Comments from the Board at the September meeting indicated that there was concern that the structure extended more than one-third of the way across the waterway. Item 2A (POLICY 44): The proposed walkway will be supported by piles, with the decking no less than two feet above ordinary high water; two 2-pile dolphins will secure the proposed floating dock. Structures of this type, size, and general configuration are known by common local knowledge and experi- ence to have no significant effect upon tidal flow and currents in and around the site of the proposed project. Birds which frequent the creeks of the North Fork tend to seek less developed areas than that in which the project is proposed and they are rarely (with the exception of seagulls) seen at and around areas already populated and developed. It may be supposed, therefore, that the addition of this dock would not adversely affect waterbirds through any significant alteration of either habitat or food chain. The same comments apply equally to wildlife in the area. The walkway, which crosses about 14' of s. patens and about 3' of s. alterniflora. is oriented almost directly nOrth-and-south, and this orientation will minimize the area of these wetland grasses which receive no direct sunlight. There is no aquatic vegetation below the low water mark which would be shaded by the ramp and float, and the float will not rest on the creek bottom at low tide. The portion of the project which extends beyond the ordinary high water mark is only about 350 square feet in area, and the impact of its shadow should not have any adverse effect upon the limited fin- and shellfish population in the immediate area. As a matter of fact, personal ex- perience has shown that blue claw crabs flourish in such an environment. Mussels and fiddler crabs are essentially the only inhabitants of the intertidal zone in the area. Other specific benefits described in the explanation of Policy 44 are not considered to be fac- tors with the proposed project: erosion, flood, and storm control; natural pollution treatment; groundwater protection; recreational opportunities; educational and scientific opportunities. The structure as proposed, because of its low profile, will not significantly alter the aesthetic appeal of the area by reducing "aesthetic open space in many otherwise densely developed ar- eas" since the proposed use is common throughout the area, the creek in question is bounded throughout by private property, and the property owners are where they are because the small- boat maritime setting and use appeals to them.
