the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations

Dear Mr. Corwin:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1999 regarding
the above matter:
WHEREAS, David S. Corwin on behalf of JOHN T. FARRIS, JR.
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated March 4, 1999, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
JOHN T. FARRIS, JR. to remove deteriorated 3.S'X 7S' dock and
install new 4'X 7S' dock in same location, with the condition
that there be no installation of two 2-pile mooring dolphins.

BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

1999, the following recommendation was made:
Moved by Scott Hilary, seconded by William McDermott, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of JOHN FARRIS 26-2-20.1 to remove deteriorated 3.5'X 75'
dock, install new 4'X 75' dock in same location, install two 2-pile mooring dolphins.

Gentlemen:
Enclosed please find a revised drawing and application sheet for the above referenced
project.
In order to attempt to meet objections of the NYS Department of Environmental
Conservation to the original project, the scope of the project has been mitigated. The
proposed dock conforms closely to the 75' structure that was previously in place. Two 2-
pile dolphins have been added to the configuration of the original dock.
I hope to meet with you at the Wednesday, 22 September, Work Session to discuss any
questions that you may have concerning the project.

Dear Ms. Botts,
On April 12, 1999 we received a notice that a public notice is
posted for Mr. John T. Farris, Jr. to install a pier for mooring
in Orient Harbor, Gardiners Bay, Orient, and any comments to
this application should be sent by April 22, 1999.
The Southold Town Board of Trustees went on our regular field
inspection for applications that corne into our office for
requests for permits. We inspected the property of Mr. Farris
on Tuesday, March 16, 1999 along with three members of the New
York State Department of Environmental Conservation. The DEe
and the Board of Trustees did not approve the request for an
extension or addition of the existing dock as this dock is in a
prime shellfish area and there was no need for this extension.
He would most likely be able to keep and maintain the existing
parts of the dock but not construct the addition.
We further advised the applicant to present his plea to the DEC
for this extension and we as Trustees would put his application
on hold until further notice of the decision of the DEC.

Install a new 4 foot by 100 foot pier with a 6
foot by 20 foot "L"-shaped section and three two-
pile mooring dolphins. The purpose of this
project is to provide safe mooring for the
applicant's recreational vessel(s).

As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of the
date of this letter.
