A right of way 15 feet in width to lay pipes for highway drainage
purposes and to maintain and operate, relay and ranove said pipes on,
over and through the land hereinafter described, to wit:
ALL that certain plot, piece or parcel of land, situate, lying and
being in the Town of Southold, Suffolk County, New York, being a strip
of land 15 feet in width, described as follows:
Beginning at a point on the curved northwesterly line of Waterview
Drive at the easterly corner of land of DiBella and the southerly corner
of land of Ritter; from said point of beginning running southwesterly
along said northwesterly line on a curve to the left, having a radius of
111. 12 feet, a distance of 15.03 feet; running thence through said
land of DiBella on a line parall"el tJ, and 15. 0 feet southwesterly from
the northeasterly boundary of, sai'land, North 38 degrees 42 minutes
40 seconds West 280 feet, more or less, to ordinary high water mark
of Goose Creek; thence northeasterly along said high water mark, 15
feet, more or less, to said land of Ritter; thence along said land,
South 38 degrees 42 minutes 40 seconds East 277 feet, more or less,
to the point of beginning.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abuttmg the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate aud rights of the party of the first part in and to said premises' TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or ~uccessors and assigns of
the party of the second part forever.
AND the party of the, first part covenants that th~ party of the first part has not done or suffered anything
whereby the saId premIses have been encumbered In any way whatever, except as aforesaid.
AND the party, of the, first part, i;, cou;pliance w~th Section 13 of the Lien Law, covenants that the party of
the first part WIll receIve the consIderatton for thIS conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
