Box 1657 Mattituck, NY 11952 RE: 295 MAIDEN LANE, MATTITUCK SCTM# 140-1-7 Dear Mr. Kord: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, October 17, 2007: RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit #6267 to extend the fixed ramp by 16' seaward, replace the 16' aluminum ramp with a 20' ramp, and replace the proposed staircase on the landward end of the ramp by an 8' extension of the fixed ramp, and as depicted on the revised plan prepared by Corps of Engineers Data, received on October 19, 2007. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. We have determined, pursuant to the Uniform Procedures Act and Tidal Wetlands Land Use Regulations (t3NYCRR Parts 821 and t3t31 respectively) that the requested changes will not exceed the scope of the original permit and can, therefore, be approved. The permit is hereby amended t0 authorize the extension of the Catwalk to 68 feet and the ramp to 20 feet. All features shall Conform to the attached site plan prepared by Dennis Korcl dated October 19 2007. The following Special Conditions are added: 11.. The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 50 linear feet from the tidal wetland boundary. 12. .The use of wood treated with pentachlorophenol or other wood treatment not specificalry approved by the Department for use in wetlands and/or marine .waters, is strictly prohibited in the construction of structures that will be in contact with tidal waters. 13. The float shall be Installed only at the approved location with a minimum of -2.5' water depth measured at apparent low tide. 15. The dock shall be constructed with maximum piling dimensions of 4 inch by 4 inch for the catwalk and 6 inch diameter pilings for the float 16. The portion of the dock soaward of AHW may kxe removed and replaced seasonally at the permtt holders discretion to prevent ice damage to the structure and damage to the tidal wetlands from ice and stomt debris. The permit holder will be responsible for restoring any tidal wetland areas that are damaged by any portion of the authorized structure that has riot been removed for the winter season upon notification and written approval (permit, modification or amendment) from the Department. 17. prop dredging, or the act of utilizing and/or directing the propeller or propulsion system of a motorized vessel and/or the water-home forces created by said propeller or propulsion system, tv excavate or displace existing bottom sediment and benthic habitat for the direct or indirect purpose of establishing or increasing water depth, is a regulated activity and is not authorized by this permit. Following your advice, I am requesting that the current permit be amended to allow a further extension of the dock into the inlet. Unless this is approved, my dock will not be usable as built. I am requesting that this application for an amendment be reviewed at the upcoming Trustees meeting in September. Once the dock was completed as detailed in the current permit, it became evident that it extended insufficiently seaward. At low tide, it would be impossible to moor a boat as the float would have been sitting on the grasses below. I did not attach the float as it would have potentially damaged both the grasses and shellfish immediately underneath. In addition, the staircase on the landward side of the ramp was not built because of concerns about potential erosion to the beach at the base of the proposed staircase. I am therefore requesting the following modifications to the dock permit: 1. mp ension of the fix ramp ~-x..~-m All other aspects of the permit would remain unchanged. Infrastructure use is not a factor since the project is accessory to and ac- cessed from private property. The project is certainly a beneficial use of the coastal location, and the incremental increase in development in the azea is insignificant. NOT APPLICABLE There is no evidence to indicate that the immediate azea of the project includes his- toric features, and it is to be expected that the mainly intertidal nature of the project azea is unlikely to have been the site of activities of past civilizations. NOT APPLICABLE The structure proposed is low profile and will be inconspicuous in the proposed location. It is compatible with other existing shoreline structures in the azea, and will not adversely affect the dynamic landscape elements (tidal fluctuations, sea- sonal vegetation changes; seasonal diurnal changes in ambient light) which might contribute to ephemeral visual qualities. • Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. ® YES ? The pro- ject is not located in a Significant Coastal Fish and Wildlife Habitat. All statutory and regulatory requirements, at all levels of government, will be strictly complied with.
