WHEREAS
there has been presented to the Town Board of the Town of Southold, Suffolk County, New

making Decisions on applications for Site Plans and Special Exception Use Permits for Retail Stores over
3000 square feet in the Town of Southold
BE IT ENACTED BY, the Town Board of the Town of Southold as follows:
Section 1. PURPOSE AND INTENT

The Town Board is considering the important recommendations of the recently adopted Hamlet Study
and the Planning Board, but is faced at the same time with pending and proposed applications for
development of retail, formula, and “big box” type development which could be detrimental to the
character and sustainability of the hamlet centers. The Town Board recognizes that the existing Zoning
Code is inadequate to deal with these chain and large-scale businesses that have been and will, in the near
future, be proposed.
The size and population of the Town, the scale of its existing buildings, the traffic and
transportation issues facing the hamlets, and the long-range goals of the Town (as set forth in the recently
adopted Hamlet Study and other past planning studies) dictate that retail and commercial limits should be
established to sustain the hamlets. Regulation on the size, location and appearance of large chain retail
businesses is necessary to address the problems these businesses create.
It is critical that the issues be handled in a comprehensive manner, crucial legislative decisions
made and those decisions implemented. The Town Planning Board, Planning Department and Town
Attorney Department have been working hard since the enactment of the moratorium to review retail
uses, sizes, and locations to update and create new legislation that will comprehensively meet the long-
range goals of the Town. The Town Board held a hearing on proposed legislation on December 14, 2005,
at which time valuable public comments were received. The Town Board would like to review the public
input, and revise the proposed legislation to better serve the needs of the community. Further, on January
1, 2006, there will be a new Town Supervisor and one new Councilperson, who will provide input into
the crafting of legislation. The Town Board finds that it is reasonable and in the public interest to further
temporarily suspend the application process for larger retail stores so that it has adequate time to examine,
assess and address these uses that would otherwise be detrimental to the community.
For the reasons stated above and to permit the Town Board to decide on and enact needed
legislation, the extension of this moratorium is necessary.
Section 2. ENACTMENT OF TEMPORARY MORATORIUM
For a period of Ninety (90) Days following the effective date of this Local Law after which date
this Local Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the Ninety (90) Day period:
1) the Planning Board shall not accept for review, continue review, hold a hearing or
make any decision upon any application for a site plan containing a RETAIL STORE
over 3000 square feet, whether submitted prior to or after the effective date of this law,
and shall not be subject to the time periods specified in Town Law § 274-a and Article

XXV of the Southold Town Code, including without limitation, provisions relating to
the, processing, reviewing, holding of hearings and the rendering of decisions. The
statutory and locally-enacted time periods for processing and making decisions on all
aspects of said site plan applications are suspended and stayed while this Local Law is
in effect. All terms used in this Local Law are as defined in §100-13 of the Code of the
Town of Southold.
2) The Zoning Board of Appeals shall not accept for review, continue review, hold a
hearing on, continue a hearing or make any decision upon any application for a special
exception use permit containing a RETAIL STORE over 3000 square feet, whether
submitted prior to or after the effective date of this law, and shall not be subject to the
time periods specified in Town Law § 274-b and Chapter 100 of the Southold Town
Code, including without limitation, provisions relating to the, processing, reviewing,
holding of hearings and the rendering of decisions. The statutory and locally-enacted
time periods for processing and making decisions on all aspects of said special
exception use permits are suspended and stayed while this Local Law is in effect. All
terms used in this Local Law are as defined in §100-13 of the Code of the Town of
Southold.
Section 3. APPLICATION
This local law shall apply to ALL [new or pending] applications for site plans or special
exception use permits for RETAIL STORES over 3000 square feet in the Town of Southold.
Section 4. EXCLUSIONS
This Local Law shall not apply to:
1) Site plans for which final or conditional final approval was granted by the Planning Board
prior to the effective date of this local law;
2) Additions to existing retail stores or restaurants, provided said addition will not result in a
cumulative floor area of said business in excess of 3000 square feet, and further provided
such addition to retail store or restaurant does not include a drive-through component;
3) Wineries;
4) Agricultural operations and accessory uses thereto.
Section 5. CONFLICT WITH STATE STATUTES AND AUTHORITY TO SUPERSEDE

To the extent that any provisions of this Local Law are in conflict with or are construed as
inconsistent with the provision of New York State Town Law, this Local Law supersedes, amends and
takes precedence over NYS Town Law pursuant to the Town’s municipal home rule powers, pursuant to
Municipal Home Rule Law § 10(1)(ii)(d)(3); § 10(1)(ii)(a)(14) and § 22 to supersede any inconsistent
authority.
In particular, to the extent and degree any provisions of this Local Law are construed as
being inconsistent with the provisions of Town Law § 274-a, §274-b and the provisions and
requirements set forth in Chapter 100 of the Southold Town Code, which require that the
Planning Board or Zoning Board of Appeals process, review, hold hearings on, and act upon
applications for site plans and special exception use permits within specified time periods, this
local law suspends and stays the running of time periods for processing, review, holding hearings
on, making decisions, and taking action on such applications provided for in those laws and is
intended to supersede and amend any said inconsistent authority.
Section 6. APPEAL PROCEDURES
a. The Town Board shall have the authority to vary or waive the application of any
provision of this Local Law if, in its legislative discretion, upon its determination, the variance or waiver
is required to alleviate an extraordinary hardship. To grant such request, the Town Board must find that a
variance or waiver will not adversely affect the purpose of this local law, the health, safety or welfare of
the Town of Southold, or any comprehensive planning efforts being undertaken in the Town. The Town
Board shall take into account the existing land use in the immediate vicinity of the property, the range of
business opportunities in the vicinity of the property and the surrounding hamlet, the rural, cultural,
historic and business character of the hamlet, and the impact of the variance or waiver on the open and
recreational space, and transportation infrastructure of the Town. The application must comply with all
other applicable provisions of the Southold Town Code.
b. Any request for a variance or waiver shall be filed with the Town Clerk and shall include
a fee of two hundred fifty ($250.00) dollars for the processing of such application, along with copies of
the site development plan and any related information required in accordance with the procedures set
forth in Chapter 100 of the Southold Town Code.
c. All such applications shall, within five (5) days of filing with the Town Clerk be referred
to the Planning Board, which shall have ten (10) days following receipt to make a recommendation to
approve or disapprove a variance or waiver of this Local Law. The application and recommendation shall
be transmitted to the Town Board. The Town Board may conduct a public hearing and make a final

decision on the application, with or without conditions. Final approval is reserved to the absolute
legislative discretion of the Town Board
Section 7. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not effect the validity of this law as a whole or
any part thereof other than the part so decided to be unconstitutional or invalid.
Section 8. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

SUPERVISOR RUSSELL: We have a public hearing at 5:00. If anybody would like to address
the Board now, we would welcome the input that you give us.
NICHOLAS TSOUNIS: Nicholas Tsounis from Mattituck, New York. Just one thing I would
like to say with the alternative fuel, one of the cheapest ways and you can use from restaurants is
vegetable oil. I have been seeing it a lot on TV. So if you could look at vegetable oil, look for
alternative energy for cars; try to check out all of the facts for vegetable oil because you can just
get it from restaurants.
SUPERVISOR RUSSELL: Thank you very much. Would anyone else like to address the
Board?
COUNCILMAN WICKHAM: This morning in the work session, the Board discussed the
question about appointments to a number of committees. You may know that in December
Supervisor Russell asked that those people who are serving on committee’s continue to serve and
that they not regard themselves as being devoid of a job as of the end of the year. Along those
lines, this morning the Board took up the proposal of how to do a careful, responsible search for
the best people for the committee’s that serve this town. We concluded that it is very difficult to

do all of that in the month of December, after an election and before January 1. It is the holiday
season. It is just very hard to get people together, it is hard enough to get our Board together
plus the people in the community who would like to express interest. On top of that, all of those

positions would become due at the same time and right on top of that we are trying to sort out the
Planning Board positions and Zoning Board and all of that. So this morning we took, I mean, we
established two policies. And the first policy is that we will not fill all of those committee
positions during the first meeting of January, which is today. Rather we are going to roll them
ahead until some date in the spring, probably around March, when the new Board will have been
seated and the new Board members can play a role in the review and selection of those people.
The second decision we took was if the Town Board is unanimous in re-appointing an incumbent
who is leaving a committee, whose term is up on a committee but the incumbent wishes to be
reappointed to that role, if we are unanimous in seeking that person’s reappointment, we will not
advertise, we will not seek new names. We are not going to drag people through the whole
process of expressing interest, only to find that we are already are only going to re-appoint the
incumbent. So those are the two policies we enacted and that is the reason why in today’s
meetings we have not appointed a whole series of new appointees to the Tree Committee, the
Land Preservation Committee, the this committee, that committee and all of that. Is that clear?
Or is that….oh, thank you. Very important. As Louisa just reminded me, consequently, all of

those people whose terms do technically expire on the 31 of December are being automatically

extended until March 31 I believe. Did I get that right?

Board for working with me to try to come up with a process that is fair, not just for the existing
members on these Boards but for any applicants that wish to be considered and also a fair way of
dealing with the Town Board, I mean, we need a process by which guys like me and Albert can
get our feet wet before we start moving on decisions on who should constitute the Boards. I
think it was fair for all of us and administratively made much more sense to push off that
decision making to a time where we have all have gotten organized and I want to thank them for

COUNCILMAN WICKHAM: There is a rather lengthy recitation here of the original law that
was put in place earlier last year. That law, the original moratorium, would expire later this
week. The purpose of this extension is to give it an additional 90 days from this week, to extend
out into the future an opportunity for the town to put in place legislation that the Board deems
appropriate to control the big box stores that would, that could otherwise be established here in
the Town of Southold. There is a purpose and an intent but it is all part of the original law and I
think it is fairly clear what this calls for. The limit is still the 3,000 square feet limit that was
there when we first took up this law last year. This public hearing has been duly noticed on the

Town Clerk’s bulletin board out there, it has appeared as a legal in the local newspaper and I do
have several communications about it from interested parties. First, from the Suffolk County
Department of Planning, ‘Pursuant to the requirements of Section A 1414 to 23 of the Suffolk
County Administrative code, this referenced application is considered to be a matter of local
determination as there is no apparent significant countywide, inter-community impact. A
decision of local determination should not be construed as either an approval or disapproval.’
On December 28, 2005, Jerilyn B. Woodhouse, the Planning Board chair released a memo to the
Town Board on this application, which reads as follows: ‘We have received your request for
comments regarding the above referenced local law extension. The Planning Board supports the
extension. We have no further comments or recommendations at this time.’ And I believe that
is all the information I have at this public hearing at this time.
SUPERVISOR RUSSELL: Would anybody like to comment on the proposal? John Nickles,

JOHN NICKLES, JR.: Hi. John Nickles, Jr., Southold. I don’t have a lot to say on this, I think
it is something the Town should look more into and I would support the 90 day extension here.
Some of the avenues I thought the Town might take with redefining specific types of retail uses
apparently may not be the way to go for the town from a legal standpoint but I would be
interested in helping the town explore what are the other possibilities might be out there to
achieve our goals. Thanks.

and our new supervisor. I don’t think I have an awful lot to say. I think the moratorium should
be extended. I think it was mostly proposed because of the CVS here in Southold. And I don’t
know why you don’t want so many people here but I am sure they will start coming once they

Town of Southold Board Meeting
SUPERVISOR RUSSELL: Okay, now we are going to open up the floor for anybody that would
like to speak on any issue that is of mutual interest? Mrs. Egan.
MS. EGAN: I didn’t have time to review everything. (Inaudible) where not there yesterday for
the gorgeous inauguration. You missed a good show. Is it going to be televised?
SUPERVISOR RUSSELL: I don’t think so.
MS. EGAN: You don’t think so. Well, it should have been because we have had a lot of
meetings here that maybe shouldn’t have been televised. But at any rate, I always address this
issue and I don’t see it here but the Justice report, that you get from the Justice Court and they go
to Mrs. Neville and they are computerized and most of the time, 90 percent of the time, the only
thing that the Town Board is interested in is how much money they get. And that is wrong. It is
important but it is wrong. They should be read by somebody up there to find out what has
happened to our town. As many of you know, I try to get here at least two or three Friday
mornings, I can’t always make it but you should be here. I am sure you have been here and it is
horrible, absolutely horrible. Incidentally, I did not see the security light on on the Justice Court
building. I spoke to Mr. McMahon about it several times, I spoke to the Chief of Police, I spoke
with our former Police Commissioner and I think he put the nix on it but the Police
Commissioner agreed that that light should be on. If anybody, anybody, god forbid, breaks into
that courtroom and secures private records, this town could be sued to the limit that you couldn’t
do a darn thing. That security light should be on. I have also requested Judge Bruer and Judge
Price and I would imagine Miss Evans, also, I had suggested that we have on Friday morning, a
scanner before people come in. you only have one court officer and unless there happened to be a
police officer here, maybe you have the Suffolk police or somebody bringing them down but
both Justices….I know Judge Bruer and Judge Price said they didn’t feel they needed it at this
time. So at least let’s secure that building in some manner, shape or form. I am sure at this point
in your administration you have not had the opportunity to break down who takes care of who
and who takes care of what, it is very important, number one, the code enforcer. You are going
to need at least two more. Present code enforcer disappears on Friday at 2:00, he never returns
calls. I had dead to rights about property in my community in East Marion, it had been a one
family residence and it is now a four family. And they only pay taxes for one. Mr. Krupski, you
should drive down and look at what your Trustees Board permitted to happen on the Keller
property. It is horrible. Absolutely horrible. I complained about it, I came to that meeting, I left
paperwork for you and you gave him a permit. Now, the water situation. As most of you know,
Long Island has been sinking at what? One inch (inaudible). There is water coming up all over
and I don’t think there is really anything you can do about it. I truly I don’t. But if there is
anyway, right up here on Horton’s Lane on the west side of it, you have gully’s coming off.
Extremely dangerous. So, let’s get with it. You appoint somebody for checking water, Mr.
Romanelli used to do that. I had also requested at the last Town Hall meeting that we get some
feedback on the Medicaid, Medicare and Mr. Horton said that the Human Resource Center had
given seminars on it. And there truly is no true clarification, people are still very, very confused.

SUPERVISOR RUSSELL: Thank you.
COUNCILMAN ROSS: Supervisor Russell, I just wanted to mention to the public today was
the Town’s Organizational Meeting at 11:00 AM, it wasn’t televised. A number of appointments
were made. We are not going to review them all but I just wanted to let the public know, we
wanted to let the public know. Planning Board appointment, there was an appointment Joe
Townsend and Jeri Woodhouse was reappointed as the chairperson of that Board. And the ZBA
appointment was Leslie Weisman and Ruth Oliva was appointed, reappointed as the chairman of
that Board. A number of other appointments were made. Scott, do you want to?
SUPERVISOR RUSSELL: I will mention that for the Deputy Supervisor’s position I appointed
John Sepenoski, who is GIS coordinator for Southold Town. He is someone who is involved in
just about every office in town government. You can go to just about any meeting or any
committee meeting and you will see him sitting there, from land preservation to ag advisory
issues, to Audubon Society activities. I think John, I have worked with John for the 10 years he
has been here, I think he is maybe one of the most under appreciated or under valued employees
in town government. He is a great source of information. He is a quiet guy, he doesn’t spend a
lot of time developing, you know, he is not a political type of guy, he is not a guy like me. He is
just busy going about his business. And I know that everybody on the Board has worked with
him at one point or another and I think they all like him. I view that role as more administrative
than political and I think John will help us synthesize some of the ongoing efforts we have here.
Synthesizing the land preservation efforts with our ag protection efforts, with our zoning and
planning initiatives. I think John is going to be a good point man for us, as we work towards
those goals.
