Patricia C. Moore, Esq. on behalf of TERRY TRIADES requests an Amendment to Permit#6351 to repair the existing stairs, in-
kind and in-place. Located: 2505 Sound View Ave., Mattituck. SCTM494-1-12.2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action is EXEMPT pursuant to§ 268-3; provided that the stairs are to be repaired in-kind and in-place.
MINOR ACTIONS--Include the following actions,which are not subject to review under this chapter:
A. Maintenance or repair involving no substantial changes in an existing structure or facility;

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CC for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).

achievement of the LWRP policy standards and conditions contained in the consistency review law.

Meeting held on Wed., September 17, 2008:
WHEREAS, Patricia C. Moore, Esq. on behalf of TERRY TRIADES applied to the
Southold Town Trustees for an Amendment to Wetland Permit#6351 under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated August 18, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 19, 2006 regarding the above matter:
WHEREAS, En-Consultant, Inc. as agent for TERRY AND FRANCES TRIADES
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the South old Town Code, the Wetland Ordinance of the Town of Southold,
application dated March 29, 2006, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of TERRY & FRANCIS
TRIADES to construct approx. 120 linear ft. of vinyl retaining wall and backfill blown out
face with approx. 2,000 cy. of clean sand to be obtained partially from recovered
blowout material and partially trucked in from an upland source and replanted with
beach grass, Rosa Rugosa, and Bayberry, with erosion control matting to be used, toe
armor added where there is no gabion, and with the conditions that there be a 15' non-
turf buffer on the landward side of the crest of the bluff, and access will be from Bailey
Beach Road, and all as depicted on the plan prepared by En-Consultants, Inc. revised
5/11/06.
Permit to construct and complete project will expire two years from the date the permit
Is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., April
12, 2006, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, to
TABLE the Wetland Permit and Coastal Erosion Permit applications of TERRY &
FRANCIS TRIADES to construct approx. 120 linear ft. of timber retaining wall and
backfill blown out face with approx. 2,000 cy. of clean sand to be obtained partially from
recovered blowout material and partially trucked in from an upland source and replanted
with beach grass, Rugosa Rose, and Bayberry.
Located: 2505 Sound View Ave., Mattituck. SCTM#94-1-12.2
The CAC Tables the applications and recommends an engineer review the plans.

The proposed action has been reviewed to Chapter 9S, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the following Policy Standards and therefore is
CONSISTENT with the LWRP.
Policv Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
. D. Use hard structural erosion protection measures for control of erosion only
where:
2. Vegetative approaches to controlling erosion are not effective.
3. Enhancement of natural protective features would not prove
practical in providing erosion protection.
4. Construction of a hard structure is the only practical design
consideration and is essential to protecting the principal use.

A. INSTRUCTIONS
1. All applicants for pennits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its sil!l1ificant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).

affect the achievement of the L WRP policy standards and conditions contained in the consistency

unprotected section of shoreline renders the continuation of those structures across the propertY the only
practicable method bv which the severely eroding bluff toe and face can be restored and stabilized over the long
term. i.e.. for at least 30 Years. The bluff face will be restorativelv filled and vegetatively enhanced. and !liven
the alreadv hardened nature of the surrounding properties. the proiect could have no adverse impacts on those
properties. There will be no direct or indirect costs incurred bv the public as a result of the implementation of
this proiect. which was originally authorized in part pursuant to Town Wetlands Permit No. 4980. issued
November 18. 1998. The work was never undertaken.
