Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 19, 2006 regarding the above matter:
WHEREAS, En-Consultant, Inc. as agent for THOMAS PERILLO, SR. applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated March
29,2006, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 19, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
South old Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of THOMAS PERilLO,
SR. to construct approx. 114 linear ft. of vinyl retaining wall to be aligned with the landward ends
of adjacent retaining wall returns and to be armored with 1-3 ton stone armor; place approx. 200
cy. of clean sand fill on bluff face landward of retaining wall; and plant bluff face with Cape
American Beach grass (12" on center) and Rugosa Rose and Bayberry (2 gal., 3' on center) and
all as depicted on the plans prepared by En-Consultants, Inc. revised 5/01/06.
Permit to construct and complete project will expire two years from the date the permit
Is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

THOMAS PERILLO, SR. requests a Wetland Permit & Coastal Erosion Permit to construct
approx. 114 linear ft. of vinyl retaining wall to be armored with 1-3 ton stone armor; place
approx. 200 cy. of clean sand fill on bluff face landward of retaining wall; and plant bluff face
with Cape American Beachgrass (12" on center) and Rugosa Rose and Bayberry (2 gal., 3' on

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the following Policy Standards and therefore is
CONSISTENT with the LWRP.
Policy Standards
4.1 Minimize losses of human life and structures from flooding and erosion
hazards.
D. Use hard structural erosion protection measures for control of erosion only where:
5. The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
b. based on sound engineering oractices
7. Adequate mitigation is provided and maintained to ensure that there is no
adverse impact to adjacent property or to natural coastal processes and
natural resources and, if undertaken by a private property owner, does
not incur significant direct or indirect public costs.

The construction and armoring of the proposed bulkhead will mitigate erosive forces and is
limited to the minimum scale necessary to improve the function of the bulkhead. The
placement of the rocks at the toe of the bulkhead would further mitigate erosive forces from
wave energy. The plans show that the adjacent properties to the east and west are also
hardened with bulkheads extending east/west. Therefore, no adverse impacts to adjacent
properties are expected if the proposal is implemented as depicted on the survey/plans
dated March 22, 2002.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits. including Town of Southold agencies, shaH complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. Iistinl!' both SUDDortinl!' and non-
sUDDortinl!' facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.

depict the proposed retaining wall relocated landward to the landward ends of the returns of the adjacent
retaining walls. Also attached is a copy of a letter from the Honeysuckle Hills Property Owners
Association authorizing construction of the retaining wall over their land.
Should you require any additional information before the requested permit can be issued, please let me
