The Southold Town Board of Trustees reviewed the survey dated June 9, 2000 and determined
the demolition ofthe existing house and the reconstruction of a single-family dwelling with a
larger footprint to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland
Code.
However, any activity within 100' of the Wetland line would require permits from this office.
This determination is not a determination from any other agency.

The Southold Town Board of Trustees reviewed the survey dated

The fOllowing action was taken by the Board of Town Trustees
during its regular meeting held on November 30, 1995 regarding
the above matter:
WHEREAS, Proper-T Permit Services on behalf of CHARLES MILLMAN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated September 5, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 30, 1995, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grants a Wetland Permit to
Proper-T Permit Services on behalf of CHARLES MILLMAN to
construct 3' X 52' walkway, a 3' X 16' ramp and a 6' X 20'
float, two-2 pile dolphins. Located 2760 Deep Hole Drive,
Mattituck.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.

In line with the changes in this project which were discussed at the October 26, 1995 meeting,
please amend the application as follows: fixed walkway 3' x 52', hinged ramp 3' x 16', float 6' x
20', The location of the landward end of the fixed walkway will be moved to the southeast so
that the walkway is perpendicular to the general shoreline; the location of the seaward end of
the float and the 2-pile dolphin which secures it will remain unchanged.
A new drawing will be submitted before the November meeting.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type: I
DESCRIPTION OF ACTION: Applicant requests permit to relocate and
reconstruct dock as follows a 4' X 16' ramp and a 6' X 20' float with
2- 2 pile dolphins to run perpendicular to shoreline.

Dear Sir:
The Board at its 9/28/95 meeting declined to approve the currently-proposed project as an
amendment to Grandfather Permit #4471.
The supporting documents submitted to the Board with that request meet all of the Board's re-
quirements for a full application for a permit, and I ask that the project now be considered for
a new permit based upon those documents.
Comments from the Board at the September meeting indicated that there was concern that the
structure extended more than one-third of the way across the waterway. This is not correct:
IT IS IMPORTANT THAT THE BOARD UNDERSTAND THAT THE STRUCTURE
EXTENDS LESS THAN ONE-THIRD OF THE WIDTH OF THE CREEK.
I am enclosing a check in the amount of $110, the balance due for a full application.

At a meeting of the Southold Town Conservation Advisory Council held
Thursday, September 21, 1995 the following recommendation was made:
A-19
Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request to amend the Wetland Permit of CHARLES
MILLMAN 123-4-10 to construct fixed open walkway 4' x 72' , hinged ramp 4' x
16' , and floating' dock 6' x 20'; install two 2-pile dolphins to secure
floating dock.
2760 Deep Hole Drive, Mattituck
The CAC recommends disapproval because the applicant currently has a permit
to reconstruct a short dock to the east which will give access to the water.
If the applicant wants to relocate the structure to the west the the Council
would approve but it must be of the same configuration as is currently
permitted and reconstruction must be to current standards.
Vote of Council: Ayes: All

COASTAL ASSESSMENT. Item 2A (POUCY 44):
The proposed walkway will be supported by piles, with the decking no less than two feet above
ordinary high water; two 2-piIe dolphins will secure the proposed floating dock. Structures of
this type, size, and general configuration are known by common local knowledge and experi-
ence to have no significant effect upon tidal flow and currents in and around the site of the
proposed project.
Birds which frequent the creeks of the North Fork tend to seek less developed areas than that
in which the project is proposed and they are rarely (with the exception of seagulls) seen at and
around areas already populated and developed. It may be supposed, therefore, that the addition
of this dock would not adversely affect waterbirds through any significant alteration of either
habitat or food chain. The same comments apply equally to wildlife in the area.
The walkway, which crosses about 14' of s. patens and about 3' of s. alterniflora. is oriented
almost directly north-and-south, and this orientation will minimize the area of these wetland
grasses which receive no direct sunlight. There is no aquatic vegetation below the low water
mark which would be shaded by the ramp and float, and the float will not rest on the creek
bottom at low tide.
The portion of the project which extends beyond the ordinary high water mark is only about
350 square feet in area, and the impact of its shadow should not have any adverse effect upon
the limited fin- and shellfish population in the immediate area. As a matter of fact, personal ex-
perience has shown that blue claw crabs flourish in such an enviromnent. Mussels and fiddler
crabs are essentially the only inhabitants of the intertidal zone in the area.
Other specific benefits descnbed in the explanation of Policy 44 are not considered to be fac-
tors with the proposed project: erosion, flood, and storm control; natural pollution treatment;
groundwater protection; recreational opportunities; educational and scientific opportunities.
The structure as proposed, because of its low profile, will not significantly alter the aesthetic
appeal of the area by reducing "aesthetic open space in many otherwise densely developed ar-
eas" since the proposed use is common throughout the area, the creek in question is bounded
throughout by private property, and the property owners are where they are because the small-
boat maritime setting and use appeals to them.
Based on these comments, it is suggested that the project is not inc~istent with Policy 44.
