deeds at page 139.

WfTNESSETH, that the party of the first part, in consideration of Ten DoUars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected~ situate,
lying and being llaJtIe<: at Southold, in the Town of Southold, County or Sufrolk
state of New York, bounded and described as follows:
BEGINNING at a monument set on the northerly line of land of the party
of the second part at a point where said line is intersected by the
boundary line between land of the party of the first part and land of
Edgar and Arlene Marvin; running thence along said land of Marvin,
North 29 degrees 44 minutes 50 seconds West 27.23 feet to land of
Robert and Margery Burns; thence along said land of Burns, North 60
degrees 31 minutes 20 seconds East 45.69 feet to a point on the
extension northerly of the easterly line of land of the party of the
second part; running thence along other land of the party of the firs
part, South 29 degrees 56 minutes 10 seconds East 27.11 feet to the
northeasterly corner of said land of the party of the second part;
thence along said land, South 60 degrees 22 minutes 20 seconds West
45.78 feet to the point of beginning. containing 1242 square feet.
The Town of Southold covenants and agrees to provide access to the
grantor for ingress and egress northerly to Traveler Street over the
Northerly 27.11 feet of the westerly line of the land of the grantor,
as such line will be after this grant is made, at such time as the
Town of Southold obtains title to that strip of land running northerly
to Traveler Street.
The parties hereto agree that no fencing over 3 feet in height,
whether natural or man-made, shall exist on the common property line
of the land of the grantor and the land of the grantee, which said
line extends for a distance of 214 feet.
TOGETHER with aU right, title and interest, if any, of t~e party of the first part in and to any streets and
roads abuttmg the above. descrIbed premIses to the center hnes thereof; TOGETHER with the appurtenances
and all the estat~ and rIg.hts of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herem granted unto the party of tile second part, the heirs or successors and assigns of
the party of the second part forever.
AND the part~ of the, first part covenants that th~ party of the first part has not done or suffered anything
whereby the Said premises have ~een enc~mbered. 1n any. way whatever, except as aforesaid.
AND the party. of the. first part, '~ com.phance w~th SectIon 13 of the Lien Law, covenants that the party of
the !irst part WIll receIve the con.slderatIon for thIS conveyance and will hold the right to receive such consid-
eratIOn as a trust fund to be apphed first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
