Dear Mr. Wohlars:
The following action was taken by the Board of Town Trustees during its regular meeting held
on Wednesday, February 21,2001 regarding the above matter:
WHEREAS, Redwin Industries, Inc. on behalf of DEBORAH PENNEY applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated January 4,2001, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 21,2001 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,

safety and general welfare ofthe people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of DEBORAH PENNEY to
build a porch enclosure and deck.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months ofthe date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

Based on the infOrmation you have submitted, this Department has determined that:

The property landward of the bl,Jlkhead whichwas constructed prior to August 20, 1977
as shown on the survey prepared by Howard V'I. Young dated September 23, 1980, is
beyond Article 25 jurisdiction."': .,s .
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part
661) no permit is required. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibility to
ensure that all precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which
may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project (I.e. a 15' to 20'
wide construction area) or erecting a temporary fence, barrier, or hale bay berm.
Please be further advised that this letter does not relieve you of the responsibility of
ontaining any necess'ary permits or approvals from other agencies.
