Dear Mr. Fitzgerald:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 30, 2003:
RESOLVED that the Southold Town Board of Trustees grants a One-Year Extension to Wetland
Permit #5337. Permit is to remove and replace in the same location 86'+/- of existing retaining
wall, 93'+/- of existing bulkhead, and 720'+/- of existing decking between the bulkhead and
retaining wall. Fill as necessary behind the bulkhead and retaining wall to maintain established
grades using an estimated 20 cy. of spoil from an associated separately permitted dredging
activity and a 10' non-turf buffer landward of the bulkhead.
This is not an approval from any other agency.

Dear Mr. Fitzgerald, Jr.
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on May 24,2001, regarding the above matter.
WHEREAS, PROPER-T PERMIT SERVICES. on behalf of DEBORAH PENNEY applied
to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of South old, application dated May 3,2001,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their [mdings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 24,2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 ofthe Southold
Town Code.

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare ofthe people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Proper-T Permit Services
on behalf of DEBORAH PENNEY for a Wetland Permit to remove and replace in the same
location 86+/- of existing retaining wall, remove and replace in the same location 93+/- of
existing bulkhead, remove and replace in the same location 720 +/- sq. ft. of existing decking
between the bulkhead and the retaining wall. Fill as necessary behind the bulkhead and retaining
wall to maintain established grades using an estimated 20 cu. yds of spoil from an associated
separately permitted dredging activity with a ten foot non-turf buffer is put in place from the
bulkhead landward.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date of this notification.

decking between the bulkhead and the retaining wall. Remove any fill material that enters the waterway

wall to maintain established grades using an estimated 20 cu. yds. of spoil from an associated separately
permitted dredging activity.
2. The project described above is proposed on property adjacent to yours. The street ad-

3. The project, which is subject to Environmental Review under Chapters 32,37, or 97 of
the Town Code, is open to public comment. A public hearing will be held at Town Hall,
53095 Main Road, Southold, New York 11971 at or about 7:00 PM on Thursday, May 24,

comment.
