The first order of business is for the Board to set Monday, November 13, 2000, at 6:00 p.rn. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting. Southold Town Planning Board Pa,qe Two October 23, 2000 PUBLIC HEARINGS Subdivisions - Final: Mr. Orlowski: 6:00 p.m. - Dickerson-Steadman - This proposed lot line change is to subtract 8,465 sq. ft. from a 9.52 acre parcel, SCTM#1000-122-2-24, and add it to an 11,272 sq. ft. parcel, SCTM#1000-122-2-6. The property is located on Sound Avenue in Mattituck. Are there any comments on this lot line change? Richard Lark, Esq., Main Rd., Cutcho.que: Good evening. I represent the applicant. I think it's pretty straight forward unless the Board has any specific questions that they would like to ask about it. (There were no questions from the Board.) Mr. Ca.q~iano: I'll offer the following: WHEREAS, Charlotte Dickerson is the owner of a 9.52 acre parcel, SCTM # 1000-122- 2-24, and Gregory and Catherine Steadman are the owners of an 11,272 square foot parcel, SCTM # 1000-122-2-6, both located on Sound Avenue in Mattituck; and WHEREAS, this proposed lot line change is to subtract 8,465 square feet from the 9.52 acre parcel, and add it to the 11,272 square foot parcel; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, did an uncoordinated review of this unlisted action, made a determination of non-significance, and granted a Negative Declaration on October 2, 2000; and $outhold Town Planninq Board Pa,qe Three October 23, 2000 WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on October 23, 2000; and WHEREAS, the $outhold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the $outhold Town Planning Board grant conditional final approval on the surveys, dated August 23, 2000, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. Mr. Orlowski: 6:05 p.m. - Harry & Lorraine Broom - This proposed lot line change is to divide an 11,517 sq. ft. parcel, SCTM#1000-10-3-25, between a 1,826 sq. ft. parcel, SCTM#1000-10-13-14, and an 8,748 sq. ft. parcel, SCTM#1000-10-3-15. 9,185 sq. ft. will be added to the 1,826 sq. ft. parcel, and 2,332 sq. ft. will be added to the 8,748 sq. ft. parcel. The property is located on Peninsula Road, Fishers Island. Are there any comments on this? Barry Rosenber,q: Mr. Chairman, I'm the owner of the property that is bounded by the two lots that are being named as being combined with the third lot. The property defined in one lot also includes a right-of-way and my original deed map upon acquisition of my property showed this right-of-way extending to the water line. The submissions that I received show the right-of-way stopping some 25 to 40 feet from the water line. I think Southold Town Planning Board Page Four October 23, 2000 it's appropriate that the right-of-way be continuous as it was in the original lot line shown before. Mr. Turner: Yes, we talked to the applicant about this and they found some information that they thought there might have been an error when they created the map and, according to the deed, you do have a 12 foot right-of-way down to the water and what we asked them to do is we are not going to sign the map until they give us a new map showing the right-of-way access down to the water. Mr. Rosenber.q: Under that condition then ! would withhold any objection. Mr. Orlowski: O.K. Any other comments? Hearing none, any comments from the Board? (There were none.) Wysocki is the owner of the parcel designated as SCTM#1000-20-1-3.4, all on the north side of Main Road in Orient; and WHEREAS, the three separate tax parcels were created by the conveyance of a life estate from Terry to Wysocki and the sale of the development rights to the Town of Southold on 28.65 acres; and WHEREAS, the subdivision application shows the three tax parcels as one piece of property and proposes to create a 1.84 acre parcel and a 30.49 acre parcel on which the development rights have been sold on 28.65 acres and the development rights remain intact on 1.84 acres; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on June 29, 1999; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on October 23, 2000; and Southold Town Planning Board Page Seven October 23, 2000 WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated September 5, 2000 and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. Before I get into the hearing held over on Cross Sound Ferry, I'm going to try to do a little bit more on this agenda and get some things out of the way. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET- OFF APPLICATIONS Final Extensions: Mr. Orlowski: Rockcove Estates - This major subdivision is for 23 lots on 28.315 acres located on the north side of Middle Road (CR48); approximately 500 feet west of McCann Lane in Greenport. SCTM#1000-33-3-19 I'll make the following motion: BE IT RESOLVED that the Southold Town Planning Board grant a retroactive six month extension of conditional final approval from September 20, 2000 to March 20, 2001. 'rhe lot line changes are to subtract 33,273 sq. ft. from the original 21.08 acre parcel and to add 13,172 sq. ft. to an adjacent parcel to the west and 20,101 sq. ft. to an adjacent parcel to the east. The lot to be set off is 0.966 acres. The development rights will be purchased by the Town on the remaining 19.347 acres. The property fronts on the north side of CR 48, the east side of Mary's Rd. and the south side of Wickham Ave. in Mattituck. Southold Town Plannin,q Board PaRe Thirteen October 23, 2000_ Hearings Held Over From Previous Meetings: Site Plans: Mr. Orlowski: 6:15 p.m. - Cross Sound Ferry - This proposed new site plan is to amend the June 6,1995 site plan for the Cross Sound Ferry Company Terminal. The subject site encompasses three parcels located on the west and east sides of SR 25 at its eastern-most terminus in Orient. SCTM#1000-15-9-10.1 and 11.1 and 15.1 This hearing is still held open. The applicant is working on a site plan and the Board is working on the SEQRA. We have it open for public comment. We'd like to hear new comments. We've heard a lot of comments at the last meeting. At this time, I'll open il: up to whoever wants to make a comment. We, most likely, will be keeping this open until ali of us get our work done. We have to finish our SEQRA document and the applicant is working on a stamped site plan. Does anybody have any comment on this site plan? Richard Warren, Inter-Science Research Associates: I'm here on behalf of Cross Sound. We had a fairly lengthy public hearing back on October 2nd and we're here again tonight. Mr. Wronowski is here. We would ask the Board - we understand that you're in the process of completing the SEQRA. We're in the process of doing the engineering drawings which we've commissioned with John Raynor from Watermill. We ask the Board if you would just suspend the hearing so that you don't just carry on meeting to meeting, causing us to have to come to this meeting and wonder about what's going to be said. At the public meeting there was an opportunity for the public to speak. The property was noticed. We had notices in the paper. We understand that you might be concerned that the public may want to have the opportunity to look at the engineering drawings and say something about the engineering drawings. But the fact that we're here and the fact that there's no one in the public that wishes to speak, I think it's intelligent from the Planning Board's perspective - and certainly it's helpful from our perspective - if you would suspend the hearing until such time as both the SEQRA is completed, the engineering drawings are completed and filed and then continue with, hopefully, one final hearing so that people would comment. ~t's going to take us some time to get the drawings done. We're in the process of doing it. It's a complicated process for us to get them done. Whether we like it or not, it is. So we ask that, in order to keep from burdening your agenda and making it difficult from our side, that you would consider closing this hearing with an understanding that you would re-open it at such time when those drawings would be received and reviewed. Mr. Orlowski: How much time do you think you will need? Southold Town Planning Board .Page Fourteen October 23, 2000 Mr. Warren: I'd like to think that they would be done in a month. .Mr. Orlowski: O.K. The Board has that option to adjourn the hearing and not close the hearing. We will not close the hearing until all of the documents are in. That will be up to the Board. Are there any other comments? (There were none.) O.K. Hearing none, i'm going to - I don't want to make a motion to close it - I think a motion to adjourn would be proper until all of the documents are in that everybody can review. We can open up this hearing and meet again here in three weeks. We can put a resolution on to put the hearing on for our next meeting after that. This way it would stop everybody from having to come out without looking at anything, it's probably a good idea. I'll entertain a motion from the Board to adjourn the hearing for Cross Sound Ferry.
