Dear Mr. Klein:
On February 8, 1999, the New York District Corps of
Engineers received a request for Department of the Army
authorization for reconstruction of a 13-foot existing bulkhead,
construction of a 16-foot bulkhead to create boat slip, and
dredging of approximately 25 cubic yards of material from the
boat slip area to a maximum depth of 3 feet below low mean water.
The site is located in James Creek off Great peconic Bay at
Mattituck, Town of Southold, Suffolk County, New York.
Based on information submitted to this office, our review of
the project indicates that an individual permit is not required.
It appears that the activities within the jurisdiction of this
office could be accomplished under Department of the Army
Nationwide General Permits Number 13 & 19. The nationwide
permits are prescribed in the December 13, 1996 Federal Register,
Final Notice of Issuance, Reissuance, and Modification of
Nationwide Permits (61 FR 65874), The work may be performed
without further authorization from this office provided the
activity complies with the permit conditions listed in Section B,
Nos. 13 & 19, Section C, and any applicable regional conditions
added by the State of New York, copies enclosed.
This determination covers only the work described in the
submitted material. Any major changes in the project may require
additional authorizations from the New York District.
Care should be taken so that construction materials,
including debris, do not enter any waterway to become drift or
pollution hazards. You are to contact the appropriate state and
local government officials to ensure that the subject work is
performed in compliance with their requirements.

This verification is valid for a period of two years from
the date of this letter, unless the nationwide permit is
modified, suspended or revoked. This verification will remain
valid for two years from the date of this letter if the activity
complies with the terms of any subsequent modifications of the
nationwide permit authorization. If the nationwide permits are
suspended, revoked, or modified in such a way that the activity
would no longer comply with the terms and conditions of a
nationwide permit, and the proposed activity has commenced, or is
under contract to commence, the permittee shall have 12 months
from the date of such action to complete the activity.
Within 30 days of the completion of the activity authorized
by this permit and any mitigation required by this permit, you
are to sign and submit the attached compliance certification form
to this office.

16, 1999 the following recommendation was made:

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of CHARLES KLEIN 122-4-17 to repair wooden bulkhead and
boat slip inkind/inplace. 16' extension is proposed on the north side perpendicular to the
shoreline and necessary to prevent silting in boat slip and to prevent impacts on the Spartina
marsh. Existing boat slip will be dredged to 3' below mean low water.

On behalf of the property owner, this letter serves as my request to obtain a Wetlands/Trustee
Lands permit for the proposed project.
Enclosed are copies of the Town permit application, location map, plans and site photographs.
The project proposes a replacement of the deteriorated boat slip shown on the plan and minor
dredging of the boat slip area to a serviceable depth. Presently, the applicant is unable to use the
property for boat mooring. A previous fixed dock was destroyed by weather. The existing slip
has silted in due to erosion from the upland area. The applicant proposes to control the siltation
by restoring the bulkhead and recreating the boat slip. The bulkhead will be replaced 5-feet land
ward of the existing bulkhead to provide space for the owner's vessel. Bulkhead will be
constructed with CCA-treated timber sheeting and piles. Dredging is proposed to a depth of
three feet below mean low water and will extend to the face of the adjacent bulkhead (see
photos). Approximately 25 c.y. of soil needs to be excavated from the slip area to reach an
appropriate mooring depth.
A small section of new bulkhead is needed to prevent future siltation of the slip. This proposed
sixteen foot-long segment is located on the north side of the boat slip. This will be a low
bulkhead to control erosion and will not disturb the adjacent Spartina bed. All construction will
be undertaken in a manner to avoid disturbance to the existing Spartina vegetation. Erosion

control materials can be used to protect the open waters and vegetated wetlands from disturbance
and siltation. The dredged material will be taken off-site and disposed in an appropriate upland
area.
This project will increase access to the water while minimizing environmental impacts. There is
no fill in wetlands proposed for this project and the area behind the repaired bulkhead will be
maintained with low-maintenance turf grass. The proposed bulkhead design and construction
techniques insure a durable structure that will have minimal adverse effects on tidal wetlands

The Board of Trustees has inspected the above referenced property as per your request,
for the possibility of constructing a dock.
It may be possible to construct a small dock/catwalk out from the cut out at the sw comer
ofthe property; but probably not a floating dock.
This is not a final determination; this will have to go through the full application and
hearing process, in order to determine all the factors and impacts on the environment.
Specifically, in order to review the proposal the Board would need water depths, channel
location, and the width ofthe existing creek
In addition, the existing chain link fence is an unpermitted structure within 100' of the
wetlands, and is not allowed under Chapter 97 of the wetland code. Fences along the
creeks block critical wildlife corridors. Please remove or move the fence in order to avoid
a fine or summons.
