Can we all rise for the Pledge of Allegiance? We just need to get some housecleaning out of the way and then we can get to the resolutions. Now, there are two opportunities during this Town Board meeting to address the Town Board. One would be right now. This would be an opportunity for you to address any of the resolutions or any of the agenda items that are on the agendas that you got when you walked in. Later on, as you are all aware by now there will be a period of time when you can address the Town Board on any other issue. Would anybody like to address the Town Board this evening? Mrs. Joan Egan. How are you tonight? JOAN EGAN: Good thank you. Joan Egan, East Marion. I really didn’t have time to go through the book. One question that pops up right away, maybe somebody else will take up. I didn’t see on your budget thing Mr. Harris’ name. Salary. SUPERVISOR RUSSELL: Mr. Harris? His salary was set at the Organizational Meeting. MS. EGAN: I know but I mean, you didn’t have his name on the list. TOWN CLERK NEVILLE: By resolution at the Organizational Meeting. SUPERVISOR RUSSELL: His salary was set at the Organizational Meeting. EGAN: Well, I guess it is 2006-57. TOWN CLERK NEVILLE: That is correct. It shouldn’t be. These are only appointed, special appointed positions in addition to the, some of them may be elected officials but most of them are not. Mr. Harris’s and a lot of the, all of the other elected officials were set at the Organizational Meeting. MS. EGAN: Well, then (inaudible) there is an awful lot of… TOWN CLERK NEVILLE: He doesn’t have an additional title for Highway Superintendent. That is why he is not on this list. MS. EGAN: Yeah, well than there is an awful lot of money going out there. Start watching the pennies, you know? Then the dollars fall in. Somebody else can take over why I read more. There is an existing 9.0 acre development rights easement on the northerly portion of this parcel having previously been purchased by the Town of Southold in 2004. The exact area of the purchase is subject to a Town-provided survey acceptable to the Land Preservation Committee. The purchase price is $45,000 (forty-five thousand dollars) per buildable acre. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural value. COUNCILMAN KRUPSKI: This would be a one year appointment for one person to fill one year of my unexpired Trustee term and I make this resolution as someone who has worked with Page 26 January 17, 2006 Town of Southold Board Meeting John Holzapfel. We sat up here on the Board together for four years, he is someone with experience. He is someone with knowledge of how the Town Trustees operate. With the new Board of Trustees, there are two new members who are unfamiliar with how the Town operates and how the Board operates and how the Board conducts itself and I think it would be very important to appoint someone like John for one year because he wouldn’t have to learn the whole process. He is a veteran and he would be an asset to the Town and so I make that motion. And I am going to ask Betty to call the role. COUNCILMAN EDWARDS: Well, before you call the role, I think we have an opportunity to comment and I would like to. I intend to vote against this resolution and out of a decent regard for Mr. Holzapfel I should explain why. We have two or three, actually three people who have expressed strong interest to my knowledge, in this position. And two of them, most notably Ms. Joyce Grigonis, ran for the office, ran forth. Garnered 3,500 votes, is very well qualified for the position and went through the effort of running in a campaign. My colleagues on the Board are probably going to vote this in and the logic behind it is that we will have two new people on the Board now, do we want another third new person on the Board. I would argue the Jim King and Peggy Dickerson are very well qualified to guide the new people on the Board and deferring for twelve months having a new person on the Board through this rent-a-Trustee technique really doesn’t ultimately solve that issue. I have also, in my experience in business, has always told me that the person wants the job the most usually is the most likely to succeed. And Mr. Holzapfel had the opportunity to run for the office and chose not to and has indicated that he does not wish to run for it in the election this fall. I certainly agree, he is very, very well qualified and he will certainly do a very good job in the position but ultimately twelve months from now we are going to have a new person, no matter who it is since he has apparently indicated that he will not run for the office and for that reason and not out of any disrespect to him, I am going to vote against this resolution. COUNCILMAN ROSS: I join in certain of Bill’s comments. I know Mr. Holzapfel will do an excellent job. I have committed to Joyce Grigonis and she garnered 3,500 votes and she worked very hard for the position and wants it tremendously and for that reason I am going to vote no. SUPERVISOR RUSSELL: Yes, with a brief explanation. I am going to vote for that. It was my goal to keep the position open. I think it is a public position, it is an elected position. The public ought to choose who their next Trustee is. Mr. Holzapfel has graciously offered his services to the Town at a time when we need a fifth Trustee. The Trustee’s felt that we did need a fifth Trustee. He has graciously offered his help. In the meantime, there will be an opportunity for candidates to be screened and run in November, so the public will get to choose who their new Trustee will be, come next winter. I happen to like both of the people that we considered today, I think Joyce Grigonis is an excellent candidate and she will have her opportunity before the voters in the fall to make her case again and she is a formidable candidate and I do wish her luck in the fall. In the meantime, I do have to think about the work load that is there and Mr. Holzapfel can hit the ground running and that is why I am supporting him. I can’t say you forgot over there. Gotta do something about that. Now, I am sure everyone here by now has heard that Mr. Kapell, the mayor of Greenport, is attempting to do a census of the incorporated Village and the hamlet. I myself called here and I heard it on the news last night, I saw it in Newsday today. It is a very difficult situation because the illegal immigrants don’t have their own domiciles. If they sign up that they are in this country illegally, they could be picked up. Unfortunately immigration is asleep at the clutch. They at this time will not come out here to pick any of them up unless they have 20 of them at one time. And there is no place where we can house 20 of them until immigration comes out. I don’t think at this point that the census is legal. I myself called Senator Hillary Clinton to find out what she could about finding out the legality of taking such a census. I think the ultimate aim for Mr. Kapell is affordable housing. Maybe he means well, I don’t know but I don’t know whether it is legal. So let’s keep on it. Maybe the Town Attorney could look into it. Unfortunately in the world we live in, things are happening to the very young and the very old. I don’t even like to put the news on. But these (inaudible) senior centers, some woman was almost beaten to death today. Our senior center, the Human Resource Center has absolutely, positively no security. There is a million doors up there, you can come in and out on and I only see a few women there. I don’t know if you can do anything about that but we should keep it in mind. Now, these little trips that our police officers take and town employee’s take, should be held to an absolute minimum. There is no reason why much of this information that they do gain and I will say that they gain, cannot be done by the internet from the police station or town hall. Oh, where are we at on the Cross Sound ferry suit? SUPERVISOR RUSSELL: Which one? MS. EGAN: Any and all. SUPERVISOR RUSSELL: We are discussing our legal options at this point, we are trying to reconcile the recent decision against Southold Town and I think the promising suit against the ferry on our initiative. So we are discussing that with counsel now. MS. EGAN: Good. I don’t like the word discussion, I do like results. Now, I had perhaps been misinformed but I don’t think so, maybe it has changed. That Peconic Landing and I know they pay a lot of taxes but they are absolutely, positively killing the Greenport Fire Department with Page 33 January 17, 2006 Town of Southold Board Meeting calls. I believe in there original contract with us, they said they would get their own ambulance and it is something else. They have a serious problem at both their entrances and I don’t think that there is much they can do about it. Any of us who have gone to the beach, if you press the sand down, the water comes up and they put too much weight on that property. It has been raped all over. Somebody took the top soil off, it has changed hands and there is a problem there with accidents on Manhasset Avenue and inside the complex there is always, always the ambulance is going. I don’t know, if anyone up there versed at all enough to say whether Peconic Landing did originally get their own ambulance? SUPERVISOR RUSSELL: There is no legal requirement… MS. EGAN: I realize that but I think to gain certain rights there, I think they did say they would put their own in… SUPERVISOR RUSSELL: I tell you what. I will look into that and I see you every day, why don’t you come in and we can go over all those concerns in the office tomorrow, we can go over all of those. I have a question about a parcel of property that is adjacent to our land and it is owned by the town and we were wondering whether or not we would be able to purchase it because we have been maintaining it. People have been dumping their garbage there and it is wooded but my husband and I have been trying to keep it as clean as possible, so we thought if at all possible. MS. TOIVONEN: Great. Thank you very much. CATHY TOLE: Good evening, Cathy Tole from Greenport. I just want to ask about a resolution but I didn’t need to do it before the vote. The resolution #130 on adding the parcels to the preservation plans. Just for clarity for the general public, if you could identify the parcels in your public hearing notice that is printed by other than the lot number, just as we do with the Trustees or the variance ZBA hearings. COUNCILMAN WICKHAM: What do you mean? To list them other than… MS. TOLE: You have the tax map numbers on here and …. COUNCILMAN WICKHAM: That is not enough? Is that what you are saying? MS. TOLE: I don’t think it makes it very clear to the general public what parcels are there. Just as the Trustees, I believe, when they publish their notices and the ZBA, Planning, all of them; when they publish their public notices they also add a common descriptive, also known as you know, whatever address or street. SUPERVISOR RUSSELL: We would probably have, probably two other options. One would be include the owners name or include the street address. Street addresses get a little touchy because on the large parcels, the street identification is a little harder because it covers so much the street frontage. COUNCILMAN WICKHAM: I would just like to comment. There are many of them, almost 200 parcels and many of them are very small. Less than a fraction of an acre. Just a very small parcel. MS. TOLE: I am not trying to argue, I just think it is information that would help the public identify what the parcels are, so they know that the property next door to them or up the street is being purchased and they may not know the tax number nor would they necessarily… COUNCILMAN ROSS: Would a map, with the spots colored? It couldn’t be put in the newspaper but it could be left at Town Hall so people could identify them. MS. TOLE: Personally I don’t think that works. But whatever steps you can take to make it clearer to the public that the property near them is being added to the map. I think they would like to know that. Page 36 January 17, 2006 Town of Southold Board Meeting COUNCILMAN EDWARDS: Could I speak to this just very briefly? For the benefit of people who don’t understand this; in order to spend the Community Preservation Funds, the 2% money, the property has to be on a list and the purpose of this hearing and the purpose of this legislation is simply to add approximately 194 parcels to the list. It no way affects their zoning, their valuation. It doesn’t say we are going to buy them, it doesn’t say anything of the kind. All it means is that they can be added to a list which already includes virtually all of the AC zone and much of the R-80 property in the town. So it is not, it really is a technical change more than anything else. And I am sure you know that, Ms. Tole, I am just mentioning for everybody else’s benefit. MS. TOLE: The other thing I would like to ask the Board’s consideration on is if you were talking about whether they be primary residence or accessory apartments or any other affordable housing options; is there a provision for handicapped or accessibility being required for these residences? If there isn’t, I would like it to be brought up in discussion at whatever work sessions, planning sessions, whatever. But that there be a mandate, I think as a government we certainly should accept that responsibility. COUNCILMAN KRUPSKI: There will be a public hearing on the zone change. I guess that would be… MS. TOLE: I am not talking about the… SUPERVISOR RUSSELL: No. On the general… MS. TOLE: I am not talking about this plan, I am talking about generally; under that category of housing, that it is appropriate for the town to mandate that there be some level, substantial level of accessibility. SUPERVISOR RUSSELL: I can tell you that we probably have some minor disagreements at the Town Board level on where to take the affordable housing program but I do think there is a general support to expand it so that we are more inclusive of issues that you just talked about. We had a cordial conversation on the issue today, so I think that we could certainly reach more people with it than what the current plan would allow for. MS. TOLE: Thank you. Okay? It’s not really your choice to make. It is the taxpayer’s choice to make. So along with Ms. Tole, I would go a step further, if you have the tax map number, you must have an address. Because if you are sending them a bill, it has to go somewhere. A postcard will do. COUNCILMAN WICKHAM: May I clarify? MR. DINIZIO: Yup. COUNCILMAN WICKHAM: Ms. Tole suggests, if I understood her, suggested that we put out to the public all the names and addresses. What you are suggesting is that we should at least as a courtesy, send a note to the owner of each property, that there property is being considered. Is that correct? MR. DINIZIO: Certainly in the instance of 130. TOWN ATTORNEY FINNEGAN: We do send a letter out to each property owner to let them know. MR. DINIZIO: Okay. That is good then. You have a nice list there. Now I am going to take this even a step further than that because the Suffolk Times had an editorial that was near and dear to my heart concerning proposed legislation to basically require the Town Board to give a synopsis of any law that they might publish in the paper instead of the law. Now, I think that is a wonderful idea and I called my Congressman and I called my Assemblyman and I expressed that and I would hope that you would somehow come up with a resolution that would support that also. Not for the economy, it is pennies, I am assuming. It is probably not a lot of money where the Town is concerned and certainly Suffolk Times said they don’t make any money on it, they are losing money on it. They consider it a community service and perhaps they can do it but certainly if you guys are writing laws, you should be able to write a synopsis that someone can understand that law. I can give you two instances, as you know I sit on the Zoning Board of Appeals, I have been for almost 20 years, I see, month after month, widows coming before the Board begging for their lots to be unmerged because they didn’t know. Okay, now the Town’s responsibility has always been fulfilled by publishing that public notice in the paper. But I can guarantee you many if not all of those people that come before that Board, if they read the law, would not understand that they were affected by it. Another example is up at the dump. The landfill. No, no, it is the landfill. And those poor people who were rezoned. I mean, just imagine if you sent them each a notice, I mean, what are there, 15 houses there, that said the Town is considering you know, restricting the use of your property. If your house burns down, you will not be able to rebuild it. Well, that is what you did. No sense in denying that. Not you in particular, but the Town, you ought to tell them that. I mean, they ought to be able to come up and comment on that. So, I am hoping that maybe you can come up with something more than, yeah, that sounds good, Jim and maybe call our Congressman and maybe do a resolution because the editorial here was complaining about how the public would be mis served by it, about the Page 38 January 17, 2006 Town of Southold Board Meeting elderly and the least educated among us you know, might not have access to a computer and all that. Well, they can come up here and read it. They can call Town Hall. You know, publish the number in each one. You know, let them call. I don’t think that’s anything that should hold it up. And certainly accuracy, honestly, I have been involved in this Town and making laws for that long and honestly when I read them, the law that you guys are going to have the public hearing on now, I read it. Quite honestly, I don’t understand it. It is not something that interests me, so I am just hoping that my property is not on there. I only have one piece. So I am just hoping that you can support, call up and support it, it is the Senate bill S6306. Not as published in the editorial which was Senate bill S386, okay, the accuracy of the editorial was wrong and Assembly is A09187 and I hope that you can support that. Thank you very much. SUPERVISOR RUSSELL: Thanks, Jim. Actually I agree with just about everything you said. I am trying to constitute a committee, a working group that is going to address some of the issues on how town government functions and how we react with the public and I am going to be pitching that in the next few weeks. And you are actually on my short list of people to call. I have seen it for 15 years. People just simply don’t understand something that affects them because they get caught in the bureaucratic jargon. And they don’t realize it affects them until eight years after their husband passed away or something like that. I think that we have, in the interest of good government, have to be as clear as possible in everything we do. Marie? MARIE DOMINICI: Marie Domenici, Mattituck. First of all, I would like to say Happy New Year to every one on the Board and also for those of you that have just been newly elected and re-elected, congratulations to all of you. I have two questions. It is my understanding that when Southold School District had that shortfall of $600,000 that that accounting firm had most of the business in this town, if not all the school districts, the town business and so on and so forth and I was just wondering, has that agency been dismissed? Do you know? SUPERVISOR RUSSELL: I actually talked to the Town Comptroller about that and we are going to schedule that for a Town Board discussion in the near future. Again, you can’t hold someone accountable for something at the Town Board level, I am right now just getting my feet wet, learning about who is doing the accounting and everything like that but certainly it was an issue that was brought up by a few other taxpayers in the community, so we are going to look into that, to see if that is necessary or not. MS. DOMENICI: Thank you. The other thing I have a concern about is when, this year you know our budget is coming up, the school budget is coming up for vote and everyone knows that Mattituck-Cutchogue has been on austerity this year and I have grave concerns that we do not work together as a community and Scott, I have kind of had this conversation briefly with you earlier tonight, I would like to see maybe some kind of committee pulled together that includes members of the School Board so that because the Town being a taxing agency for the school district I think it is important when we talk about school taxes and population and density. I think it is important that there not be silos between the town and the school district and for that matter, utilities. Because every time we turn around you have LIPA wanting to build a nuclear power plant in somebody’s backyard; so I think it is really important that the three agencies if you will, the school district, the town and utilities work together when we talk about taxes, Page 39 January 17, 2006 Town of Southold Board Meeting density and planning. So it is my hope that there is a future consideration that a committee is pulled together of some sort so that there can be open dialogue to help us do planning that works for this town that is whole and not just you know, in segments and silos. COUNCILMAN KRUPSKI: We are, actually we are addressing just that at our work sessions today. That is what one of the discussions was centered around, about how some of these developments would affect the school district. MS. DOMENICI: And it is important that you know, we not be taxed out of our homes. I mean, when you have people deciding whether or not they need to buy their medication or buy food that is a pretty scary scenario and you know, right now we are looking at the average age in this room, I don’t think too many people have to worry about that but when you get to be in your 60’s and 70’s and I am not quite there yet but you know, you start to worry about these things and you don’t want to have to be forced out of your homes and I am not telling you anything you people haven’t heard already but it is a grave concern and it is something we need to look for, for our children and our future, so any consideration you can give to that, that would be greatly appreciated. Thank you for your time. SUPERVISOR RUSSELL: Thank you. Greg. GREG YAKABOSKI: Greg Yakaboski, Southold. Again, Happy New Year to everybody and congratulations, Al, Scott and Tom. Not the reason I came up here tonight but just to echo some of the comments regarding Ms. Domenici mentioned and Jimmy, you might with Factory Ave., Factory Lane or Factory Avenue in Mattituck, you might want to include the School Board and also send notice to neighbors. You remember it was a big deal, there was a lot of out put last time they wanted to do something there during the lead agency process. A couple of issues I wanted to talk about. One, I am not sure where it is, I just wanted to come in on it, the sanitary flow credits which I had talked about with the previous administration, I was sent by the, thank you, Town Attorney’s office a copy of that appraisal. I am not sure if it is a dead issue, if it will come up before the Board, if the Board is going to bring it up again, I have looked at the appraisal, I think it is pretty much fundamentally flawed. Probably point it out in about five minutes on each point what it wrong with it. Again, the basic point I had problems with it was if you were buying something for 50 and then selling it for 15 or 5, there was a gift somewhere. Either you gave too much money when you gave the 50 or you are selling it too cheap. And aside from violating New York State Constitution against gifts, that just seemed to be a, not right for Town property. But again ,I would just urge the Board, if they are going to consider this issue, to look at that appraisal and I can give somebody my cell number and I will spend five minutes with you and show you what is wrong with the appraisal. It is just fundamentally flawed. Second point I wanted to ask about was water quality, stormwater run-off. I had approached the previous administration during the budget process and asked about what projects were listed for stormwater, there was a big hoopla made, we have a lot of money in the budget for stormwater run-off remediation, quality control, that kind of thing. At that time there was no list of what money was available or what projects were available. What projects were targeted this year. You see, when they did the budget, you would have specific budgets projects targeted so that you could figure out how much they cost and put the money in the budget. I know Al, Page 40 January 17, 2006 Town of Southold Board Meeting coming from the Trustees I am sure it is a big issue with Al, and if somebody could just, uh, I could stop back in a couple meetings and find out what is going on or give a call, I don’t know how you guys want me to handle that but that is one. That is the second point. The third point was the community center. There was, I do think it is important, I know Tom has been advocate for years about maybe a town pool or a town community center. I had approached the Board about two months ago, three months ago what is going on and it was mentioned there is actually some kind of grant being applied for, to renovate and do something with the Rec center up there, if anybody could fill me in, perhaps next meeting or meeting after that or I could again call somebody, however you guys want to handle it. That would be appreciated. The other issue was, again, I had mentioned to the previous administration. When the budget comes out, there is a cover sheet listed on the budget, which lists the money by district and by different big departments, whole town and part town; it is a summary sheet, right up front. What would be nice to have, would be say for the last four or five years, to take that summary sheet and show what dollars were actually spent in each of those categories and how much was raised by taxes. Just take that summary sheet and put actual dollars in, in the sheet. See actually what actually happened over the last few years. One thing that is talked about in town is how the tax raises, property tax raises have been kept very low over the past couple of years; my more concern is how much tax, how much actually cash it has cost to run the town over the last couple of years. There was a big influx over the last five years of new people coming into town and new homes being built and there is actually more people to help cover the costs and I am wondering if there is actually, while the tax increases might not be very much, if it costs, how much more it costs in actual dollars to run the town from say four or five years ago to say, last year. And that kind of summary would show that over the years. Not just looking at tax percentages. The last thing and Al and Scott probably did not get this, the other Board members did get this; and I wanted to handle this at the last Board meeting of the year, unfortunately no public comments were taken at the last Board meeting of the year. This regarding Josh Horton, the previous Supervisor, holding two jobs. One with North Fork Bank as was reported in the paper and with the Town. I respectfully ask that the Board refer this over to the Ethics Committee as a conflict of interest, it needs to be looked at. The reason is this: Josh, Scott any supervisor as the supervisor is the Chief Financial Officer of the Town. North Fork Bank provides a vital service to the Town in that they help through the lockbox system, help forward and collect most of the tax dollars in the Town. They provide tremendous financial services to the Town. To me and my personal review of the ethics, really should be called conflict of interest law, it is tough when the chief financial regulator of the Town is also an employee of one of the chief providers of financial servers to the Town. It is tough to do your job or the perception of not being able to do your job is a problem right there. The second point would be, again, previous Supervisor Horton, as an employee of North Fork Bank and I don’t know how long he was an employee, it was reported in the paper it was about a month before the end of the year. The Town also has the lease with North Fork Bank and I know Supervisor Horton, over the last year, was a big proponent of a new Town Hall. In other words, moving out of North Fork Bank, buying some property in the back and building a new Town Hall to the point of even I think he held an informational hearing at the end there, Tom, on it. Did a lot of work on that. Not that a new Town Hall should not be looked at, not that a new Town Hall is not a good idea. Some folks on the Board know that on a personal level, I was in favor of a new Town Hall. But when you are an employee of North Fork Bank, as was reported, and if that is true at the same time you are advocating a new Town Hall which would Page 41 January 17, 2006 Town of Southold Board Meeting move the Town out of North Fork Bank, less than a year after you advocated moving the Town into North Fork Bank. It just doesn’t look good. SUPERVISOR RUSSELL: I am sorry Greg but basically if he was advocating moving tenants out of his employer’s bank, then that would make him, that is not the best move in the bank’s interest. So I am sure, look, I will be honest with you Greg, I like you a lot but we have to make a fundamental decision tonight, if we are going to move forward or not. The public has the right to go before the Ethics Board and make a complaint but you know what? I want to move forward, I want to take this town in a positive direction. I understand the perceptions that are out there and I find it deplorable as well but I can tell you as the Supervisor, I am not going to get involved in it. Because it is my job to move this Town forward, to move in the best interests of everybody in Southold Town and not settle old scores. I just want to move forward. I am going to tell you with complete candor tonight, if you are looking for someone to spearhead that, it is not going to be me. I am going to ask this Board to just keep moving forward and moving in the best interests of Southold Town and I don’t think covering old ground is going to do that. MR. YAKABOSKI: I would agree, Scott that covering old ground, if this was to cover old ground or to settle scores I would completely agree with you. I would. Okay? To be here at night, to come here, I had wanted to settle this and deal with it during the last administration. During the last Board meeting. Unfortunately the public was not afforded at that meeting its normal course in speaking either at the resolutions or at the public comment time, like now, an opportunity to speak at that meeting. That is fine. As for being old ground, I would suggest to each of the Board members, I know Bill, Dan, Louisa, Al, Tom, each one of you, to look at an issue which only came up four weeks before the end of the year and how that affects the public trust of the Town. I think it is not an old issue and not something that would be going backwards on. It has never been dealt with, never been dealt with. I know Bill mentioned in running for office he was a big proponent of how much they have done with the Ethics Code. To me this is a…Tom, I see you want to speak? COUNCILMAN WICKHAM: Members of the public may refer things to the Ethics Board. It doesn’t have to come from Town Board members. MR. YAKABOSKI: That is correct. I will tell you right now, as the Board knows or Scot and Al might not, but I sent something, I already sent something to the Ethics Board. I have to come back and actually swear to something, I didn’t realize at the time, I was away; so I am going to be taking care of that. However, again, from the, to me and Scott and I are going to respectfully disagree with this particular point, that the Town Board as a whole, I think it is something that is tough to overlook when a (inaudible) again, it is not for me to decide, it is for the Ethics Board to decide but it seems from reading the rules, such a clear and not only a clear but a blatant violation of the conflict of interest law. What was going on at the time. I am not trying to put the Board at a difficult spot at all, if the Board does not want to do something, I respect that. I already have something in, I have to go, there was a technicality, I have to swear to it or something like that and I will swear that I read the paper that Josh was an employee of the bank and so forth. But I think it is, well, I will leave it at that. As to my other questions, what would Page 42 January 17, 2006 Town of Southold Board Meeting be the best, would the Board, is it easier for me to come back at another Board meeting or simply contact…? SUPERVISOR RUSSELL: I can answer some of your questions right now. On the issue of budgets and town government, if you look at you tax bill each year, my office, my former office puts the budget changes as a percentage on the tax bill. If you look at the percentage change of the Town tax line, that percentage increase of the tax you see is an actual dollar increase. It is a budget to budget increase. It is not a tax rate increase. In other words, the tax rate might have gone up three percent but the budget might have gone up five percent. That two percent being offset by assessment gains. That is why we do it budget to budget. We take the fixed dollar amount from year one and compare the fixed dollar amount to year two and that is the percentage that we post on the tax bill for that very reason, so that there is clarity in the budgeting process not (inaudible) with assessment changes and things like that. So that is one thing that is easily calculated from your tax bill. On the issue of sanitary flow credit values, I have to agree with you, I am not a big fan of that particular appraisal but it is a difficult issue and you have to remember what the goal of the sanitary flow credits are. Also, as an appraiser, I can tell you that our goal as appraisers is to find the least erroneous answer to basically an unanswerable problem, which is what is, and I stole that from a Supreme court justice, so, I think it was Cardoza, I don’t remember. That is the challenge but you have to remember what the goal of sanitary flow credits are. I have some concerns about the sanitary flow credit program. Those are issues that we will be discussing over the next few months. But on the issue of valuation, if the issue is to propose or advance the goals of affordable housing, I am not sure that you can charge $50,000 for a sanitary flow credit. And that is just not going to meet the needs of why it was created to begin with. MR. YAKABOSKI: You are correct, Scott as to that. It might not meet the needs. Unfortunately I think the Town’s hands are bound by the New York State constitution about gifts to people. COUNCILMAN WICKHAM: Several months ago the Town Board commissioned a professional study by a well regarded appraiser to help us answer that question. We got information, we relied on it, we enacted our legislation based on that. You and others are entitled to your opinions and to take issue with it. But the Board acted on it and like the Supervisor, my intent it to go forward and not to go backwards and go over old stuff. There may be, no doubt there are questions can be raised about it but we based our judgment and our vote on that professional opinion and as far as I am concerned it was a sound one. I am satisfied with it and I want to go forward. MR. YAKABOSKI: If it came forth, Tom, that the professional opinion was fundamentally flawed, would you change your mind? COUNCILMAN WICKHAM: If somebody could show us a credible threat to the integrity of that professional opinion, I would take it very seriously. MR. YAKABOSKI: That is a fair enough assessment. Would the Board be voting on that if it came up without another public hearing or would it set a time… Page 43 January 17, 2006 Town of Southold Board Meeting COUNCILMAN WICKHAM: We already voted on it. It is past history. TOWN ATTORNEY FINNEGAN: Do you mean on the value? MR. YAKABOSKI: On the valuation. TOWN ATTORNEY FINNEGAN: The value is already set. MR. YAKABOSKI: And if…. SUPERVISOR RUSSELL: Greg, as you know I am an appraiser by trade. Come into my office tomorrow, right after Mrs. Egan and we will go over the valuation. I have to tell you, I am not a big fan of the appraisal but as an appraiser for 15 years, the only work I ever liked was my own, so, that is the nature of that business. If you have specific, professional concerns about that appraisal, we can go over that tomorrow and I will bring every bit of information we discuss to the next work session. MR. YAKABOSKI: Approximately I will just jot it out over the next few days and then talk to you so… SUPERVISOR RUSSELL: I have the appraisals, come and see me. MR. YAKABOSKI: No, no, so you have something in writing on what my concerns were. SUPERVISOR RUSSELL: Okay. MR. YAKABOSKI: And just to wrap up, on the ethics thing Scott, if the Board was something that they would consider without making a big deal of it, it could be something that the Board simply refers over to the Ethics Board and says, look, this came up in the paper, could you please take a look at it and the Board says nothing else ever about it, this Board says nothing else about it, that would be fine, it would meet my concerns on a very low key approach. Thank you very much for your time. COUNCILMAN KRUPSKI: Just to answer the storm water run-off question, I know last year there was a project that didn’t get completed at the end of Old Harbor Road in Cutchogue. It was a road end project; tear the end of the road up, put in drainage and sort of back the end of the road up. A very simple project that the Highway Department conducts and has done numerous in the Town. Tonight we voted resolution number 128 authorizing Cornell to do, with the New York State Department of State grant to do a storm water management plan for us and that would give us a lot more information as the specifics of the problems and then we could make decisions working with the Highway Department and Town Board and probably the Trustees and try to prioritize the drainage. I mean, it is always been every road drains into the creek or into the bay, so when we started this probably 15 years ago when John Bredemeyer was president of the Board of Trustees, we started working on Hashomamaque, we looked at the largest shellfishing areas first, we started working in Mattituck Inlet because it was a shellfishing producing area and Page 44 January 17, 2006 Town of Southold Board Meeting then we started to look at other projects that were doable. You can’t, if you don’t have a management plan and you can’t get state and federal money, so we also looked at a lot of the smaller town road endings, to see which ones we could do in-house but it is a monumental task that I am sure we will get all the roads were designed for the last 300 years to run into the creek, it is going to take a long time to correct everything. MR. YAKABOSKI: Yeah, I appreciate that, Al. What had happened was that maybe I just misheard it but I was looking for the event there was a certain list of projects out there that were looked out, I mean maybe there were 20 projects okay, I wasn’t told a number and that a certain amount of money was put aside in this budget, the existing budget, to do those, some of those 20 projects. I was trying to find out, what my example, fake example, what were the 20 projects and how much money was put aside? And maybe that is not the case but that is what I really was trying to find out. COUNCILMAN KRUPSKI: The specific ones for 06? MR. YAKABOSKI: Yeah, I mean just came across, said 20 projects, my number and we have x number of dollars, we have to prioritize. I didn’t know, I couldn’t find out what those 20 projects were or what those dollar amounts were either. It is one of the things I was trying to question. I don’t expect you to know it sitting here tonight it is not fair but maybe in a month or so I could give you a call… COUNCILMAN KRUPSKI: Sure. Sure. MR. YAKABOSKI: …if you know something, that would be great. Thank the Board, thank you very much for your time, I appreciate it and good luck with everything. SUPERVISOR RUSSELL: Cathy? MS. TOLE: Cathy Tole, Greenport. Just to, something was triggered in my memory by the prior speaker. I believe a member of the community came forward and specifically asked whether or not there was conflict on the part of the prior supervisor and I don’t care if it was Josh, John or anybody else but it happened to be that individual with dealing with North Fork Bank in that there was discussion in the community uncorroborated at that time, that he was going to be employed with North Fork Bank and my memory is that there was a denial from the seat that you sit in now and that is where there is a serious problem with the appearance of impropriety and perhaps an impropriety. In that the discussion about the town annex was going on at that time. And if somebody comes up here and mentions to this Board that there is such an appearance, I would respectfully disagree with you. You do not have to carry it as your mantle, but I believe it is your obligation as a public official to simply designate that somebody notify the Board of Ethics that such an accusation has been made at whatever meeting, in your office or whatever. You don’t have to provide evidence but it is your obligation if there is an impropriety declared, if I came up here and said, hey I heard that somebody over in (he is not here anymore) Highway Department was driving drunk in the town vehicle, it would be your obligation to simply report it. You are not giving evidence but you came by information in your role as public Page 45 January 17, 2006 Town of Southold Board Meeting servant and you should advance that and send it to where it belongs. I don’t know whether there was or was not an impropriety and I am not making that accusation but I do recall that discussion here in the Town Board and I would like to ask all of you to consider when you are out here, out in the public or in this meeting, that if you receive an allegation of impropriety, that you just bring it forward. Just have somebody make a call. That is all. Thank you. SUPERVISOR RUSSELL: Thank you. Jim? MR. DINIZIO: I guess this is a night of double dippers, so I am going to be one, too. Quite honestly, Josh Horton is not an employee of this Town any longer, okay? He chose not to run again and quite honestly, if you speak over me again, ma’am, I will stay up here for half an hour, my concern here is that if people want to do a witch hunt, you let them do the witch hunt, okay? Don’t let them use you. It is none of your business what a person that is no longer employed by this Town has done. If you find impropriety with the contractors you are dealing with, i.e. North Fork Bank and somehow a contract has been signed, then that is your responsibility. But because somebody comes up here, because anybody can come up here and make any statement they seem to feel they want to, doesn’t meant that you have to react in any way and I encourage you not to. Not to waste one second, one dollar of the taxpayers money investigating a person who no longer works for the town. You have no recourse, anyway. I mean, everybody, it is a small town, everybody has to work. Quite honestly, the supervisor’s job is a part-time job. I know it is a lot of money but it is a part-time job. No matter what anybody says. Okay? So if anybody wants to work somewhere else, they certainly are welcome to. No matter what, even if the Supervisor says so, so all I am asking you folks is don’t consider it, okay? SUPERVISOR RUSSELL: This is exactly what I am talking about but you had some very good ideas before, Cathy, you have always given me great ideas. I would rather focus on those good ideas and move this town forward. That Ethics Board isn’t there for us, they are there for you. And if you have an issue with the Ethics Board, bring it to the Ethics Board. MR. DINIZIO: Thank you. SUPERVISOR RUSSELL: They don’t work for this Board, they work for you. Some people might have merit to their arguments, bring it to the Ethics Board and let them consider it. In the meantime, I am going to focus on moving this Town forward and I have made it perfectly clear on where I stand on it and I think the Town Board supports me on it. Mrs. Egan? MS. EGAN: The only, Joan Egan, East Marion. I did bring to the Ethics Board but the only thing that I felt that the Town should do is that Mr. Horton should give back some money but that ain’t gonna happen. SUPERVISOR RUSSELL: I got the Crown Vic back though. I get to drive that. MS. EGAN: He should give some of his salary back but that is not going to happen. Who takes the tapes to Cablevision? Is this man responsible for taking the tapes to Cablevision? To Joe the manager? SUPERVISOR RUSSELL: He doesn’t work for me, he works for Cablevision. MS. EGAN: Does anybody know who takes the tape to Cablevision? What is being taped now. Who takes…. TOWN CLERK NEVILLE: This gentleman drops them off at Cablevision, he doesn’t work for Cablevision. The Town employed him. MS. EGAN: I said, who is responsible? Because last time it didn’t work right. TOWN CLERK NEVILLE: He is not responsible for them scheduling it. Just for dropping it off to Cablevision. MS. EGAN: Well, I was told the last time, after Mr. Russell’s first meeting, I called right away because I knew you were anxious and so was the whole town to, you know, see the new Board and how it is all working and it didn’t happen. It didn’t happen. Mr. Horton’s ran and then his tape about his projection of the new Town Hall and you only got on twice that I know of. SUPERVISOR RUSSELL: Maybe there was a public outcry to pull me off. TOWN CLERK NEVILLE: Cablevision schedules, not Allen Video. Cablevision schedules the tapes that they run. And they should get a receipt that it has been received, so that when I call and they say it isn’t here, I want to know what happened to the tape? I am not trying to double cross anybody. I want the Town Board meeting to be put on at the appropriate time. I am the one that spends the time on the phone, at my expense. I don’t get a salary. Now, I think you should all know also, that you know Mr. Carlin is going to be coming back and he is going to get you on that Animal Shelter, darling. But I have spoken to him, you know his wife passed away and it was a terrible tragedy for him. I congratulate some of the Town Board members, I did not know it myself until well after. They did respond to his need in visiting and calling and what have you but I did speak to him last week and he is getting back in here and I did tell him, Frank, don’t talk too long. But I don’t know, he is going to come back and I think we should all be thankful for Mr. Carlin of Southold because he does his homework and he doesn’t get paid. Thank you. SUPERVISOR RUSSELL: Thank you. Anybody else like to address the Town Board before I adjourn it? COUNCILMAN WICKHAM: May I have a comment? We have met many people in the past few weeks who have come to know about the proposed project behind Factory Avenue in Mattituck. Many of them have expressed concern, some of the have expressed support, but it is clearly becoming known in the community what this project is. Which is to say 24 homes in an Page 47 January 17, 2006 Town of Southold Board Meeting area behind Factory Avenue. One of the disheartening aspects of being a member of the Town Board over quite some years, is to run up against people who strongly oppose a project but really didn’t take advantage of opportunities to learn what that project was about during the formative stages. The group that is proposing that project, the not-for-profit group called Community Development Center of Long Island is hosting an open house at the Mattituck Library this Thursday between 2:00 and 8:00. Anybody can just walk in. They can learn anything they ever wanted to know and maybe more than they wanted to know about that project at this stage before it has become final. They can learn all the different aspects, they can learn the financing of it, the proposed lay-out, how the thing has been planned. It also is an opportunity for residents in the town who would like to take advantage of affordable housing opportunities to learn whether they could be eligible and what the steps are in getting a mortgage and getting on the list and their likelihood of success. So it is a two-fold opportunity, one for the public to know what that project is about, the other is for prospective owners who may be interested to actually find out whether they could qualify. There is no formal presentation at a particular time, it is like a running opportunity for people to learn. So I recommend that, particularly for people who have some concerns about it. To learn at the bottom level what this project is all about. And then two weeks from today at I believe 5:00 in the afternoon, there will be a public hearing on that project. A public hearing, rather, on the proposal to rezone the property to affordable housing status, such that the project could go forward. I encourage people who have got views about that project, pro or con, to show up at that public hearing and give us the benefit of your views. Thank you.
