DINAS, deceased Brooklyn, ar LOT f.. party of the second part, 8 12 f f ZI 28 WITNESSETH, that the party of the first part, to whom Letters of Administration 3ettera testamentary were issued by the Surrogate's Court, Kings County, New York on December 7, 1982 and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Taw, and in consideration of a dis— tribution of a portion of said decedent's estate da"9 paid by-thrflarty-e€the-see end-pafF does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, decedent's one—half interest as tenant in common with PERRY XENAKIS ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying andbemgfsthe at East Marion, Town of Southold, Suffolk County, New York, and bounded and described as follows: BEGINNING at a monument on the boundary line between land of the party of the first part and land of Krupski, 152.48 feet easterly along said boundary line from the easterly line of Rocky Point Road, said point of beginning being the northeasterly corner of land conveyed by Wayland C. Brown to Stanley Zultoski; from said point of bM-nning running along said land of Krul-ski, North 77 degrees 09 minutes 30 seconds East 234.79 feet to a monument and land of East— ern Excavating Company; Thence along said land of Eastern Excavating Company South 9 degrees 08 min— utes 00 seconds East 373.85 feet to a rust and land of Nowell; Thence along said land of Nowell and along land of West, South 62 degrees 34 minutes 10 seconds West 248.62 feet to an iron pipe and land conveyed by Wayland C. Brown to Panagopoulos; Thence along said land of Panagopoulos, along land conveyed by Wayland. C. Brown to Peters, and along said land of Zultoski, North 8 degrees 30 minutes 00 seconds West 412.35 feet to the point of BEGINNING. TOGETHER with a right of way 20 feet in width running westerly from the prem— ises to Rocky Point Road, the center line of said right of way being the boundary line between said land of Peters and said land of Zultoski. Said GEORGE C. DINAS and PERRY XENAKIS, being the same persons, as the Grantees in the deed recorded in the Suffolk County Clerk's office in Liber 5929 at page 418. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estatc vhich the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to conveyor dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first pert covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
