Dear Mr. Just:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 25, 2001 regarding the above matter:
WHEREAS, J .M.O. Environmental Consulting on behalf of STEVE POWERS applied to the
Southold Town Trustees for a permit under the provisions ofthe Wetland Ordinance of the Town
of South old, application dated March 20,2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 25, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 ofthe Southold
Town Code,

WHEREAS, the Board has detennined that the project as proposed will not affect the health,
safety and general welfare ofthe people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of STEVE POWERS to
remove the existing catwalk and piles that had secured float and ramp assembly. To reconstruct
a 4'X 103' catwalk, a 4'X 12' extension to the seaward end of the reconstructed catwalk, a 4'X
16' ramp and a 6'X 20' float in a "T" fonnation to be secured by (2) 8" piles, with the condition
that the piles on the catwalk are 6" and are to be hand-dug through the wetlands.
BE IT FURTHER RESOLVED that this detennination should not be considered a detennination
made for any other Department or Agency, which may also have an application pending for the
same or-similar project.
Pennit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and pennit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

includes this extension.
Please provide this information to the Department of State as Soon as possible. Pursuant to 15 CFR 930.60(a),
the review of your consistency certification will begin after we receive this information and any other data and
information necessary for us to adequately assess the effects of the proposal On the Coastal Management
Program. Any additional information which you believe will facilitate our consistency review of this project
would be appreciated. The Corps of Engineers cannot issue a permit for this project unless the Department of
State concurs with your consistency certification.

The New York District, U.S. Army Corps of Engineers, has
received a request for Department of the Army authorization for
the following activity:
APPLICANT:

ACTIVITY:
Reconstruct an existing 4 foot by 103 foot fixed
timber pier, extend by 12 feet, and install a4
foot by 16 foot walk-ramp and a 6 foot by 20 foot
float secured to two 8-inch pilings. The purpose
of this project is to provide an adequate mooring
facility for the applicant's vessel(s)

As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town ConserVation Advisory Council held Monday, April
16, 2001, the following recommendation was made:
Moved by Bill McDermott, seconded by Melvyn Morris, it was .
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit application of STEVE POWERS 123-8-26.1 to remove the existing
catwalk and piles which had secured float and ramp assembly, ramp and float had
drifted away. To reconstruct a 4'X 103' catwalk, a 4'X 16' ramp and 6'X 20' float in a 'T
formation to be secured by (2) 8" piles.
