Dear Mr. Fitzgerald:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, February 26,2003:
RESOLVED that the Southold Town Board of Trustees grants a One-Year Extension to Wetland
Permit #5133 to remove and replace in the same location 145'+/- of existing retaining wall;
remove and replace in the same location 115'+/- of existing bulkhead; remove and replace in
same location 1345'+/- of existing decking between the bulkhead and the retaining wall. Remove
and replace in the same location two sets of stairs. Remove any fill that enters the waterway and
replace it behind the bulkhead or retaining wall. Fill as necessary behind the bulkhead and
retaining wall to maintain established grades using an estimated 30 cy. of spoil from an
associated separately permitted dredging activity and establish a 10' non-turf buffer.
This is the last one-year extension that will be granted.
This is not an approval from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Monday, May
14, 2001, the following recommendation was made:

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A STIPULATION of the Amendment Request of the SALT LAKE ASSOCIATION 144-
5-19to Amend Permit #5133 to remove and replace in the same location 145'+/- of
existing retaining wall; remove and replace in the same location 115'+/- of existing
bulkhead; remove and replace in the same location 1345+/- sq. ft. of existing decking

The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on March 22, 2000, regarding the
above matter:
WHEREAS,
Trustees
Ordinance
2000 and,
SALT LAKE ASSOCIATION, applied to the Southold Town
for a permit under the provisions of the Wetland
of the Town of Southo1d, application dated March 3,
WHEREAS, said application was referred to the Southo1d Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 22, 2000, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approves the application of
SALT LAKE ASSOCIATION to dredge portions of the boat basin to 5'
below MLW, remove collected sand from surrounding walkway, place
dredge spoil and sand removed from walkway on indicated site,
maintenance dredge the same conditions as necessary a min. of
three times during the next ten years but that the Board be
notified on each time it is dredged and based on Trustee Arthur
Foster's inspection of spoil site. Located: Old Salt Lake Road,
Mattituck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete pro;ect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

The New York District, Corps of Engineers has received an application for a Department of the
Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) and Section
404 of the Clean Water Act (33 USC 1344).

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general, the needs and welfare of the people. .
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise, it will be presumed that there are no objections to the activity.
Any person may request, in writing, before this public notice expires, that a public hearing be
held to collect information necessary to consider this application. Requests for public hearings shall state,

with particularity, the reasons why a public hearing should be held. It should be noted that information
submitted by mail is considered just as carefully in the permit decision process and bears the same weight
as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not
likely to affect any Federally endangered or threatened species or their critical habitat, or Essential Fish
Habitat and/or managed species. However, pursuant to Section 7 of the Endangered Species Act (16
USC 1531), the District Engineer is consulting with the appropriate Federal agency to determine the
presence of and potential impacts to listed species in the project area or their critical habitat.
Based upon a review of the latest published version of the National Register of Historic Places,
there are no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished
under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of
the guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority
of Section 404 (b) of the Clean Water Act and the applicant will obtain a water quality certificate or
waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior
to a permit decision.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 USC
1456 (c)], for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicant has certified in the permit
application tlIat the activity complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State, the
applicant's certification and accompanying information is available from the Consistency Coordinator,
New York ~tate Departtnent of State, Division of Coastal Resources and Waterfront Revitalization,
Coastal Zone Management Program, 41 State Street, Albany, New York 12231, Telephone (518) 474-
6000. Comments regarding the applicant's certification, and copies of any letters to this office
commenting upon this proposal, should be so addressed.
In addition to any required water quality certificate and coastal zone management program
concurrence, the applicant has obtained or requested the following governmental authorization for the

WORK DESCRIPTION
The applicant, Salt Lake Association, Inc., has requested Department of the Army authorization
to dredge material from James Creek, Great Peconic Bay at Mattituck, Town of Southold,
Suffolk County, New York with ten years maintenance and subsequent beach nourishment.
The work would involve dredging, with ten years maintenance, by clamshell, of material from
an area of excess sediment in an existing boat basin to a maximum depth of 5 feet below mean
low water, removing approximately 700 cubic yards of material on initial basis. Three additional
dredging events are anticipated during ~e ten-year life of permit, if issued, removing
approximately 150 cubic yards of material per event. All dredged material would be disposed
behind an existing exposed timber bulkhead on a sandy beach where return flow would be
allowed to reenter the bay through hay bales,
The stated purpose of this project is to maintain an existing boat basin.

YOU ARE HEREBY GIVEN NOTICE THAT:
1. An application is being submitted to the Board of Trustees for a pennit to:
Dredge portions of the boat basin to 5 feet below mean low water; remove collected sand from
surroWlding walkway; place a total of approximately 700 cubic yards of dredge spoil and sand
removed from walkway on indicated site; maintenance-dredge to same conditions as necessary
a maximum of three times during the next ten years.
2. The project described above is proposed on property adjacent to yours. The street ad-
dress of that property is as follows:

3. The project, which is subject to Environmental Review under Chapters 32, 37, or 97 of
the Town Code, is open to public comment. A public hearing will be held at Town Hall,
53095"Main Road, Southold, New York 11971 at or about 7:15 PM on Wednesday, March
22,2000. You may contact the Trustees Office at 765-1892 or in writing if you wish to
comment.
4. The project descn"bed above will be reviewed by the Board of Trustees of the Town of
Southold. The project may require independent review and approval by other agencies of
the Town, State, or Federal governments.
