The following action was taken by the Southold Town Board of Trustees on Wednesday
August 24, 2005:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit # 186 and 1911 as follows:
Remove all of the existing asphalt area (driveway and area near creek) and repave an
area of asphalt approx. 30' x 32' for parking and basketball with the CONDITION that a
boat and trailer be removed from the high marsh area and moved into the upland, and
that native grasses with no fertilizers, chemicals, or underground sprinkler systems be
used within 50' of the wetlands, and all as depicted on the plan drawn by JMO
Environmental Consulting and received August 3, 2005 by the Trustees.

Here is a copy of the Notie~ of Violation that Itcc, eived on Saturday July 23, I would like
to add an amendment to my existing pen-nit which I re~ived about 2 years ago that
allowed me to r~fir my bulkh~ and remove some asphalt near and in the creek,.
Aa I mentioned on the phone I did not think that the new asphalt was anywhere close to
the 100 foot wetlands boundary. I did call the Trustees office prior to starting this proje~
aaa Was told no permits were rextuked if it was outside the I00 foot boundary, I did not
~ that the Bay Constable would be measuring from an area in my neighbors yard,
from which the asphalt is approximately 96 feet to the wetlands. I measured from the area
that was used to map out my b~_~_!~_head repairs and I measured about 130 feet to the
asphalt.
Since purchasing this pmpexty about 5 years ago I have elim_i_a__ated a very serious run off
problem. The property had an asphalt drivc~vay and parking area that came from
Fleetwood road down the driveway and asphalt coveted about 80% of the area between
the house and creek, rain water would nm from Fleetwood Road down the driveway and
right into the creek. There was ~vea an asphalt boat ramp in the back yard that went right
into the creek.. If you look at the sur~ey you can see the blacktop area I am referring to.
This was a s~.Hous mu off situation that I asked the Trustees for permission to remove
whoa I mpaked my bulkhea& They granted permission and I remove the asphalt and I am
in th~ process on trying to reestablish natural wetland vegetation ia this ar~ I am very
conscious on the wetlands and the laws that are in place to protect them.
I am also in the process of growing grass and planting bushea around the new asphalt to
minimize any runoff that this new area may produce.
Again I would n~v~ have gone ahead with this project without a pcmit ifI thought that I
was within the 100 foot wetland area. I would prefer to keep the new asphalt as I have put
a basketball hoop up and my yard is now the gathering place for thc neiCa mood
children, P~rso~ally, I would rather have them hanging out in my yard then on a street
comer somewhere.
Please forward me the appropriate paper work that I will nccd to apply for an mncndment
to my existing permit, if this ia the best solution to the notice of violation. It can be

January 23, 2002 and revised as of April 23, 2003.
RESOLVED, that the Southold Town Board of Trustees Approve the request for a Transfer of
Permit # 1911 & 186 from the name of June K. Hussey to the name ofDebra & Philip Rybecky
and an Amendment to permit #1911 and 186 to resheath +/- 1 I7 of timber bulkhead to extend
western return 8' landward, to close a 35'x26' section of existing boat basin by installing 35' of
new bulkhead, to widen the remainder of the basin by removing 40' of timber bulkhead and
excavating 10'x40' area to -4' ALW, excavated material (60 c.y. of sand) shall be used to fill the
southern portion of the basin, to install 38' of new bulkhead to remove 20' of timber bulkhead
and to reconstruct 5' landward to dredge the northem portion of the basin (28'x40') to -4' ALW
the resultant spoil (+/- 72 c.y. of sand) to be placed in the southern portion of the basin along
with +/- 60 c.y. clean sand to be trucked in from an upland site to complete the filling of the
basin and to install a 3'x12' ramp and 6'x20' flat - all bulkhead sheathing shall be vinyl.

Dear Mr. Kmpski:
At the present time I am writing you on behalf of the Rybecky's regarding their property
on Eugenes Creek in Cutchogue. It is my understanding that the Rybecky's had appeared
in front of the Board requesting that Permit No. 1265 and No. 1911 be transferred to
them from June L. Hussey and to amend Permit No. 1265 and No 1911.
For your review I have enclosed copies of the plans we have prepared at the Rybecky's
request to reflect that work they wish to perform. The project description is that the
"applicant proposes to resheath + 117 of timber bulkhead, to extend western return 8-
landward, to close of a 35'x 26- section of existing boat basin by installing 35- of new
bulkhead, to widen the remainder of the basin by removing 40- of timber bulkhead and
excavating a 10-x 40- area to -4-ALW, excavaded material ( 60 c.y. of sand) shall be
used to fill the southern portion of the basin, to install 38- of new bulkhead, to remove
20- of timber bulkhead and to reconstruct 5- landward, to dredge the northern portion of
the basin (28- x 40-) to -4- ALW, the resultant spoil (+ 72 c.y. of sand) to be placed in
the southern protion of the basin along with + 60 c.y. of clean sand to be trucked in from

Dear Board of Town Trustees,
Please find the enclosed request for an amendment to the attached permits, along with my
request to transfer the all existing permits on file in the name of June L. Hussey or for
this property (1065 Fleetwood Road, Cutchogue, NY- SCM# 1000-137-4-24) into my
name as I purchased this residence in July 2000. My check for $50 is enclosed.
The purpose of this request is to have the part of the existing bulkhead approx, t65 feet
which was replaced in 1977 on permit #1265 replaced. The condition of this part of the
bulkhead is very poor which has allowed the fill behind the bulkhead to fall into the creek
from below. The newer section of the bulkhead approx. 100 fl. replaced in 1984 on
permit #1911 is in better condition, and only needs to be resheated from the landward
side. As in the last permits, recovery of lost sand would also be requested. I have
attached a sketch with both areas clearly marked. ! have contacted John Hocker of
Latham Sand & Gravel as my contractor to perform this work if a permit is provided.

The New York District, U.S. Army Corps of Engineers, has
received a request for Department of the Army authorization for
the following activity:
APPLICANT:

ACTIVITY
The work would i'nvolve re-configuring the
waterward end of a private residence as follows:
Close off a 26' wide by 36' long portion of a boat
basin with 35 linear feet of new vinyl bulkhead,
and fill it with 132 cubic yards of sand from an
approved upland source and from dredging, which
would be graded to match the surrounding
elevations and planted with high marsh vegetation
or beach grass 12" on center; and expand the
remaining boat basin by excavating/dredging 60
cubic yards of material from a 10' wide by 40'
long area adjacent to the bulkhead, to a depth of
4 feet below the plane of mean low water.
Install a pier assembly consisting of a 3' wide by
12' long ramp and a 6' wide by 20' long float
within the boat basin, chocked to maintain a
minimum of 2 feet of water at all tidal stages.
Under authority of the Nationwide Permit Program,
Nationwide permi~ number 35, dredge 72 cubic yards
of sand from the remaining boat basin to depth of
4 feet below mean low water, utilizing a clamshell
dredge with dredged material to be used as fill in
the closed off area of the boat basin and behind
the bulkhead.
Under authority of the Nationwide Permit Program,
Nationwide permit number 3, remove 40 linear feet
of bulkhead, install 20 linear feet of vinyl
sheathing, and replace, within 18 inches, 117
linear feet of timber bulkhead and construct an 8
foot return extension.
Under authority of the Nationwide Permit Program,
Nationwide permit number 27 and due to state
requirements, remove 2,340 square feet of existing
asphalt adjacent to the boat slip, some of which
is located in the intertidal zone and high marsh
area, and plant the area with S~artina
alterniflora 6" on center and Spartina patens 12"
on Center to mitigate for filling an area of the
boat slip.
The stated purpose of this project is to enhance
water access and prevent erosion.

Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the

Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.

All applicants for permits* including Town of Southold a. Al* for
proposed actions that are subject to the Town of SoutholdWa v. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including BuiMing Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanafions of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a

Trustees.
If your application is approved above, a Permit Fee is now due, and
should be made payable to the order of the Board of Southold Town
Trustees. This fee is computed below according to the Schedule of
Rates as set forth in the Instruction Sheet (Form I/I}. This fee must
be paid within 90 days or reapplication and additional fee will be
necessary.
If the Permit Fee is paid in person to the Clerk of the Board, the Permit
will be obtainable at the same time. If the fee is paid by mail, the Permit
