Subject to a purchase looney mortgage in the amount of $90,000.00 which mortgage was executed and delivered by the party of the second part to the party of the first part as security for a portion of the purchase price and which said mortgage is intended to be recorded simultaneously herewith. The! premises herein described shall be subject to the following restric- t' ons: The! structure on the premises known as "Revolutionary House" as presentl utilized contains four apartments and the party of the second part may continue to use the premises as a multi -family structure until January 1 1987 at which time the party of the second part agrees to utilize these premises only as a sin§le-family dwelling. The structure on the premise known as "Sunset House' as presently utilized contains three apartments and the party of the second part may continue to use the premises for t:aiLs purpose until January 1, 1987 at which time the party of the second part agrees to utilize the premises for only two families. The party of the second part represents that it is his intention to eventually re- novate and convert the Revolutionary House to a one -family dwelling Continued - ARTHUR J. The purpose of this clause is that after January 1, 1987 the two structures on the premise: will be occupied by no more than three families. The premises herein are also sold subje4t to and together with the benefits of the following paragraph contained in the deed dated October 2, 1980 between Regens International Corporation and Pierre - Andre Gazarian, as follows: "Parcel I hereinabove described is conveyed subject to the right of the owners of the premises across the street (Bay Avenue, Village Lane or Main Street) to the West known as Revolutionary, Sunset and Edge- .. water, to take sufficient quantities of water from the existing well and/or wells now on said Parcel I and to share in the cost of repst maintaining and replacing the well and/or wells and the piping in that supplies the premises on the West. The cost of maintaining and repair ing the said water supply and piping as aforesaid, shall be borne in the following proportions: Twelve -seventeenths (12/17%) per centum thereof by the owner of Parcels known as Revolutionary, Sunset and Edgewater, and Five -seventeenths (5/17%) per centum thereof by the owner of Parcel I above-described (Bay House) and Parcel II above- described (Bayside). The aforesaid premises to the west presently take water from the water supply and piping on Parcel I (Bay House) and this declaration continues the present arran ement. The right continued and granted herein shall be twelve (12� feet in width and extend from the water source presently located on Parcel I above- described and connected by underground piping in a general southwest, south and westerly direction across Parcel I in described through Village Lane or Main Street to the premises on the West across the street known as Revolutionary, Sunset and Edgewater and as presently laid out, and delineated on a Map of premises made by Roderick Van Tuyl on September 4, 1980."
