! WITNESSETH, that the party of the first part, pursuant to
Resolution Number 1083-1986 adopted by the Suffolk County
Legislature on September 23, 1986 andl thereafter, approved by the
County Executive on October 6, 1986, ~n consideration of ten
dollars and other valuable consideration paid by the party of the
second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of
the second part forever,
ALL that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, and acquired by Tax Deed on February 7, 1983, from
Jean H. Tuthill, the County Treasurer of Suffolk County, New
York~ and recorded on February 8, 1983t in Liber 9311, cp 572
on 5/3, and otherwise known as and by own of Southold Sch Dist
5 N-Goose Creek E-Waterview Dr S-Waterview Dr W-H B Moore,
TOGETHER with all right, title and interest, if any, of
the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
AND the party of the first part, in compliance with
Section 13 of the Lien Law, hereby covenants that the party of
the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of
the same for any other purpose.
THE WORD "PARTY" shall be construed as if it read
"parties" whenever the sense of this indenture so-requires.

WHEREAS, the COUNTl OF SUFFOLK is the fee owner of the following

ALL, that certain plot, piece or parcel of land, with any buildings and
improvements thereon erected, situate, lying and being in the Town of Southold,
County of Suffolk, and State of New York, described on the Tax Map of the
Suffolk County Real Property Tax Service Agency as District 1000, Section
078.00, Block 07.00, Lot 018.000, and acquired by tax deed on February 7, 1983,

Dear Judy:
At a recent Town Board meeting, I was instructed to cause a title
search to be made of a 20' strip of land extending from the westerly
side of Waterview Drive to Goose Creek at Bayview and shown on the
Suffolk County Tax Map as Dist. 1000; Section 078; Block 7; Lot 018.
and acquired by the Suffolk County Treasurer by deed dated 2/7/83
and recorded on 2'8'83 in Liber 9311 of deeds at page 572.
I ordered a search by Title USA and enclose herewith a copy of its title
report No. 86-52-54746. wherein the title company reports that the
premises are "Subject to the rights of others in common over the
subject premises and more particularly mentioned in Grant of Right of
Way in deed L. 5121 p. 74 as contained within." The deed referred to
is abstracted on the last page of the report. I am also enclosing a copy
of the tax map showing the strip in red for the information of the Town
