Permit #5924 to replace the existing 110' bulkhead in-place and place 20 cy. of fill
material behind bulkhead as backfill, and as depicted on the plan dated October 10,
2004.

Dear Mr. Radovich:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 26, 2004 regarding the above matter:
WHEREAS, MIRO RADOVICH applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated April 26, 2004, and,
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 26, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of MIRa RADOVICH to
replace the existing bulkhead within 18" using vinyl sheathing, with the condition that
during construction, the pilings are removed, the sheathing and the whalers are
installed, and the pilings are re-installed, and all as depicted on the plan prepared by
Miro Radovich dated June 28, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification. .
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the South old Town Conservation Advisory Council held Tuesday, May
11, 2004, the following recommendation was made:
Moved by William Cook, seconded by Don Wilder, it was
RESOLVED to recommend to the South old Town Board of Trustees APPROVAL of the
Wetland Permit application of MIRO RADOVICH to replace the existing bulkhead within
18" using vinyl sheathing and pilings of CCA material.
Located: 400 Budd's Pond Rd., Southold. SCTM#56-5-18
The CAC questions the street drain going through the bulkhead.

MIRO RADOVICH requests an Amendment to Permit #5924 to replace the existing 110'
bulkhead in-place and place 20 cy. of fill material behind bulkhead as backfill. Located: 400
Budd's Pond Rd., Southold. SCTM#56-5-18
The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to
LWRP review pursuant to Chapter 95 of the Town of South old Town Code. This review will
address the backfilling of the bulkhead with 20 c. y. of clean fill.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally, CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management
practice is applied;
1. To further the intent of the L WRP and the policies. assess the proiect area for the
use of a floatin!! turbidity screen silt/boom durin!! re-construction of the structure to
minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

At the request of Mr. Radovich 1 am submitting a copy of the DEe permit and also a
copy of the Trustees permit for replacing and constructing a new bulkhead.
Mr. Radovich told me that he has spoken with you regarding an amendment to the Town
permit in order to have both permits read the same, that the reconstruction ofthe
bulkhead will be do done in place.

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
2. The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas greater than 50 linear feet from the tidal wetland boundary.
3. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than one (1) week shall be
contained by a continuous line of staked hay bales/silt curtain (or other NYSDEC approved method) placed on the
seaward side between the fill and wetland or protected buffer area. Tarps are authorized to supplement these
approved methods.
4. All fill shall consist of "clean" sand, gravel, or soil (not asphalt, f1yash, broken concrete or demolition debris).
5. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
6. Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be
excavated landward of the bulkhead and retained so as not to enter the waterway, tidal wetland or protected buffer
area.
7. There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization
structure or into any tidal wetland or adjacent area.
8. Bulkhead must be installed in same location as pre-existing bulkhead.

Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the
State of New York, its representatives, employees, and agents ("DEC") for all claims, suits, actions, and damages, to the
extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in
connection with, or operation and maintenance of, the facility or facilities authorized by the permit whether in compliance
or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims,
suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any
claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice Laws and Rules or
any citizen suit or civil rights provision under federal or state laws. .
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subjeclto the same sanctions for violations of the Environmental
Conservation law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may
be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights
of others in order to perform the permitted work nor does it authorize the impairment of any rights, titte, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Deparbnent
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by
an authorized representative of the Department of Environmental Conservation (the Department) to determine whether
the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant
to ECl 71-0301 and SAPA401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the permit
area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection
by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit

Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any

The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous
Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:
NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg #40, Stony Brook NY 11790-2356
General Condition 4: Permit Modifications, Suspensions and Revocations by the Deparbnent
The Department reserves the righlto modify, suspend or revoke this permit in accordance with 6 NYCRR Part 621. The grounds
for modification, suspension or revocation include:
a) materially false or inaccurate statements in the permit application or supporting papers;
b) failure by the permittee to comply with any terms or conditions of the permit:
c) exceeding the scope of the project as described in the permit application;
d) newly discovered material information or a material change in environmental conditions, relevant technology or applicable
law or regulations since the issuance of the existing permit;
e) noncompliance with previously issued permit conditions, orders of the commissioner, any provisions ofthe Environmental
Conservation Law or regulations of the Department related to the permitted activity.
