Dear Mr. Fitzgerald:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 116, 2005 regarding the above matter:
WHEREAS, applied to the Southold Town Trustees for a permit under the provisions of
Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated October 21,2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trtrstees with respect to said
application on November 16, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of BRADFORD
WINSTON to construct an in-ground swimming pool and wOod deck, attached to the
existing single-family dwelling, with the condition that a drywell be installed for pool
backwash to prevent any' water or chemicals from the pool from entering the wetland
and waters of the Town, and all as depicted on the plan dated 11/7/05 and approved by
the Board of Trustees on 11/16/05.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

BRADFORD WINSTON requests a Wetland Permit to construct an in-ground
swimming pool mid wood deck, attached to the existing single-family dwelling.
Located: 485 Breezy Path, Southold. SCTM#89-2-8
The proposed action ]has been reviewed to Chapter 95, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP provided that:
1. The applicant proposes a sub-surface pool drain (dry-well) from the maximum
distance from the wetland to prevent pool chemicals from entering the wetland in
the event that the pool should be drained.
Pursuant to C apter 9.>, the Board of Trustees shall consider this recommendation ~n
preparing its written determination regarding the consistency of the proposed action.

mediate area is heavily developed it is felt that there is no adverse impact on the

ject is for the modification of an existing structure while retaining the same use.
The project is certainly a beneficial use of the coastal location, and the incremental
increase in development in the area is insignificant.

The original development of the site was approved by the Town Trustees, the
NYSDEC and the SCDHS beginning in 1998. Steps will be taken to insure that silt

within, a State-designated Significant Coastal Fish and Wildlife Habitat. All statu-
tory and regulatory requirements, at all levels of government, will be strictly com-
plied with. No dredging, excavating, or filling of the creek bottom is proposed.
