To Whom It May Concern,
On February I5, 2006, B. Laing Associates, Inc. on behalf of George Baldwin, received a
permit from the Town of Southold Board of Trustees under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April
11, 2005.
The permit received is for a maintenance dredge for 50 cy to maintain navigable water
depths. We received our final, New York Department of Environmental Conservation Permit in
the Fall of 2007. We now have all permits in place to do this work. We also have a contractor
close to being chosen. However, due to the difficulty of scheduling a dredger during the
allowable dredging time frame in 2007 and again in 2008, the dredging has not yet been done.
At this time, on the behalf of George Baldwin as his agent, B. Laing Associates, Inc
would like to request for a permit extension. We understand that this matter will need to be
reviewed by the committee during the monthly boazd meeting and I would like to bring to your
attention that the permit expires on February 15, 2008.

On February 15, 2006, B. Laing Associates, Inc. on behalf of George Baldwin, received a
permit from the Town of Southold Board of Trustees under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April
I1, 2005.
The permit received is for a maintenance dredge for 50 cy to maintain navigable water
depths. We received our final, New York Depaztment of Environmental Conservation in the Fall
of 2007. We now have all permits in place to do this work. However, due to the difficulty of
scheduling a dredger during the allowable dredging time frame in 2007 the dredging has not yet
been done.
At this time, on the behalf of George Baldwin as his agent, B. Laing Associates, Inc
would like to request for a permit extension. We understand that this matter will need to be
reviewed by the committee during the monthly boazd meeting and would like to kindly request it

Dear Mr. Bontje:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 15, 2006 regarding the above matter:
WHEREAS, B. Laing Associates as agent for GEORGE BALDWIN applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated April 11,
2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 15, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of GEORGE BALDWIN
to maintenance dredge 50 cy. to maintain navigable water depth, with the condition that
a turbidity screen be put in place during dredging or dredge at low tide. Dredge spoil will
be placed across the street to the north on the lot SCTM# 57-2-g, and 3 -5 cubic yards
of dredge spoil to be placed behind the Baldwin's bulkhead; with the condition that there
be a 10' non turf buffer landward of the bulkhead at the completion of the project, and all
as depicted in the plans prepared by John Gendron on 3/3/05.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Honorable Trustees:
Please find enclosed the benthic data you requested in yow correspondence of
June, 2005. At this time, as a result of ow analysis of the benthic data, we are increasing
ow dredging requests to 50 cubic yards each.
In addition to the requested data, we would like to respond to correspondence
from ow neighbor to the east, Mr. Torpey. In a letter dated June 26, 2005 he has
provided two comments. The first is that he be notified of any further hearings in regard
to the referenced matter. At the time of the prior scheduled hearing, notice was provided
by postings on all fow properties. However, prior to the date for notice by mail, the
hearing was postponed to await receipt of the above data. When we approach the next
hearing date, we will again be happy to post such information on ow properties, will we
mail the proper individual notices and I am swe .the Trustees will provide newspaper
notice of same. It is likely to be winter and harder to arrange to see folks but we will also
try to speak with Mr. Torpey as well in regard to the project.
With regard to potential "odor' issues, this is an unlikely condition. I say so as I
was present during at least two days of the prior work in the mid 1990's. At that time,
considerably more material was dredged from the creek in front of the Bontje and
Mulholland properties. The smell of salt seemed more evident to me but no trace of a
malodorous condition was noted by me or ow neighbors: This was also true of the
"disposal" site. Further, I was in my residence during 1988 when Baldwin and Carlucci
had a considerable pile of dredge spoils in Mr. Baldwin's side yard for many months.
Again, no trace of a malodorous condition was noted by me or ow neighbors.

Disposal of the dredged materials is proposed to occur in three separate locations.
Approximately 20 yards of material will be used on Mr. Mulholland's upland property,
10 yards will be used on my upland property, and the balance of 170 yazds of material
will be used on Mr. Cazlucci's upland spare lot. Mr. Cazh?cci's spaze lot is located no h
of Island View Lane (#860 Island View Lane) and no wetland occurs within 100 feet of
the property. All of the disposal areas will have a silt fence/hay bale struchue to prevent
erosion on the downhill side of any dredge spoil piles. Once the piles have been
sufficiently dewatered and desired grading has been achieved, final stabilization will be
accomplished by seeding with afast-germinating, grass seed mix.

scheduling and attending the Trustees' hearing.

At the meeting of the Southold Town Conservation Advisory Council held Tues., June
14, 2005, the following recommendation was made:
Moved by Tom Schlichter, seconded by William Cook, it was
RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of GEORGE BALDWIN to
maintenance dredge 25 cy. to'maintain navigable water depth. Dredge spoil will be
placed on Mulholland property with majority being placed on Bandichuck and Carclucci
properties north of Island View Lane.
Located: 1045 Island View Lane, Southold. SCTM#57-2-21
The CAC recommends Approval of the application with the Condition the fill is placed in
an appropriate area and proof that the area has been dredged in the past.

As this is minor in nature, authorization may be by Letter

Regulations governing work in navigable waters of the United ,
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c)(3)(A)), the applicant.

June, 2005. At this time, as a rnsuh of orrr analysis of the benthic data, we are irigrasing
oux dredging xequests to 50 cubic yards each.
In addition to the requested data, we would like to respond to oorrespo~adence
from ow neighbor to the east, Mr. Torpey. In a letter dated June 26, 2005 he has
provided two comanerrts. The first is that he be nadfied of any further heanngs in regard
to the referenced matter. At the time of the prior scheduled hearing, notice was provided
by postings on all fowr properties. However, prior to the date for notice by mail, the
hearing was postponed to await xeoeipt of the above data. When we approach the next
hearing date, we wi11 again be happy to post such information oa our propet'ties, wi11 we
mail the proper individual notices and I am sure the Trustees wip provide new~3paper
notice of same. It is likely to be vrinRer and harder to arrange to sec folks but we will also
try to speak with Mr. Torpey as we11 in regard to the project.
With regard to peteahal "odor" issues, this is art unlikely condition. I say so as I
was preserrt during at least two days of the prior work in the mid 1990' x- At that time,
considerably mote material was dredged from the creak in fiont of the Bontje and
Mulholland properties. The smell of salt seemed more evident to me but no trace of a
malodorous condition was noted by me or our neighbors. This was also txue~ of the
"disposal" site. Further, I was in my xesi rderrce B~dwl'u9i$s y~ ~ m~lonths.
