Pursuant to 15 CFR Part 930.58, the following necessary data and information is required to enable the Department of State to adequately assess and undertake its review of the coastal zone effects of this proposed activity: The materials submitted with your consistency certification explain that the need for the proposed new bulkhead is to prevent further erosion of the existing upland property into West Creek. Please demonstrate or provide information which supports the need for a new erosion control structure, including documentation on the rate of erosion at this site in order to support this assertion. The proposed bulkhead would be constructed below the line on MHW. This may be a waterward expansion ofthe upland property in and on publicly owned lands and waters. Please provide a copy of the deed for the property with a metes and bounds description to document the applicant's ownership of the underwater and intertidal lands on which the proposed bulkhead would be constructed. If the applicant does not own the underwater lands on which the proposed bulkhead would be constructed, please provide documentation demonstrating whether permission has been obtained from the owners of the underwater land. Please provide the necessary information requested above as soon as possible. If this necessary information and data is not provided within thirty days of the date of this letter, the Department of State may close the file regarding this proposed activity. From the information submitted, it appears as though the proposed bulkhead may not be consistent with the Policy 4 of the Town of Southold Local Waterfront Revitalization Program (LWRP) which requires the minimization of the loss of life, structures, and natural resources from flooding and erosion. More specifically, Sub-policy 4.1.D requires that the use of hard structural erosion protection measures for control of erosion be limited to those locations where "construction of a hard structure is the only practical design consideration and is essential to protecting the principal use." In addition, LWRP Policy 4.2.B(1) requires the protection and restoration of natural protective features byavoiding alteration orinterference with shorelines in anatural condition. The explanation of LWRP Policy 4 also refers to the Peconic Estuary Program's "no net increase policy". The alternatives analysis provided with your application is inadequate to document that the proposed design, or use of any hard structure is necessary, and is the only practical design. Given the above, the Department may object to the consistency certification provided for the above referenced proposal and recommends modification of the proposed project to utilize soft, non- structural, vegetative methods of erosion control, or withdrawal of the consistency certification. Box 2124 Greenport, NY 11944 Re: JOSEPH BRITTMAN 80 GLENN RD, SOUTHOLD SCTM# 78-2-10 Dear Mr. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 19, 2006 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. as agent for JOSEPH BRITTMAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 27, 2006 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 19, 2006 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the Southold Town Code, 2 ~ • WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, and, WHEREAS, the followinct mitigating actions will be taken in order to be more consistent with the LWRP: creation of Spartina marsh along a shoreline that has no plants, and a non-turf buffer landward of the MHW, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application JOSEPH BRITTMAN to construct 105' of low-profilE: bulkhead using C-Loc 4500 vinyl sheathing, revegetate inter-tidal marsh area with Spartina alterniflora and install a 32"X 20' seasonal ramp at the end of an existing dock onto a 6'X 20' seasonal float in an "L" configuration, secured by (4) 6" pilings with the condition of a 15' wide non-turf buffer landward of the shoreline and all as depicted on the plan prepared by Costello (Marine Contracting Corp. revised April 28, 2006. Permit to construct and complete project will expire two years from the date the permit Is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. It is my reconunendation that the action as proposed is INCONSISTENT. The applicant has not demonstrated that the proposed action is consistent with the below sub policies. D. Use hard structunxl erosion protection measures for control of erosion only where.• 1. Avoidance of the hazazd is not appropriate because a structure is functionally dependent on a location on or in coastal waters; located in an area of extensive public investment; or reinforces the role of Maritime Centers or Areas for Concentrated Development. 2. Vegetative arororoaches to controlline erosion are not effective. 3. Enhancement of natural protective features would not prove practical in providing erosion protection. 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. 5. The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary b. based on sound engineering practices 6. Practical vegetative methods have been included in the project design and implementation. 7. Adequate mitigation is provided and maintained to ensure that there is no adverse impact to adjacent property or to natural coastal processes and natural resources and, if undertaken by a private property owner, does not incur significant direct or indirect public costs. It is recommended that the applicant re-grading and replant the inter-tidal marsh area with Spartina alterniJlora and extend the length of the ramp rather than install the low sill bulkhead. Within the high marsh, consider requiring the planting of Spartina patens to control erosion. This recommendation will abolish the impacts associated with the hardening of the shoreline. The applicant currently enjoys access to the waterway via an existing dock. The proposed extension of the dock system is inconsistent with the following policies and sub-policies. 9.4 Assure public access to public trust lands and navigable waters. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean hi h water for navigation recreation and other public trust purposes, including the incidental rights of public anchoring_ 2. Penmit limited obstruction of public use, including navigation, in navigable waters: a. for water-dependent uses involving navigation and commerce which require structures or activities in water as part of the use. b. for commercial recreational boating facilities, provided that the loss of navigable waters and use of underwater lands is offset by sufficient public benefits. c. in order to gain reasonable access to navigable waters from riparian lands. The extension of the dock structure and docking of a vessel at the terminus of the dock wilt impede the ability of vessels to navigate the water body in this area. 3. Obstruction of navigable waters and underwater lands is limited: b. To the minimum necessary for access to navigable waters The minimum is determined by evaluating the following factors: (i) the extent of the use's dependence on access to navigable waters, (ii) the range of tidal water level fluctuation, (iii) the size and nature of the body of water, (iv) the nature of public use of the adjacent waters, (v) the traditional means of access used by surrounding similar uses, (vi) whether or not alternative means to gain access are available. Piers, docking facilities, and catwalks must not result in an unnecessary ir:terference with use of public trust lands. Alternatives to long piers or docks include use of dinghies to reach moored boats and mooring in nearby marinas. Dredging solely to W ~ i accommodate the draft of larger boats is not a recommended alternative. c. by extent and characteristics of the developable adjacent upland area and its ability to support in-water development for the water- dependent use. c. by potential adverse effects on natural resources and their uses, and d. by potential adverse effects on public safety. 4. Structures extending beyond the minimum necessary for access to navigable waters imuair public trust interests and open space values associated with the water's surface. Allow such structures only in the following circumstances: a. when necessary for practical and convenient operation of water- dependent industry or commerce, and provided that obstruction of commercial navigation does not result. b. for commercial recreational boating facilities provided that: (i) the loss of navigable waters and use of underwater lands is offset by sufficient public benefit, and (ii) obstruction of commercial navigation does not result. c. when the principal purpose of the structure is necessary: (i) to provide public access for recreational uses (ii) for improvements for navigation (iii) for protection from coastal hazazds, or (iv) for essential public transportation and transmission facilities. Further, to support Sub-policy 8.3 "Protect the environment from degradation due to toxic pollutants and substances hazardous to the environment and public health", The proposed timber has not been identified. If the action is approved it is recommended to further Policy 8.3 that no CCA treated lumber is used in the construction within marine waters. Our proposal is consistent with this policy in presently there is an existing dock and with the additional of the 32'k20' will aid the upland property owners to reach adequate water to service their boat. The construction of the bulkhead will stabilize this eroding bluff making the area safer. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have a negative impact on the visual quality or scenic resources. This proposal is consistent with the area. This property as well as the adjacent property have docks. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. Our proposed bulkhead will stabilize this small eroding bluff. This area must be stabilized to ensure the integrity of the existing ramp. If this area is allowed to erode the landward end of the ramp will collapse. Policy 5 Protect and improve water quality and supply in the Town of Southold. Our proposal will not have any impact of the water quality or supply in the Town of Southold. During the initial construction there will be a disturbance to the ecosystem but this area will be revegetated and will re-establish itself within one season.
