I enclose a copy of the Planning Board's transmittal letter. As you have been previously advised, the Town of Southold approved the subdivision of your property in 1972 and still honors that approval. Therefore, we do not have any problems with the Town of Southold. The Health Department regulations have changed drastically since the early 19701s. It is the Health Department that now requires approval of subdivision of your property. It is this approval which has taken a considerable amount of time. As I advised you the last time we spoke, we believe we are very close to Health Department approval. One of their inquiries was that of DEC jurisdiction. The DEC has recently notified the Health Department that they do not have jurisdiction over land subdivisions near freshwater wetlands. The second concern, that of the soil test, was created because the Health Department initially directed that the test hole be placed in the low part of the property. Unfortunately, this was a poor choice of location because the area drilled proved to be rather wet and contained unacceptable amounts of clay. As you may recall, it was necessary to have the test hole re-drilled in a better location. This has been done and the results submitted to the Health Department and we are awaiting their response. Unless the Health Department raises some additional issue, this is the last step prior to the approval, at which point your subdivision approvals will be complete. Very truly yours, AAW:mh Abigail A. Dezr '�r, r Chairman; Last Fall I had to make some changes in my estate planning for tax purposes, there being an overabundance of property in my name. The tax emptions on estates have little meaning at the present time ; the steep continuing inflation minimizing the exemptions. In our estate planning among other changes we decided to convey the southerly 8 1/3 acres to my wife. This was done, however it was found that there was a boundary dispute and the deed was delayed. Upon investigation the Title company which in this case insured both sides, confirmed our original survey. This all takes time and explains the delay. The submission for approval of the southerly 6 1/3 acres by Elaine Axien into 5 plots makes for a very liberal divisions two of the plots being 74,678 and 95,600 sq. ft. in area. We are think— ing in terns of " be kind to the land 16 because we have lived here as permanent residents for 27 years and respect this property. This division has been worked out on the basis of contours , affording to each parcel sufficient areas for building, for privacy, landscaping and wooded space. The luxuriant growth and the very large size of each plot affords the privacy people are seeking today.
