SCTM# 1000-68-1-14.1 and 14.2 Dear Mr. Zachariadis: The Planning Board is in receipt of your letter and supporting documents regarding the subdivision referenced above. It is clear from those documents that the Planning Board's conditions of approval in their June 11, 1986 resolution for the subdivision were met back in 1987. We have added a copy of the map with the Suffolk County Department of Health Services (SCDHS) approval stamp from April 9,1987 and the Suffolk County Planning Commission letter dated June 16, 1986 to our file, and will move the file from our"Expired" folder to our "Approved" folder. Since we have found no evidence that a subdivision map was filed with the Suffolk County Clerk, that may be a good course of action going forward. The SCDHS let us know that they would be able to stamp a new map for filing based on the approval granted in 1987. That new map that could then be stamped by the Southold Town Planning Board, and then filed with the County Clerk, which would solidify the paper trail very clearly. Please call with any questions. The question for them would be whether or not they recognize the two tax parcels as two separate lots—did they approve that subdivision of 68- 1-14 back in 1986 or 87. Enough happened in the Town process that it would be difficult to say they are not recognized lots under Town rules. But having Health Dept approval would cinch it. Or the property owner could be asked to produce the Health Dept approval and the filed map if there is one. Lot Recognition doesn't require that a map be filed—just that the Planning Board approved it. They approved it with conditions and no follow up in the file on whether or not the conditions were met. Of course today this wouldn't happen. The 80's seemed to allow a lot of things to slip through. -1 I October 15, 2022 Southold Town Planning Department, I hope this letter finds you well. My name is Constantine Zachariadis. William Walters (realtor representing me) and I are writing to you regarding the following addresses, as I am considering purchasing these two properties: • 3651 Soundview Ave Peconic, NY 11958 (1000-68.-1-14.2) • 3645 Soundview Ave Peconic, NY 11958 (1000-68.-1-14.1) After extensive research, it appears that the properties were subdivided/"set- off" since two tax lots were issued,'as per ZBA decision #3418, dated October 18, 1985 and a Planning Department decision that took place on June 9, 1986. Further, I am providing a copy of a letter to Michael Hall, who was,the applicants attorney at the time, from Chairman Bennett Orlowski, Jr which references and confirms the Planning Department's approval of the "set-off". Our two questions currently are as follows: 1. How did the approved "set-off"file end up as an expired application w/the Planning Department?All conditions from both the planning department and the ZBA decisions seem to have been met, septic permits issued, a second home constructed, several CO's issued for both homes since these approvals and finally the property cards from the assessor's office referencing the approved "set-off' and the date the "set-off"was approved? 2. Please confirm that the final step is to provide 6 copies a final map? Additional documentation that we are providing for your convenience is as follows: • CO's for both.properties • Septic Permits • Property Cards • Letter from the Suffolk County Department Of Planning which deferred to oppose Southold Town's decision to approve the "set-off' Finally, our goal at this time is to work with the Planning Department to identify a path forward to close out the expired file to avoid any restrictions attached to a non-conforming property w/ two CO'd, year-round residences. Article III, Section 100-31, Bulk Schedule., Column "A-80" of the Zoning Code requires minimum sideyard setbacks at 20 and 25 feet for a principal dwelling structure. 4. The relief requested by this application is specifically a variance from the required 20 feet to 12.2 feet for the attachment of an existing stoop area containing approximately 30 sq. ft. , exclusive of the steps, to an existing sideyard deck, presently setback 17.0 feet from the south(westerly) property line at its closest points, all as more particularly shown on the survey amended October 6, 1988. 5. The dwelling together with the subject stoop area and sideyard deck was constructed pursuant to Building Permit No. 15665 dated February 5,. 1987. 6. It is noted that the lot in question was the subject of a prior Board of Appeals action rendered May 28, 1986 under Appl. No. 3418, which conditioned compliance of the "A-80" Bulk Schedule" as to minimum setbacks, and specific right-of-way improvements. 7. in considering this application, the Board also finds and determines: (a) the relief requested is minimal; (b) the relief will not alter the essential character of the neighborhood; (c) the difficulties are uniquely related to the property; (d) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the Mown, or be adverse to neighboring properties; (e) in view of all of the above factors, the interests of justice will be served by granting the relief, as requested and conditionally noted below. The surface has been regraded and is of uniform approval. Present trees and vegetation prevents traffic from leaving R.O.W. and should be maintained at its present condition with controlled vegetation maintaince to allow emergency vehicles proper passage. Timber guide rails should be considered at 1. 5 feet from road edge, as recommended by engineer but not considered mandatory. Again, I would recommend approval of this R.O.W. subject to maintaining it at its present condition with periodical maintaince on vegetation so as not to interfere with emergency vehicles. I call your attention to the right side of the road between lengths 540 ft. ± and 700 ft. from Soundview Avenue where there is hardly any shoulder width. The existing ground slopes down at estimated slopes of 1 on 2± to levels from 2 ft. to 5 ft. below the road edge. Would recommend placing shoulder material for a 3 ft. width in the above noted area. Also a timber guide rail could be considered at 1 . 5 ft. from the road edge. Would also recommend inspection by the Building Inspector prior to final approval of this access road. John W. The present roadway is passable but not in good condition . Some gravel was found at variable depths ; however , additional improvements are necessary to allow sufficient ingress and egress of fire trucks and other emergency vehicles . 5 . Although the area consists of lots substantially larger than the subject premises varying in size from four acres to 12 . 5 acres , it is the opinion of the board that the size , shape and character of this parcel lends to the practical difficulties in this situation since there is no alternative method of planning the layout or configuration for a set-off division without a variance . The parcel as exists with 3. 24 acres is 177% of the minimum lot area requirement of 80 ,000 sq . ft . In considering this appeal , the board also finds and deter- mines : (a ) that the relief requested is not substantial since the applicant has met 81 % of the area requirement for Lot #1 , and 96% of the area requirement for Lot #2 ; (b ) that the practical diffi - culties claimed are sufficient to warrant this variance ; (c ) the circumstances are unique and not shared by other properties existing generally in the neighborhood ; (d ) there will; be no substantial change in the character of the neighborhood , or detriment to adjoin- ing properties ; (e ) the difficulty cannot be obviated by some method feasible for appellants to pursue other than a variance ; (f) that in view of the manner in which the difficulty arose and in consideration of all the above factors , the interests of justice will best be served by allowing the variance , as conditionally noted below.
