Isaksen, Jr., last dated June 7, 2004 and received on June 27, 2007, and determined the proposed work on the dwelling consisting of replacing the windows, new outside doors, new roof and painting to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Southampton, NY 11968 RE: DAVID CORCORAN 405 FLEETWOOD RD., CUTCHOGUE SCTM#137-4-15 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on November 17, 2004 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of DAVID CORCORAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 27, 2004, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 17, 2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, z WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold `own Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of trie town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of DAVID CORCORAN to remove and replace (in-place) approx. 83 linear ft. of existing timber bulkhead (forming boat slip) with vinyl bulkhead; maintenance dredge 30'X 30' area within boat slip to a max. depth of ALW; spread approx. 45 of 85 cy. sand/silt spoil landward of bulkhead as backfill; and truck remaining spoil to an approx. upland source. Please provide a survey photocopy and a deed photocopy with the description supporting the survey and thus substantiating the extent of your client's ownship. If the property is owned by the Town please/submit infomation confianing permission to do the proposed work. Also please provide information documenting whether the dredge depth is appropriate including whether the waterway that the dredging would abut is maintained at the same depth. The proposed work would be located within the Cutchogue Harbor and Wetlands Significant Coastal Fish and Wildlife Habitat (narrative copy enclosed). Please therefore discuss whether the proposed dredging of material will be performed only from 9/15 - 3/15 or within silt curtains. The requested information is necessary to assess the consistency ofthe proposal with the NYS Coastal Management Progtam. If this necessary information and data is not provided within thirty days of the date of this letter, the Department of Slate may close the file regarding [his proposed activity. With regard to Policy 15, maintaining navigable water depths at the subject site should not cause an increase in the erosion of downdrift lands. With regard to Policy 35, the turbidity h7cely to resuh from the dredging activities will be localized and ephemeral in nature. Therefore, there will be no adverse effects on adjacent fish habitat. Finally, it will be necessary to secure Article 15 and 25 permits from the NYSDEC to ensure that the project will meet State dredging permit requirements. Thus, the proposed project will be consistent with Policies 15 and 35. 2a) The proposed project is located adjacent to State designated tidal wetlands, and thus must be consistent with Policy 44. Because the project wilt not affect the benefits derived from tidal wetlands and will require a Tidal Wetlands Act permit from the NYSDEC, it will be consistent with Policy 44. 3a) Because the proposed activity will occur at a waterfront site, it must be c~~nsistent with Policies 2, 21, and 22. The project will be consistem with 1) Policy 2 becayse the proposal is considered a water dependent use by this policy; and 2) Policy 22 in th sl it will not inhibit or prechule existing or future water-related recreation on the adjacent waters. Policy 22 does not apply to the project. 3c) Because the proposed activity includes construction of an erosion control structure, the proposed project must be consistent with Policies 13, 14, and 16. Pursuant to Policy 14, placement of the structure will not cause or increase erosion at adjacent properties. The net effect of the project should only be to preve~ further erosion of the subject property, without causing adverse effects to adjacent properties. The structure will be designed and constructed in accordance with generally accepted engineering practice, and thus, excluding any catastrophic occurrences, has a reasonable probability of controlling erosion for at least thirty years.
