Dear Mr. Herrmann:
The following action was taken by the Board of Town Trustees
during its regular meeting held on August 23, 2000 regarding the
above matter:
WHEREAS, En-Consultants, Inc. on behalf of PETER & BARBARA SWAHN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated August 4, 2000, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on August 23, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
PETER & BARBARA SWAHN to remove 103' of existing timber bulkhead
and 65' of existing retaining wall; construct +/-94' of new
timber bulkhead; remove existng 75' groin; remove and replace
(inkind/inplace) existing 39' timber groin; remove and replace
(inkind/inplace) and extend landward by 6' existing 58' timber
groin; and backfill with approximately 75 cy. of clean sand to
be trucked in from an upland source and planted with beach
grass. As necessary, regrade and reconstruct timber stairs
landward of bulkhead.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr. Arfsten:
Pursuant to our recent telephone conversation and my discussions with the Town of South old Trustees,
please find (4) copies of a revised project plan depicting the easternmost groin to be removed and
existing sections of bulkhead and retaining wall to be removed in favor of a new bulkhead.
Specifically, the project description should now read as follows: Remove 103' of existing timber
bulkhead and 65' of existing retaining wall; construct :!:94' of new timber bulkhead; remove existing
75' groin; remove and replace (iklip) existing 39' timber groin; remove and replace (iklip) and extend
landward by 6' existing 58' timber groin; and backfill with approximately 75 cubic yards of clean sand
to be trucked in from an upland source and planted with beach grass. As necessary, regrade and
reconstruct timber stairs landward of bulkhead pursuant to Letter of Non-Jurisdiction #1-4738-
02663/00001.
By copy of this letter and revised plans, I am similarly requesting that the Town of Southold Trustees
issue their wetlands permit.

Under authority of the Nationwide General Permit
Program, replace 103 linear feet of timber
bulkhead within 18 inches of the existing bulkhead
with approximately 75 cubic yards of clean upland
material as backfill. Replace in-kind and in-
place, three low-profile timber groins and install
a 4 foot by 5 foot set of access steps. The
purpose of this project is.to provide safe access
to the beach and stabilize the shoreline.

of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the

Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicants
have certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.

application, your comments are requested within 15 days of the
date of this letter.

At the meeting ofthe Southold Town Conservation Advisory Council held Tuesday, August 15,
2000, the following recommendation was made:
Moved by Bill McDermott, seconded by Bret Hedges, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of PETER & BARBARA SW AHN 123-8-8.1&8.2 to reconstruct
(within 18") +/-103' of existing timber bulkhead; remove +/-65' of failing timber retaining wall;
and backfill with approx. 75 cy. of clean sand to be trucked in from an upland source. Remove
and replace (inkind/inplace) (3) low-profile timber groins (58'; 39'; 75'); construct 4'X 5' steps
to beach; and reconstruct as necessary timber stairs landward of bulkhead. New 64' and 12'
sections of bulkhead to be constructed +/-2'6" higher than existing to meet existing elevation of
27' section.

12' sections of bulkhead to be constructed :t2'6" higher than existing to meet existing elevation
