ALL that certain plot, piece or parcel of lard, with the buildings and improvements thereon erected, situate,
lying and being in the Village of Orient, Town of Southold, County of Suffolk an
State of New York, bounded and described as follows:
BEGINNING at a monument set at the corner formed by the intersection of
the easterly side of Village Lane with the southerly side of Orchard
Street; running thence south 74 degrees 53 minutes 00 seconds east alon
the southerly side of Orchard Street, 116.26 feet to land now or former
of Rackett; thence along said last mentioned land the following two
courses and distances: (1) South 21 degrees 54 minutes 40 seconds west
56.72 feet; (2) North 68 degrees 19 minutes 50 seconds west 115.60 feet
to the easterly side of Village Lane; thence north 22 degrees 07 minute
20 seconds east along the easterly side of Village Lane 43.45 feet to t
corner aforesaid, at the point or place of BEGINNING.
There is a twenty (20%) percent interest in said property deeded by the
Party of the First Part to rhe Party of the Second ?art by Deed dated
December 20, 1982, and recorded December 27, 1982 in Liber 9289 of
Conveyances, Page 188.
It is the intent of the Party of the First Part to create, by way of
this Deed, a forty (408) percent undivided interest (twenty (208) perce
by Deed dated December 20, 1982, plus twenty (208) percent by this Deed
in the premises herein in the Party of the Second Part with the other
sixty (60%) percent -interest remaining in the Party of the First Part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said
premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly
enjoy the said premises; that the said premises are free from incumbrances, except as aforesaid; that the
party of the first part will execute or procure any further necessary assurance of the title to said premises; and
that sard,paety of the first part will forever warrant the title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
