by the party of the second part, does hereby grant and release unto the party of the second part, the heirs, or
successors and assigns for the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
andbeingjKXW at East Marion, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot No. 12 on a certain
map entitled "Map of Soundcrest Woods, Section 1" filed in the office
of the Clerk of the County of Suffolk on June 9, 1969 as Map No. 5315.
The following cofrenants and restrictions apply to this lot:
1. Each house shall have a minimum of one thousand (1000) square feet
of living area on the ground floor and a garage for not more than
two vehicles. No construction shall be located closer than forty
(40) feet from the street line. Trees may be removed from the
premises only as necessary for the purposes of construction.
Cesspools shall be located in the rear of each lot.
2. No more than two pets may be kept on the premises. No commercial
vehicles may be kept on the premises unless garaged. Boat storage
on the premises may be only along the rear line of the property.
No fences may be maintained on the premises over four (4) feet in
P height whether it be natural or man made.
3. Each lot owner shall have the use of a parcel of land for re-
creational purposes only on Long Island Sound, located on other
property of the grantor herein immediately adjacent northerly of
this subdivision, said parcel being approximately one half acre
in size with a frontage of about one hundred (100) feet on Long
Island Sound, together with a relocatable right of way thereto from
Stars Road.
These restrictions, but not the beach rights, shall expire on
January 1, 1990.
The restrictions set forth herein may be amended, modified or
changed by the agreement of Theodore H. Schroeder, Marilyn E. Schroeder,
George W. Schroeder, Jr. and Robert R. Schroeder, or their respective
legal representatives, collectively, without notice to or the consent
of any other persons owning a lot in this subdivision.
