Dear Mr. Daley:
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on July 25,2001, regarding the above matter.
WHEREAS, Richard Daley, R.A- on behalf of BUD GEORGE HOLMAN applied to the
Southold Town Trustees for a permit under the provisions ofthe Wetland Ordinance of the Town
of South old, application dated July 3,2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
July 25,2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town,

NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustee approved the application of BUD GEORGE HOLMAN
for a WetIand Permit for addition of a partial second story over existing first story, addition of a
second story deck and exterior stair to that deck - roof over the center section of the second floor
deck.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date ofthis notification.

Dear Mr Holman:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that: The portion of property which is located landward of the "top of the
bluff' as shown on the survey by Joseph A. Ingegno dated November 6,2000 last revised April 9, 2001
is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional

Please be advised that I am defense Counsel for Bud George Holman in the action entitled
CORtERt v. HOLMAN currently pending in Supreme Court, Suffolk County. I am in
receipt of a copy of the letter forwarded to you on November 13, 2002 by Michael L.
Cirrito, Esquire. In his letter, Mr. Cirrito advises that the survey provided to him during
the discovery process in the underlying litigation shows the subject groin is not on Mr.
Holman's property, but on the property of his neighbor to the west. Mr. Cirrito further
advises in his letter that due to the "inaccurate and false information" contained in the
application for the DEC permit, he and his clients believe the permit to be "voidable."
My client, Bud George Holman, purchased the property located at 350 Park Avenue,
Mattituck, New York from Frank Abrams in 1968. At that time, the subject groin was
already in place. Mr. Holman has advised the undersigned that at the time of his purchase
of the property from Mr. Abrams in 1968, Mr. Holman was provided with a survey,
prepared by Mr. Van Tuyl of G reen port, which survey demonstrated the westerly groin to
be entirely within Mr. Holman's property lines. Said survey also demonstrated that Mr.
Holman's property continued two (2) feet to the west of the subject groin.
Following the purchase of the property in 1968, Mr. Holman had a house constructed on
said property, raised his children in that house, and has borne the responsibility for the
maintenance and repairs of the easterly, westerly and center groins, as well as the costs
associated therewith, for the past thirty-four years. In addition, Mr. Holman has been
taxed since 1968 for 1.9 acres which he understands to include the westerly groin and two
(2) feet to the west thereof. Mr. Holman and his family quietly enjoyed the subject property
for thirty-three years until the commencement ofthe litigation by the Corieris in 2001.
The previous repairs to the subject groins were done approximately twenty (20) years ago
by Pat Carig of Southold at the request of, and at the cost to, Mr. Holman. Mr. Carig
passed away prior to the most recent repairs and, as such, Mr. Holman retained the
services of Costello Marine Contracting Corporation. Costello obtained all ofthe necessary
permits from the DEC and the Town of South old, and thereafter performed the work at
Mr. Holman's property. Following the completion of Costello's work, and following the
commencement of the underlying litigation by the Corieris, DEC Field Engineer Chris
Arfsten was contacted by Environmental Consultant, Paul Napolitano, on behalf of Mr.
Holman with regard to the work performed. Mr. Arfsten stated that the distance between
the bulkhead and the easterly groin was within tolerances, and that the DEC has no way of
enforcing the shortening of the westerly groin because it was not a remedial measure. Mr.
Arfsten also stated that the longer length of the groins will only help to encourage
regeneration ofthe beach area at PlaintiffCorieri's property, and that the DEC considered
the matter closed as of January 2001.
The survey to which Mr. Cirrito refers was only prepared in November, 2000 - more than
one year after the repairs made by Costello Marine Contracting Corp. at my client's
property. Until that time, and pursuant to the original survey presented to Mr. Holman
upon his purchase of the property, Mr. Holman understood the westerly groin and two (2)
feet west thereof to be entirely within his property lines. Based upon the original survey,
Mr. Holman has, for thirty-four years, ensured that the subject groins were maintained
and repaired to remain functional, and has borne the cost for said repairs. As such, any
allegation of "inaccurate and faIse information" in the permit application cannot and
should not be considered valid or in good faith.

pursuant to ECL71-Q301 andSAPA 401(3). .'

Gentlemen:
I am sending you this correspondence on behalf of my clients
David & Ann Corieri, the fee owners of 412 Park Avenue Mattituck,
New York the property abutting the above referenced property to
the East.
On March 4, 1999 the D.E.C granted to Bud Holman, the owner
of 350 Park Avenue, a permit to reconstruct two (2) low-profile
groins. The permit required Mr. Holman to shorten the Westerly
groin 10 feet. In addition, each groin was to be constructed 34"
below the top of the bulkhead.
The application upon which this permit was approved is
enclosed for your review. As you will note, on the seventh page
of this document, the site plan filed with the application
indicates that both the easterly and westerly groin were located
within the applicants' property.
Since the permit was issued the applicant has rebuilt and
extended the easterly groin as permitted but has failed to
shorten and lower the westerly groin as required.
As a result of this groin construction and the failure of
the applicant to complete the permitted work as required the
Corieri's, who purchased the property on January 19, 1999 have
lost substantially all of their beach front. The Corieri's then
instituted a civil action against the applicant now pending under
index #28707-00 in Suffolk County, New York.
During discovery in that action the Defendant produced a
survey, a copy of which is enclosed. This survey indicates that
the Westerly groin, which has not been modified since the
application, is not on the applicant's property but rather is on
the property of his neighbor to the West. Therefore, the
applicant could never have had the ability to comply with the
permit's conditions since Holman never had the legal right to
modify the Westerly groin as required.
This mis-statement in the permit application, whether
intentional or unintentional, calls into question the entire
grant of the permit and in our opinion makes the permit voidable.
I am enclosing a copy of the report of Aram V. Terchunian, a
Coastal Geologist who has determined that,
"The impact of the Holman Groin is to block
littoral sand transport from reaching the
Corieri property and thus causing the beach
to erode at an accelerated rate. This impact
was easily predictable, and avoidable, if the
specifications of the US Army Corps of
Engineers-shore Protection Manual were
followed. Shortening and lowering the updrift
(west) groin would allow more sand to enter
the groin compartment on the updrift (west)
side, since the sand impounded there would be
released to the downdrift (east)".
My clients property and his riparian rights have been
severely impacted by the grant of this permit based upon
inaccurate and false information regarding property ownership.

your office and that appropriate relief and action be taken with

the erosion problem worsens by the day and is accelerated.

1.1.2. Project Scope
The scope of the project is the Corleri property and the surrounding beachfront properties
to the east and west. This report will evaluate the impact of the Holman groin on the
Corleri property and the potential alternatives to alleviate any adverse environmental
impact.
1.2. Environmental Setting
1.2.1. Site Description & Location
1.2.1.1.Shoreline Features
The study area of this project includes beaches, bluffs, dunes, inlets, groins, and jetties
along the Great Peconic Bay shoreline in the vicinity of the Corleri and Holman properties
(See Figure 1).
1.3. Coastal Geologic Setting
1.3.1. Generalized Coastal Geology
The study area is a recent beach deposit on the Great Peconic Bay shoreline of the North
Fork of Long Island. The spine of the North Fork was fonned by glacial activity during
the Pleistocene Glaciations, which left behind an assemblage of sediments to fonn the
Roanoke Point Recessional moraine. As the glaciers gradually receded approximately
18,000 years ago, the meltwater and wind processes transported sand and sediments to the
south forming an outwash plain that is today recognized as the Great Peconic Bay
shoreline of the North Fork (Sirken, 1995 and Eise~ 1977). Gradually sea level rose and
coastal processes reworked the sediment along the shoreline into the current
configuration.
1.3.2. Surficial Sediments and Soils
The surface soils of the study area are identified on the Soil Survey of Suffolk County
(USDA Soil Conservation Service, 1975) (Figure2) as:
Bc - Beaches: Sandy, gravely, or cobbly areas between water and mean sea level and
dunes or escarpments. All of the beaches along Long Island Sound are very gravely and
cobbly. Covers 1.2% of ground in Suffolk County.
Rd A - Riverhead: Deep, well drained, moderately coarse textured soils that fonned in
a mantle of sandy loam or fine sandy loam over thick layers of coarse sand and gravel.
These soils occur throughout the county in rolling to steep areas on moraines and in level
to gently sloping areas on outwash plains.

1 3.3 Generic Littoral Transport, Beach, Bluff,
and Dune Processes
The coastal processes oflittoral (longshore) transport, driven by the wind, waves, and
tides have gradually reshaped the underlymg soils into a characteristic beach and 101"
blufli'dune system common to the Peconic Bays. Littoral transport or drift is the
alongshore movement of sand along the beach in response to wind, waves, and tic es.
Ordinarily, waves will strike the beach on an angle and move sand in one dommant
direction (Figure 3) The supply side is called the updrift and the receiving side is called
the downdlift

A large amount of sand is also moved along the shoreline as submerged nearshore sand
bars. These sand bars break wave energy and this helps protect and stabilize the beach.
They also supply large volumes of sand to the beach.

Sand on the beach is moved by wind into dunes and stabilized by seaside vegetation,
including American Beach Grass, Dusty Miller, Seaside Goldenrod, Bayberry, Beach
Plum, Rosa Rugosa, and other salt tolerant grasses. Dunes typically form of accretionary
or stable shorelines. The dunes on the Peconic Bays are typically low profile, usually not
more than 10 to 12 feet above sea level.
The source of some of the sand on the Peconic beaches and dune are the eroding bluffs.
Sand eroded from the bluff is entrained in littoral transport and moved laterally to maintain
and nurture the beaches and dunes as described above (Figure 4).

2.2. Coastal & Littoral Processes
On the subject site, the sand moves dominantly from west to east as demonstrated above,
and as reported in the scientific literature for this area (Eisel, 1977 - Figure 6). Nonnal
day-to-day processes and storm processes move the sand to the east in littoral transport as
described earlier. As a consequence of this dominant littoral sand transport, sand builds
up against the west side ofJames Creek and Deep Hole Creek. Simultaneously, sand is
eroded from the west side of James Creek

2.3. Shoreline Structures
2.3.1. Groins and Jetties
Groins and jetties are similar structures, which are used for very different purposes in
coastal stabilization. Jetties are used at inlet entrances to block the flow of sand into
channel and thus preserve navigation. Groins are used on the open beach to deposit sand
for a recreational or protective beach. Either structure can be constructed of wood, metal,
plastic, rock, or similar structures. Although the uses of groins and jetties are different,
their impacts are similar, and thus the reason that they are often grouped together Groins
may be used either singly (Figure 7) or in groups (Figure 8), depending on the desired
condition and the site-specific configuration ofthe shoreline.

In either case, the object of groin construction is to cause sand to deposit in one specific
location (the updrift side) and to prevent sand from depositing in another location (the
downdrift side). It is this specific function of groins, which has prompted the US Army
Corps of Engineers (the primary federal agency responsible for coastal stabilization
engineering the United States) to develop very specific design, construction, and
reconstruction rules. For example, the Shore Protection Manual (which is the recognized
design standard in coastal engineering) developed and written by the Corps outlines six
rules for groin design:

In addition, the Corps has gone as far as to advise coastal engineers and other
professionals of potential legal consequences from failure to follow the fundamental design
principles, including prefilling the groin compartments with sand, proper spacing and
length, and constructing the entire project in order:
11. .!,eJ;~_1 Aspects.
The legal considerations discussed previously in Section V~3 of this
chapter are also applicable to the construction of groins. Legal problems are
varied and often complex, due to the diversity of legal precedent in different
jurisdictions and the application of the factual setting to a particular body
of law.
Previous information on the functional design of groins emphasizes the
fact that adverse downdrift shore erosion can be expected if the updrlft. side
of the groin is not artificially filled to its impounding capacity at the t~e
of groin construction. Liability for property damage insofar as the Federal
Government is concerned will be determined with reference to the Federal Tort
Claims Act. It is therefore incumbent on the owner of groin-type st.ructures
to recognize the legal .tmplications of this coastal structure in order to
plan, design, constructt and maintain the structure accordingly. It is thus
prudent to seek legal counsel at the earliest stages of formulation.

The Corps developed a detailed procedure for the order of groin construction, to ensure
that an adequate supply of sand is supplied to the downdrift beach. Furthermore, the
Corps recommends that all groin compartments be prefilled with beach compatible sand to
facilitate the bypass of sand to downdrift beaches and minimize downdrift beach erosion.
8. Order of Gro~Co~tructi~.
At sites where a groin system is under consideration, two possibilities
arise: either the groin system is to be filled artificially or longshore
transport is to be depended on to produce the fill. With artificial fill, the
only interruption of lo-ngshore transport will be the period between the time
the groin system is constructed and the time the artificial fill is made. For
economical reasons, the fill is normally placed in one continuous operation,
especially if it is being accomplished by hydraulic dredge. Accordingly, to
reduce the time period between the groin construction and the deposition of
the fill, all groins should preferably be constructed concurrently.. Deposi-
tion of the fill should commence as Boon a8 the stage of groin construction
permits. When depending on longshore transport, no groin will fill until all
the preceding updrift groins have been filled. This natural filling ....'"ill
reduce the supply to downdrift beaches. The time period required for the
entire system to fill naturally and the material to resume its unrestricted
movement downdrift may be 80 long that severe downdrift damage may result.
Accordingly, to reduce this damage, only the groin or group of groins at the
downdrift end should be constructed initially. The second groin,. or group,
should not be started unt.il the first has filled and material passing around
or over the groins has again stabilized the downdrift beach. Although this
method may increase costs t it will not only aid 1n reducing damage, but will
also provide a practical guide to the spacing of groins.

Finally, the Corps developed a detailed engineering procedure for reconstructing existing
groin fields, which includes tapering of the downdrift groins to minimize disturbances to
the downdrift shoreline and to reintegrate the flow of beach sands into the natural system
(Figure 9)

In addition to this detailed design standards developed in the "Shore Protection Manual' ,
the Corps also prepared a more simplified "Coastal Engineering Technical Note: Groins -
Their Applications and Limitations" (attached), for use in design and permit guidance.
This Technical Note of eight pages reinforces the guidance in the "Shore Protection
Manual" and stresses the fact that
"the accumulation of material (accretion) on the updrift side is
accompanied by a corresponding amount of erosion on the dawndrift side
of the groin". (Page 1-2)
This Technical Note also includes a section on "Functional Limitations", which
underscores the problems with inadequate sand supply, the order of groin construction,
and the recommended practice of prefiIIing groin compartments with beach compatible
sand (see Pages 2 - 3).
Repeatedly, the Technical Note specifies that groins will only work where there is an
adequate supply of sand, entrapped sand can lead to downdrift erosion, the groins height
and length must be chosen to maximize updrift filling and minimize downdrift erosion,
groins must be stable against earth pressures and resist scour, and constructed to be
prevent flanking (see page 6 & 7 - Design Considerations).

The reconstruction of the eastern groin, including the seaward extension and the use of
irnpenneable, interlocking PVC, coupled with the lack of action on the western (updrift)
Holman groin has had a devastating and highly erosive impact on the Corleri beach.
Moreover, this impact was entirely predictable.
In addition to extending the groin seaward and increasing its sand trapping capacity,
reconstructing the groin with modern PVC materials (to replace old, probably deteriorated
wooden materials) makes the groin more "sand tight". In other words, older structures
tend to "leak" sand through the groin and thus a rebuilt groin, which does not allow this
sand through will decrease the sand supply, will cause increased downdrift erosion.

3. Conclusions and Findings
3.1. Coastal Geology & Uttoral Process
The Holman and Corieri properties are located along the shoreline of Great Peconic Bay
where the prevailing littoral transport of sand is from the west to the east. The shoreline
consists of glacially derived soils that have been reworked by coastal processes and thus
the beach consists of a veneer of sand coating the glacial sediments.
3.2. Geomorphology, Inlets, & Shoreline Structures
The shoreline is defined by natural compartments, delineated on the east and west ends by
inlets at Deep Hole Creek and James Creek, respectively. The shoreline been modified by
the construction of jetties at James Creek and a series of groins and seawalls along the
shoreline east of James Creek. The length and spacing of these groins as well as the
construction are highly variable, although most of the older groins are constructed of
timber. These groins are also in various stages of repair. The Holman property contains
three groins and the downdrift (eastern) groin was reconstructed and lengthened in 1999.
3.3. The Impact of the Holman Groin
The impact of the Holman Groin is to block littoral sand transport from reaching the
Corieri property and thus causing the beach to erode at an accelerated rate. This impact
was easily predictable, and avoidable, if the specifications of the US Army Corps of
Engineers - Shore Protection Manual were followed.
3.4. Potential Remedial Actions
Shortening and lowering the updrift (west) groin would allow more sand to enter the groin
compartment on the updrift (west) side, since the sand impounded there would be released
to the downdrift (east).
Establishing a uniform groin length and spacing (consistent with the Corps of Engineers
design standards) along the entire beachfront would be logical if the remaining groins to
the east, in this case the Corieri groins ( and others) were of equal length and spacing. If
the remaining downdrift groins were shorter, than the US Army Corps of Engineers
formula for groin tapering and spacing would be most appropriate.
Adding beach compatible sand to the Corieri property is also recommended, but only in
combination with the other structural changes to the groins descnoed above.

of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with the
terms and conditions of the permit.
Item B: Permittee to Require its Contractors to Comply with Permit
The permittee shall require its independent contractors, employees, agents and assigns comply with this permit,
including all special conditions, and such persons shall be subject to the same sanctions for violations of the
Environmental Conservation law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights
of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the worik suspended
pursuant to ECl 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Departmenfs representative during an inspection to the
permit area when written or verbal notification is provided by the Department at least 24 hours prior to such inspection.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDESl,
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:
NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg #40, Stony Brook, NY 11790-2356
General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the ECl and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

( TIDAL WETLANDS)
1. If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or a~er the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and fiood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent
or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services
or local government which may be required.
4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project.
5. Any material dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.
7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
8. If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions lisied herein are met.
9. At least 48 hours prior to commencement of the project, the permittee and contractor shall si9n and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
2. The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas greater than 75 linear feet from the tidal wetland boundary.
3. Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be
excavated landward of the bulkhead and retained so as notto enter the waterway, tidal wetland or protected buffer
area.
4. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion
or prior to permit expiration, whichever comes first. The approved methodologies are as follows: .
a. Stabilization of the entire disturbed area with appropriate vegetation (grasses, etc.).

Dear Directors:
We recently bought a waterfront home here in the town of Southold on the Great
Peconic Bay. Until this month there was a beach. Now there is none.
In June our neighbor had a groin rebuilt immediately west of our beach. The groin was
constructed very high on the bulkhead. It is my understanding that permits for this type
of construction are issued to help property owners maintain their beaches, but built on a
low profile as to not erode neighbors' beaches. Sand has built up on his side, at the
expense of reducing our beach significantly. We estimate at least an 18" loss of sand
depth on our side.
Would you please have this groin checked to see if it conforms to what was permitted by
the town board and/or the D.E.C.? Things are changing rapidly, so we would
tremendously appreciate your prompt attention to this matter.

Dear Mr. Krupski:
Thank you for taking the time to meet with me at the Holman property in Mattituck
on the 12th of January to review the existing conditions at the site in regard to our
application to reconstruct three existing functional groins.
Please let this letter confirm Mr. Holman's acceptance of the Trustees recommen-
dations at the conclusion of our meeting. We will also revise our drawings to reflect the
more accurate conditions that exist along with the proposed changes.
. The three groins are to be consistent in length and elevation
. The elevation of each groin is to be 34" below the top of the existing bulkhead
which attaches to the existing bulkhead just beneath the lower bottom stringer.
. Remove 10' from the westerly 64'groin and lower the elevation to 34"
. Extending the center groin by 6' to an overall length 54' and raising the height
by 2".
, The length of the easterly groin is to remain 50' long with 6" of additional height
at the bulkhead connection

On the day of the Trustees inspection mean-low-water at that particular site was
2:32 p.m. Our inspection occurred slightly after 3:30 p.m. There was a AGOGEE
condition the previous day (January 11th) and its gravitational influences on the tide. The
winds were light easterly and the barometric pressure was 29.97 inches.
Again, we acknowledge and accept the recommendations of the Trustees. Several
photographs on the day of our meeting along with plans that have been revised
accordingly are enclosed. We will forward copies of same to the New York State
Department of Environmental Conservation.

Dear Mr. Herrmann,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on January 22, 1999, regarding
the above matter:
WHEREAS, BUD HOLMAN, applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated November 2, 1998 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 22, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
BUD HOLMAN to reconstruct three low-profile jetties, one 65' and
two 50' long, with condition that new drawings be submitted
showing all jetties the same lenqth, not as requested in
description. Located: 350 Park Ave., Mattituck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete pro;ect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Protection Unit lu1vc initiated an effort to reaoh uniform deci$ions on projects involviIU!: tidal
wetl"",ci3 in th.. Town. Among the three pllrt;e.~ present for this meeting 1 inspection the following
agreements were reached.

The vast majority of the groins along this section of Oreat Pcconic Bay are too long. The length
of these groins should not e:xceed a length greater than the: ML W mark. Also the vast majority are
too high and should be reduced in height.
. The following objections and modifications are required:
1. The plan submillc<l is ina!Xw:ate, the groin on the western boundaJ)' oflhe property is in line
with the existing return, not off set as shown.
2. The three groins, one at 65' and two at 50' will be reduced to 36' (west), 32'(middle:} and
18'(east} respectively which reflect the AML W mark as depicted on the plans submitted by
Costello Marine Contr.
3. The elevation of the groin will not exceed a height that is less than 3' 3" from the top of the
bulkhead.
