Said two parcels being the same premises conveyed to grantor by
deed dated May 20, 1968 recorded in Liber 6398 at page 169 in
the Office of the Clerk of Suffolk County.
PARCEL THREE
ALL that certain lot, piece or parcel of land siutate, lying and
being at East Marion, Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at a point on the easterly boundary line of land now or
formerly of J. and J. W. Elsworth Company, 457.73 feet southerly along
said boundary line from the northeasterly corner of said land, said
point of beginning being the south westerly corner of Lot 6 as shown
on "Map of Marion Manor", filed in the Suffolk County Clerk's Office
as .Map No. 2038; from said point of beginning running thence along
said easterly boundary line, being along a "reserved parcel" and Lot 5
as shown on said map, South 25 degrees 08 minutes 50 seconds East, 430
feet more or less to ordinary high water mark of Gardiners Bay; thence
westerly along said high water mark 410 feet more or less to the easterly
edge of a bulkhead of the. dredged channel; thence northerly along said
easterly edge of said bulkhead of the dredged channel and through the
waters of, a dredged basin North 24 degrees .04 minutes 30 seconds West,
560 feet more or less to an iron pipe; thence North 64 degrees 51 minutes
10 seconds East, 371.49 feet to the point of BEGINNING.
PARCEL FOUR
BEGINNING at a point on the easterly side of Shipyard Lane 354.24
feet southerly along said easterly line from a monument located on said
easterly side. of Shipyard Lane, 2,226 .1 feet more or less from a monument
situated at the southeast corner of Main Road and Shipyard Lane and from
said point of beginning running the following three courses: (1) North 80
degrees 15 minutes 00 seconds East, 388.35 feet; thence (2) North 64
degrees 51 minutes 10 seconds East, 202.77 feet; thence (3) South 25
degrees 08 minutes 50 seconds East, 50.0_ feet to land in another parcel
described above; thence along said land South 64 degrees 51 minutes 10
seconds West, 80.0 feet to the northwesterly corner thereof; thence
the following two courses: (1) South 64 degrees 51 minutes 10 seconds
West, 129.53 feet; thence (2) South 80 degrees 15 minutes 00 seconds
West, 382.86 feet to said easterly line of Shipyard Lane; thence along
said easterly line North 23 degrees 30 minutes 50 seconds West, 51.48
feet to the point of BEGINNING. Said parcels three and four being the
same parcels conveyed to grantor by deed dated May 20, 1953 recorded
in Liber 6398atpage 162 in the Office of the Clerk of Suffolk County.
SUBJECT to any and all zoning ordinances or amendments thereto,
heretofore adopted by any Town, County or Municipality having juristic-
tion thereover.
SUBJECT to a perpetual easement set forth in a deed from Northern
Oyster Company, Inc. to J. and J. W. Elsworth Company, dated October 10,
1967 and recorded in the office of the Clerk of Suffolk County at Liber
6241 at.page 365, which is as follows:
IN CONSIDERATION of this conveyance, the Grantee hereby
grants to the Grantor a perpetual easement into, out of and
through adredged channel running from Gardiners Bay into a
certain dredged basin as shown on a survey prepared for the
grantor by R. Van Tuyl dated April 20, 1966 and as amended
under date of June 23, 1967 and said Grantee at . its own cost
:and expense shall bear the cost of dredging when necessary
-said-channel to maintain a depth of not less than eight feet
at-mean low -water.
AND the Grantee further grants to the Grantor a. perpetual
_•- easement into, out of and over and through a certain-dredged
basin which is connected by the foregoing dredged channel with
Gardiners. Bay which dredged basin is shown on the= foregoing
survey of. Van Tuyl subject to the maintenance of _bulkheads and
docks presently existing in said dredged basin.
