Dear Mr. Grinere:
The Southold Town Board of Trustees inspected the property on April 12, 2006 and
determined the proposed walking path from the road to the center of the property to be
out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and
Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, or within 100' landward from the top of the bluff,
without further authorization from the Southold Town Board of Trustees pursuant to
Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Board of Trustees,
I am writing you today on behalf of the Goldenview Estates Property
Association membership. The property owners of our association share
ownership of a parcel of land which we commonly refer to as "the
parkland". It is a 2.2 acre flag lot type parcel with frontage to White Eagle
Drive. Access to the lot by its owners is very difficult due to the overgrowth
of vines, brush, etc. As a community, we have a plan to create a natural
walking path to allow the owners access to the center of the property. This
plan does not include any clearing or development of the land. We are
proposing to simply remove some brush, unwanted vines and such to allow
access and healthy enjoyment of the property by its owners.
The property borders another lot which has a creek (Brushes Creek) running
through it. Although we are not clearing, and our planned path will have
little to no impact on the appearance of our property, we are respectfully
requesting your review of our proposed walking path to confirm that we are
in full compliance with any and all requirements. Of course we have proper
insurance for our property and believe that the elevations and distance from
the creek to the walking path exceed any environmental requirements as we
understand them.
I am including a copy of our simple walking path plan and a map with
elevations and distance measurements and a check for fees for your review.
We kindly request that this review be considered as soon as possible. We are
anxious to continue our project and enjoy the natural beauty of our parkland.
