Box 2124 Greenport, NY 11944 RE: SHEILA PATEL 19965 SOUNDVIEW AVE., SOUTHOLD SCTM#51-4-5.1 Dear Mr. Costello: The Board of Town Trustees took the following action during its regular meeting held on April 19, 2006 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of SHEILA PATEL applied to the South old Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 21,2006, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 19, 2006, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 . . WHEREAS, the structure complies with the standards set forth in Chapter 97 of the South old Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of SHEILA PATEL to add additional 6"X 6" upper stringer to existing bulkhead. Face exterior surface of bulkhead with '/.." HOPE sheets. SCTM#5l-4-5.1 The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the following Policy Standards and therefore is CONSISTENT with the L WRP. Policv Standards 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 5. The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary b. based on sound engineering practices 7. Adequate mitigation is provided and maintained to ensure that there is no adverse impact to adjacent property or to natural coastal processes and natural resources and, if undertaken by a private property owner, does not incur significant direct or indirect public costs. . . . The extension and armoring of the existing bulkhead will mitigate erosive forces and is limited to the minimum scale necessary to improve the function of the bulkhead. The placement of the rocks at the toe of the bulkhead would further mitigate erosive forces from wave energy. The plans show that the adjacent properties to the east and west are also hardened with bulkheads extending east/west. Therefore, no adverse impacts to adjacent properties are expected if the proposal is implemented as depicted on the survey/plans dated February 14, 2006. DEVELOPED COAST POLICIES Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse e.....t.. of development. Our proposal is to reinforce an existing bulkhead. The existing bulkhead is fairly new construction and it is not standing up to the storm action that it is exposed to. The additional of a 6"x6" stringer is just a minor alteration. The additional of the rock will arm the bulkhead and help in preventing further erosion. Policy 2 Policy 3 Preserve historic resources of the Town of Southold. Our project does not involve any historic resources of the Town of Southold. Enhance visual quality and plotect scenic resources throughout the Town of Southold. The addition of the rock will not decrease the visual quality or scenic resource of the Town of Southold. There is native rock along this shore line similar in size to what we are proposing. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. If the bulkhead is not reinforced it will eventually start to fail. Constructing a new bulkhead in this area is not an easy task and in our opinion placing this rock in front of the bulkhead prior to any further deterioration would prevent total failure of this structure. Policy 5 Policy 6 Policy 7 Protect and improve water quality and supply in the Town of Southold. This proposal will have no effects on the water quality or supply in the Town of Southold. Protect and restore the quality and function of the Town of Southold's ecosystem. All construction will be above the AHWM. Due to the strong wave action in this area there is no vegetation. So our proposal will have no effect on the Town of Southold's ecosystem. Plotect and improve air quality in the Town of Southold. This proposal will have no effects on the air quality or supply in the Town of Southold.
