Dear Mr. Krupski and Board of Town Trustees,
On June 28,2002, I received approval from the board of trustees to transfer permit #1989 into
my name from the previous two owners of my current residence located at 5545 Skunk Lane,
Cutchogue, NY.(attacj:J.ed)
When I applied for this permit change, I also requested approval for a fixed dock on adjoining lot
# 112 to be considered. I was advised that I should reapply for the new permit after I completed
the transfer of permit # 1989.
I wish to formally apply for either an addendum to permit # 1989, or to request a seperate permit
for the following fixed dock leading to a floating dock on lot #112. (S.C.T.M. Dist. 1000-138-02,
lot 9&18).(survey dated 12-27-02 attached)
The proposed new addition applies to lot #112, which currently has approx. 70 ft.ofwood
bulkheading and would begin approx. 32.5 feet from the SE waterfront property line.
I would like to add a 5 ft. fixed-angled dock extending 24 ft. over the wetlands to a 4ft. x 8ft.
ramp leading to a 5ft.xl6ft.long floating dock joined by a 4ft. x 8ft. floating dock.(attached
drawing)

The new construction would be constructed in such a way ,( approx. 6 ft. high over ground line)
from the existing bulkheading as to not disturb the wetlands in any way.
I request this permit so that my children can dock our currently owhed boats, (9ft.
inflatable#NY2407LJ, 8ft. watertender #NY2736EK, andI4ft.aluminum#NY5207JY) in a safe
area for them to have easier access.
Lot #111 has a wood dock with slips appropriate for large boats or adults. My children use their
small boats which are difficult to tie up using the existing pilings. Also, the action of the tides
result in periodic very low water depths leaving a distance greater than 4.5ft. from the existing
wood dock height to the bottom of their boats.
My concern is for the safety of my cWidren as well as for several of my older family members who
have difficult)' amhn\..ting and useassistive devices_l believe that it will be safer and easier for my
family members to access the boats from a floating dock.
On both sides of my hom~ as weILasalO1lgth~entire stretch of waterfront properties ~ted on
Skunk Lane, are many docks connecting with floating ramps which are similar to the one I am
proposing. Also~l did notice that the. previous owner, Dr. Perlmutter, received approval in 1990
to add a ramp over said wetlands, however, he never completed the project.(attached)

Dear Mr. Kujawski:
In confirmation of our conversation and your on-site visit of this past summer,
I wish to formally request an addendum to the existing dock permit *1989 which
applies to the existing dock at 5590 Skunk Lane, Cutchogue.
The proposed new addition will consist of a ramp, attached to the existing
bulkheading and projecting over the wetlands in such .a waYias not to disturb
them whatsoever. The unattached end of the ramp will float freely with the
tide.
For your review I have attached a rough draft of the proposed ramp, which is
slated for construction this coming Spring (1990).
Thank you for your attention. This should alleviate the problem which had
existed at the north end of the existing dock.

The following action was taken by the Town Board of Trustees at its
regular meeting held on January 25, 1990.
RESOLVED that the Town Trustees approve the waiver request made by
Michael J. Perlmutter to add a ramp to existing bulkheading and
projecting over the wetlands in such a way as not to disturb them.
The unattached end of the ramp will float freely with the tide.

Dear Mr. Kujawski:
In confirmation of our conversation and your on-site visit of this past summer,
I wish to formally request an addendum to the existing dock permit *1989 which
applies to the existing dock at 5590 Skunk Lane, Cutchogue.
The proposed new addition will consist of a ramp. attached to the existing
bulkheading and projecting over the wetlands in such a way, as not to disturb
them whatsoever. The unattached end of the ramp will float freely with the
tide.
For your review I have attached a rough draft of the proposed ramp. which is
slated for construction this coming Spring (1990).
Thank you for your attention. This should alleviate the problem which had
existed at the north end of the existing dock.

Re: Boat docking facilities
Dear Dr. and Mrs. Perlmutter:
It has come to our attention that you may not be aware of the
Southold Town Code in regard to boat docking facilities.
Please be advised that according to the Southold Town Code, Chapter
100.31(3) abc, boat docking facilities for the docking, mooring or
accommodation of non-commercial boats, are subject to the following
requirements:
(a) There shall be docking or mooring facilities for no more than 2
boats, other than those owned and used by the owner of the
premises for his personal use.
(b) The Town Trustees shall approve new boat docking facilities.
(c) Boats at such docks shall not be used for overnight sleeping
purposes.

I was distressed at the unreasonable nature of the request
contained in the 'August 7, 1989 communication from the Board of
Town Trustees. The facts are as follows:
a)
My 28' boat draws 31 feet of water from the water
line to the tips of the two fixed rudders.
The water on the south side of my dock is deeper
than the north side; never the less, ingress and
egress is difficult at low tide. (EXH. la1b1c)
Going north from my dock, environmentally sensitive
vegetation takes over and any type of docking is not
practical. (EXH Id)
The north side is used to keep my other boat, a
shallow draft 14 foot outboard, which is high and
dry at low tide. (EXH. Ib1c)
Granted that "title" does not include creek bottom,
it is interesting to note that my boat, on the south
side of the dock essentially falls within the exten-
sion of my southern property line. (EXH. 2 & SURVEY)
Although not limited to the facts aforementioned, it
is apparent that it is unreasonable and unwarranted
to limit my "quiet enjoyment of deed and dock.

It would be presumptious on my part to suggest what the com-
plaintant could do, rather I would set forth certain facts for
your consideration:
1) To my south, there exists bulkheaded slips for (5)
boats, in addition to another 70 feet or so of low
bulkhead, for a total of some 140 feet. (EXH. A1A2A3)

2) There is an area to the south of the (5) slips
that is devoid of vegetation. (EXH. B)
3) Other property owners have ramped over to pro-
tect sensitive vegetation in accordance with
published TRUSTEES guidelines. (EXH. C)
4) The launching of any boat over wetlands is
damaging to the environment and should not be
permitted. (EXH. B, Dl' D2)
In summation, the facts do not warrant any limitation
on the reasonable use of my property, and further, that the
complaintant be "requested" to cease and desist damaging the
wetlands both on his property and mine.

I wish to thank you for your letter of the above date (copy attached for your
reference). Please be advised that I am quite well aware of the Southold Town
Code chapter which applies.
Please be advised that we are fully in compliance with the code, specifically:
(a) There are not more than two boats docked or moored at the facility
which are not owned and used by me personally.
(b) This facility is not new, and has been in existence since prior
to the purchase of the premises by me.
(c) No boats at the facility are utilized for overnight sleeping
purposes.
If you would like to discuss this matter further, please feel free to contact
this office.

Dear Dr. and Mrs. Perlmutter:
It has come to our attention that you may not be aware of the
Southold Town Code in regard to boat docking facilities.
Please be advised that according to the Southold Town Code, Chapter
100.31(3) abc, boat docking facilities for the docking, mooring or
accommodation of non-commercial boats, are subject to the following
requirements:
(a) There shall be docking or mooring facilities for no more than 2
boats, other than those owned and used by the owner of the
premises for his personal use.
(b) The Town Trustees shall approve new boat docking facilities.
(c) Boats at such docks shall not be used for overnight sleeping
purposes.
