The meeting began at 7:08 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? Adoption of LPC meeting minutes from March 21, 2006 and April 11, 2006. [HOLD] MOTION made by Ray Huntington, seconded by Michelle Zaloom, to accept minutes of April 11, 2006. Motion carried 5/0. Applications: ?? Survey made by John Ehlers has been sent to Shalvey for final approval. The findings on the Phase I, Environmental Site Assessment Summary prepared by Nelson, Pope & Voorhis, LLC were discussed. LPC members want the discarded fuel oil tank and battery removed from the property and the stained area under the existing usable fuel oil tank cleaned up prior to closing. Melissa to contact landowners’ attorneys with this decision. ?? NEW SUFFOLK LAND CO. (f/k/a Campbell) SCTM # 1000-55-1-8.3 Location: 5455 Youngs Avenue, Southold Total PDR Acreage: 22.56 acres Reviewed request for building within easement area. Appointment with Ben Sisson. New Suffolk Land Co. has presented to the LPC a proposal to construct a Morton-style building 42’x90’ in the northeasterly corner of the property in an area deemed unfit for planting vines. An area 42’x60’ would be used for ag equipment storage and a 42’x30’ heated area would be used for a shop office and bathroom. Melissa informed LPC members that County policy allows for no heated office/bathrooms in their development rights easements. Ben Sisson made his presentation to the committee explaining the desired location [unfit for planting, nearness to road & utilities] and usage for the proposed building that he would like to see erected by 2007. LPC members suggested other possible sites for the building, possibly locating the building on adjacent property owned by New Suffolk Land Co. on which development rights are intact. Mr. Sisson emphasized that the best location would be where proposed (#1), but reluctantly agreed to consider alternate locations - (#2) wooded area far back off Horton’s Lane at s/e side of property, (#3) s/e corner near Young’s Rd (#4) on Horton’s Lane between two existing residential houses. Committee members drew map with location of potential sites and Mr. Sisson ranked them as noted above. Mr. Sisson, if building is allowed where proposed, is agreeable to angling the building and/or facing the bays’ openings away from Young’s Rd. LPC will discuss again at next meeting after obtaining additional information. Addition to Agenda: ?? Tim Caufield relayed discussions with Abigail Wickham in regard to her possibly gifting a conservation easement to Peconic Land Trust on all (with defined building areas) or part of the property. If conservation easement is gifted to Peconic Land Trust, PLT may consider, in the future, giving development rights to Town if Town purchases restricted land or development areas for open space purposes. Town would purchase 12 acres development rights easement from Shur and an additional 11 acres on the Arrieta property This plan would require a subdivision. Plan B [separates 3 ½ acres to include Shur house from the farm, leaving approximately 13 acres of development rights for Town purchase and an additional 10 acres of development rights for Town to purchase on Arrieta property, reserving 2.5± acres for existing house including a 1± acre area for riding arena behind the out parcel located on Oregon Road. This would require a lot line modification and Arrieta would purchase fee title to Shur farm and Shur’s would retain ownership of their home for future sale. LPC members favorable to Plan B. EXECUTIVE SESSION. The Members entered into MOTION made by Eric Keil, seconded by John Sepenoski, to direct Tim Caufield to present a purchase offer to property owners as outlined in Plan B, that would exclude the additional house lot presented in Plan A and move the riding arena location from the “Shur” property to a reserved area closer to Oregon Rd on the “Arrieta” property. This would result in an approximately 23 acre development rights easement. Motion carried 6/0. END OF EXECUTIVE SESSION Melissa informed LPC members that this project, if it can proceed quickly, may be a candidate for the Federal Grant proposal due this month. ?? Landowners have property on the market with a real estate broker who is looking for a buyer. Town and Peconic Land Trust have an interest in buying developments rights on parts of the property, which would result in a significant amount of preserved agricultural acreage, and have directed Tim Caufield to inform the broker of their willingness to participate in a joint preservation plan with a potential buyer, if one is found. Landowner was given a citation for a Trustee violation for land clearing. He would consider offering fee title to property to the Town at a possibly significant bargain sale price in exchange for Town’s dismissal of violation. Melissa has discussed the violation with the Trustees’ office and the Assistant Town Attorney. EXECUTIVE SESSION. The Members re-entered into MOTION made by Eric Keil, seconded by Ray Huntington, to direct Melissa Spiro, Land Preservation Coordinator, to negotiate a significant bargain sale with landowner for the purchase of fee title provided the Town Board is acceptable to the surrounding circumstances for the proposed sale offer and subsequent dismissal of the charges. Landowner accepted offer and contditions. END OF EXECUTIVE SESSION Ray Huntington reviewed environmental report received from the property owner and presented his report to the LPC members. Although mild contamination was found under tanks and floating on a salt water “pool”, it appears that the matter is being properly dealt with by landowners. The report for the paint facility came up clean. Spill was reported in 2004. The Phase I and Phase II report that he reviewed were compiled from research on the MII zoned area on the subject property. The landowner, at the request of LPC members, has agreed to include the “beach appendage/thumb” area in the sale to the Town. It was found that the “thumb” area is actually located in the R-80 zoned area, rather than in the MII zone as originally thought. Landowner has agreed to certain restrictions on the MII zoned area as suggested by LPC members but would like to retain and rebuild the dock area for personal and neighbors’ use (3-4 boat slips) and rebuild existing “shed” on property in same footprint but with a loft area to be used as a bunkhouse. This would remain a bargain sale. ??
