TOGETHER with a non exclusive 25 foot right of way for ingress and
egress and for access by public utilities underground, which right
of way is described as follows:
BEGINNING at a point on the easterly line of a right of way
formerly owned by the Estate of Walter W. Washburn and now owned by
the Marion Road Association, Inc. , said point of beginning being at
the southerly end of a private road known as Marion Place and being
distant from the intersection of the southerly line of said right
of way of the Marion Road Association, Inc. , and known as Marion
Lane with the westerly line of Bay Avenue the following two
courses:
1 ) South 56 degrees 35 minutes 20 seconds West 293. 01 feet along
the southerly line of Marion Lane; and 2) South 34 degrees 12
minutes 40 seconds East 300. 00 feet along the easterly line of
Marion Place.
RUNNING THENCE from said point of beginning through the premises
now owned by Edward F. Pohlig and Margaret E. Pohlig South 34
degrees 12 minutes 40 seconds East 152.08 feet to the above
described parcel; THENCE along said parcel the following two
courses:
1 ) South 55 degrees 47 minutes 20 seconds West 25. 00 feet ; and
2) North 34 degrees 12 minutes 40 seconds West 152. 43 feet to said
right of way owned by the Marion Road Association, Inc. , and known

TOGETHER with a 50 foot right of way for ingress and egress and for
access by public utilities , either overhead or underground, which
right of way is described as follows:
BEGINNING at a point on the westerly line of Bay Avenue, about 650
feet southerly- as measured -along said -westerly Line from Main Road
said point of beginning also being where the southeasterly corner
of land of Koch intersects the land westerly side _of Say Avenue_;

THENCE along land of Smith and land of Koch North 56 degrees 35 _
minutes -20 seconds East , 343. 81 feet to the westerly line of Bay
Avenue and the point or place of BEGINNING.
SUBJECT TO a right of way for emergency use aligned with the private road known as
Marion Place and extending said road to the southerly Lineofthe above described
parcel. Said right of way shall normally remain closed to all traffic by a gate-at the
southerly line of the above described parcel and control of the use-of said right-of
way shall rest exclusively with the owner of the above described parcel except that i
shall be. immediately available for use by emergency vehicles responding to an emer-
gency such as fire, ambulance and police. Except for -the portion of said right of way
used as a driveway in connection with the occupancy of a dwelling erected on this par
cel, no special surfacing of this right of way shall be required and it may be main-
tained as lawn.- The central portion of said right of way shall be maintained free of
any obstruction either on the surface or overhead which might interfere with its in-
tended use including the parking of vehicles in such a manner that access by
emergency vehicles is blocked.
