommendation to the Town Board
and you can take it up with them? I am a victim of a
right-of-way that is a disaster. I am very much opposed in how
it is being operated now. You, sir, have received no corse
factors. We have. I think what we are trying to do is perhaps
save a life or lives, believe it or not. Which in my mind is
more important than a subdivider making a couple of dollars.
That is all I am going to say about it.
Mr. Bruer: Again, of course money is important and lives are
more important. I don't think we have any instance here that
there has been any loss of life or loss of property because of
the minor subdivision road in of it themselves. I take offense
when members of, not only this Board but other Boards, to make
it a point to point out that the developer or somebody else in
the community is making money. I think that is wrong.
Mr. Mullen: Just a moment please. We don,t resent anyone making
a dollar but I said to you what I am looking forward to is to
perhaps save a life for a few extra dollars. That's what I said.
Mr. Bruer: I just like to call, let's not beat a dead horse here.

Mr. Lessard: Because of the position I am in, I hate to have to
say this. Five years ago we had the same problem. Because of
minor subdivisions or majors if you would, the ZBA is also
involved. Now through oversite,this last Highway meeting, now I
am not going to lay the blame at anybody's door, we overlooked
the ZBA. We overlooked me too. So I have no qualms with the
specifications you laid down. I think that that has a lot of
merit. What I am asking this board is to please coordinate with
the ZBA so everybody goes in the same direction. I don't want to
come up with two standards. We are in a position where outside
the subdivision it belongs to the ZBA and inside it belongs to
the Planning Board and want to see the same answers on both
Boards. I know the end we are trying to reach, but I think that
in the process we don't want to leave somebody out and the left
hand does not know what the right hand is doing.
Mr. Orlowski: Let me just say Ghat we have not adopted this as
plan policy of the Board, because we realize that this is
important. We want the Town Board, the Building Department and
the Zoning Board to be well aware the proper channel to run this
whole thing through it the Highway Committee. The Highway
Committee asks us at the last meeting to come up with these
specs, and hand them in. I am sure the Highway Committee will
invite the proper agencies.
Mr. Lessard: Don't get me wrong.
Mr. Orlowski: The Board is not adopting this tonight. You will
have your chance somewhere along the line. We are going to stick
by it. This Board will stick by it. I am tired of playing
Russian reulet with these minor subdivision roads. And we are
trying to set a policy here. All we want everyone to be happy.

I represent Robert Johnsen re the above minor subdivision. Sketch map
approval was granted in late November, 1986 as per the attached. The saga
since that date which my client has been subjected to with the Suffolk
County Health Department is unfortunately not an unfamiliar one. Suffice
it to say after much delay, apparently endemic to the Health Department,
and despite great perservence on the part of my client, he anticipates
Suffolk County Health Department approval is finally to be granted within
the next ten days.
It has now, however, come to our attention that technically, the
sketch plan approval expired eleven months ago. Secretarial staff to the
Planning Board advises that an application to extend will be routinely
granted provided a check for $1,000 is provided and a new application
filled out.
In light of the circumstances outlined above, by which, through no
fault of his own, my client was delayed at great length by the Suffolk
County Health Department. I request that you implement Article 5, section
A 106-50 of the Southold Town Code, and declare, under all the
circumstances, that this is a hardship case in which a waiving of the
payment requirement should be granted. I point out that my client has
already paid fees in excess of $500 on his initial application and the
delay in its processing was totally out of his control.

3. By this application, appellant requests approval of
proposed Lot No. 4 of 70,000 sq. ft. in area and lot width of 226±
feet. The remaining proposed three lots in this four-lot minor
subdivision are proposed to contain a minimum lot area of 80,000
sq. ft. each, and are vacant, all as shown by minor subdivision
sketch plan/survey prepared by Young & Young September 5, 1984.
Proposed Lot No. 4 will contain the existing single-family dwelling
and accessory storage garage located in the rearyard area.
4. The percentage of relief requested in relation to the
zoning r~quirement, Article III,. Section 100-31, Bulk Schedule,
is 12.5%, or lO,O00 sq. ft.
In considering this appeal, the board finds and determines:
(a) that the circumstances are unique; (b) that the variance
will not in turn cause a substantial effect of increased popula-
tion density or be adverse to the safety, health, welfare, comfort,
convenience and order of the town; (c) the practical difficulties
shown are sufficient to warrant the granting of the variance;
(d) there will be no substantial change in the character of the
neighborhood or a substantial detriment to adjoining properties;
(e) the difficulty cannot be obviated by some method feasible
for appellant to pursue other than a variance; (f) that in view
of the above factors, the interests of justice will best ~e
served by allowing the variance.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Sawicki, it was
RESOLVED, that the relief requested under Appeal No. 3486

BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
