Dear Mr. Magill:
The Board of Town Trustees took the following action during a Regular Meeting, held on
January 22,2003 regarding the above matter.
WHEREAS, Alfred A. Magill applied to the Southold Town Trustees for a permit under the
provisions of the WetIand Ordinance ofthe Town of Southold, application dated December 31,
2002.
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 22, 2003 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southo1d
Town Code.

WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of Alfred A.Magill
For a Wetland Permit to remove "old" house/block foundation/replace with poured concrete
foundation - new home on the same footprint with drywells, gutters and haybales.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Ifinspections are required, at a fee of$5.00 per inspection (See attached schedule).
FEES: $10.00

Whenever the Code calle ror a public hearing, this section
shall apply. Upon determining th.1 an appUcation is complete,
. the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The hoard or commlssi.on
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, dat.e. place and
nature of the hearing to be publiehed In the official
neW!paper within the period prescnbed by law. .
B. By requiring' the applicant to erect the sign provided by
the town, which shall be prominentJy displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more. than ten
(10) feet from the property line, The sign ,hall be
di8pla~d for a period of not less than seven (7) days
immediately pteceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
slbe has complied with this provision.
C. By requiring the applicant to send notice to the owners
of record of every property which abuts and every
property which is across from any public or private street
