Dear Mr. Herrmann,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on January 22, 1999, regarding
the above matter:
WHEREAS, ANDREAS KARACOSTAS" applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated November
23, 1998 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 22, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southo1d Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
ANDREAS KARACOSTAS, to remove and replace, inkind/inplace the
failing structure (retaining wall) and area landward and
backfill and replant with Ammophilia breviligulata, with
condition that contractor call our office before work begins due
to concern of construction access to site. Located: 21275 Sound
View Ave., Southold.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete proiect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held
Tuesday, December 15, 1998 the following recommendation was made:

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Permit and Coastal Erosion Permit Application
of ANDREAS KARACOSTAS 135-1-2 to place on filter cloth within 4' of
existing timber retaining wall 40+/-' of 1 - 3 ton toe armor stone.

The CAC recommends disapproval based on the following:
1. Concern about the environmental impact of putting stones below the
Mean High Water
2. Is this the best solution to the problem? The CAC believes fixing the
bulkhead and bluff management may be a more appropriate solution.
3. Concerns with existing framed sheds on bulkhead.
4. Concerns about the storage of outboard gasoline in shed.

Dear Sir:
This is in reference to a "Notice to adjacent property owner" in the~i~:
matter of Andreas Karacostas (SCTM#1000-135-1-2), received by Certified
Mail on 20 Nov. 1998, and an enclosed copy of sketched plan showing the
proposal.
Please be informed that the attached sketch is inaccurate and mislead-
ing. It presents a bulkhead being vertical throughout its sketched
length and apparentlY in good condition. Yet, in reality, a good part
of the bulkhead between our properties is severely damaged, having
pached holes at the level of the proposed stone placement; but what is
worse is that it is progressively leaning north, towards the water, at
such a precarious angle that the top protrudes almost three feet, at
.its furthest point, from its original vertical position!
This has been attributed by Mr. Karacostas to the progressive erosion
of the beach due to a jetty, built at the west border of his property.
He has frequently expressed his displeasure of the impact caused by
that jetty i.e. the built up of the beach west of the jetty and serious
erosion of his beach on the east. His intent was to build a jetty on
Qis eastern border. We strongly opposed this solution to him, as the
~ffect would be disasterous to our already eroded beach, apart from the
fact that it was illegal. Another measure he said he was thinking of,
was to remove stones from the already existing jetty and place them in
front of his leaning bulkhead. This would be less expensive, but only a
half-way measure, destined to prove more expensive in the long run.
Recently Mr. Karacostas seemed to agree with us that the most sensible
solution of the problem is to replace the leaning part of the bulkhead
of an about 80 ft. length. We proposed to share the expense on a 50/50
basis, though it is apparent that the inside pressure which caused the
displacement of the top of the bulkhead is due to inadequate
stabilisation of his bluff.
We are disturbed to see that now Mr. Karacostas has gone back to his
previous idea to place stones in front of his bulkhead, a half-way
measure to which we are fully opposed for the following reasons:
A): We have received expert advice that, even if the width of the stone
-
placement is no more than four feet from the BOTTOM of the leaning part
of his bulkhead, it is bound to cause a "jetty effect" on our beach,
causing further beach erosion to the east and built up of beach to the
west and in front of it. (If the width is meant to be four feet from
the TOP of the leaning bulkhead, then it will be almost seven feet from
the bottom and the "jetty effect" will be even worse!)
B): It will be impossible for us to go ahead with our plan to rebuild
OUr part of the leaning bulkhead, because if Mr. Karacostas does not do
the same, this will cause a gap between his leaning and our vertical
part Of the bulkhead with detrimental results for both our properties.

Perhaps it should not be surprising that Mr. Karacostas remains
categorical with his steady refusal to assume any responsibility for
possible damage to our property as a result of the proposed placement
of toe armor stone in front of the most eastern part of his bulkhead.
It seems to us quite unlikely that anyone else, including the Board of
Trustees itself, would wish to assume any such responsibility.
Please notify us of your planned site visit, as we will arrange to be
present.
