HARNEY 4015 MAIN BAYVIEW RD., SOUTHOLD SCTM#78-2-16 Dear Ms. Martin: The Southold Town Board of Trustees reviewed the site plan prepared by Robert I. Brown dated February 27,2006 and determined the proposed renovations and additions to the existing dwelling, and replacement of the existing sanitary system, to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. 2 This determination is not a determination from any other agency. Harney 1000-78-02-16 4015 Main Bayview Road, Southold ~ Dear Lauren, As per our conversation yesterday, I am currently the permit agent for the clients mentioned above. The renovations and additions currently being proposed for their residence are well over 200' from the wetland edge of theirs & the adjoining property to the east. We are currently awaiting a promised DEC letter of Non-Jurisdiction as all proposed activity is above the 10' contour, with a gradual slope. The Health Department is waiting for the DEC letter and in addition is requiring a letter of Wetlands non-jurisdiction be written before issuing the permit to replace the existing septic system. Following, please find a copy of the topographical survey, a stamped, signed copy of our site plan for the proposed work, and a letter of authorization to act as agent on their behalf Thank you for your time and consideration of our request.
