Dear Mr. Samuels:
The Southold Town Board of Trustees reviewed the site plan prepared by Thomas C.
Samuels last dated August 23, 2005 and determined the proposed construction of a
new residence on a pre-existing foundation and new sanitary system to be out of the
Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, or within 25' landward from the top of the bluff, without
further authorization from the Southold Town Board of Trustees pursuant to Chapter 97
and/or Chapter 37 of the Town Code. It is your responsibility to ensure that
necessary precautions are taken to prevent ?y sedimentation or other alterat!on or
disturbance to the ground~s-u-~ace or ~/eg~t~bon ~th~n Ti~tal Wetlands jufisdict~3n and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Mr. Samuels:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 19, 2006 regarding the above matter:
WHEREAS, Samuels and Steelman Architects as agent for EDWARD & ADRIENNE
SOLOMON applied to the Southold Town Trustees for a permit under the provisions of
Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated March 27, 2006, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of EDWARD AND
ADRIENNE SOLOMON to construct an in-ground swimming pool and enclosure fence with the
conditions that there be a dry well for pool backwash and the two fences in the intertidal area be
removed back to the toe of the bluff and all as depicted in the plans prepared by Samuels and
Steelman Architects revised 4/27/06.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Wed., April
12,2006, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland. Permit application of EDWARD & ADRIENNE
SOLOMON to construct an in-ground swimming pool and enclosure fence.
Located: 1205 Point Pleasant Rd., Mattituck. SCTM#114-1-4
The CAC recommends Approval of the application with the Condition a drywell is
installed to contain the pool backwash, and all trees with a DBH of 6" or more, from the
hay bale line to the water, are left in place.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits'" including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. ... Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail. Iist/ne: both supportine: and non-
supportine: facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.
