RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5097 to remove and replace (inkind/inplace) approx. 101 linear ft. of existing timber retaining
wall, 4'X 5' and 4'X 8' decks, and (2) 3'X 6' stairs; and construct 4'X 34' addition to existing
porch, and remove and relocate 4'X 8' stairs.

At the meeting of the Southold Town Conservation Advisory Council held Thursday,
December 12, 2002, the following recommendation was made:
WILBUR OSLER to Amend Permit #5097 to remove and replace (inkind/inplace)
approx. 101 linear ft. of existing timber retaining wall, 4'X 5' and 4'X 8' decks, and (2)
3'X 6' stairs; and construct 4'X 34' addition to existing porch, and remove and relocate
4'X 8' stairs.

Dear Mr. Herrmann:
The following action was taken by the Board of Town Trustees during its Regular
Meeting held on Wednesday, December 15, 1999 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of WILBUR OSLER applied to the Southold
Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
South old, application dated November 26, 1999, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 15, 1999, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS. the Board has determined that the project as proposed will not affect the
health, safety, and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of WILBUR OSLER
to replace (within 18") +/-66' section of existing timber bulkhead with vinyl bulkhead
and remove and replace (inplace) +/-36' section of existing timber bulkhead with vinyl
bulkhead, and backfill with approx. 50 cy. of clean sand to be trucked in from an
upland source.
BE IT FURTHER RESOLVED, that this determination should not be considered a
determination made for any other department or agency which may also have an
application pending for the same or similar project.
Permit to construct and complete project will expire two vears from the date it is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified upon completion of said
project.

Dear Mr. Osler:
On December 7, 1999, the New York District Corps of
Engineers received a request for Department of the Army
authorization to replace a 66 linear foot section of timber
bulkhead within 18 inches using a vinyl bulkhead, replace a 36
foot section similarly in-place and place approximately 50 cubic
yards of clean backfill to be trucked in from an upland location.
The site is in Great Peconic Bay located in Laurel, Town of
Southold, Suffolk County, New York.
Based on information submitted to this office, our review of
the project indicates that an individual permit is not required.
It appears that the activities within the jurisdiction of this
office could be accomplished under Department of the Army
Nationwide General Permit Number 3. The nationwide permits are
prescribed in the December 13, 1996 Federal Register, Final
Notice of Issuance, Reissuance, and Modification of Nationwide
Permits (61 FR 65874). The work may be performed without further
authorization from this office provided the activity complies
with the permit conditions listed in Section B, No.3, Section C,
and any applicable regional conditions added by the State of New
York, copies enclosed.
This determination covers only the work described in the
submitted material. Any major changes in the project may require
additional authorizations from the New York District.
Care should be taken so that construction materials,
including debris, do not enter any waterway to become drift or
pollution hazards. You are to contact the appropriate state and
local government officials to ensure that the subject work is
performed in compliance with their requirements.
This verification is valid for a period of two years from
the date of this letter, unless the nationwide permit is
modified, suspended or revoked. This verification will remain
valid for two years from the date of this letter if the activity
complies with the terms of any subsequent modifications of the
nationwide permit authorization. If the nationwide permits are
suspended, revoked, or modified in such a way that the activity
.

would no longer comply with the terms and conditions of a
nationwide permit, and the proposed activity has commenced, or is
under contract to commence, the permittee shall have 12 months
from the date of such action to complete the activity.
Within 30 days of the completion of the activity authorized
by this permit and any mitigation required by this permit, you
are to sign and submit the attached compliance certification form
to this office.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for ali claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with the
terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns 01 their
responsibility to comply with this permit, including ali special conditions while acting as the permittee's agent with respect
to the pemnitted activities, and such persons shali be subject to the same sanctions for violations of the Environmental
Conservation law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-ol-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the pemnittee any right to trespass upon the iands or interfere with the riparian rights
of others in order to perform the permitted work nor does it authorize the impairment of any rights, titie, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECl 71-0301 and SAPA 401 (3).
The permittee shali provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy of this permit, including ali referenced maps, drawings and special conditions, must be available for
inspection by the Department at ali times at the project site or facility. Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination,
General Condition 3: Applications for Permit Rllnewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Poliutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Poliution Control (APC) and Solid Waste
Management Facilities (SWMF); and
b) 30 days before expiration of ali other permit types.
Submission of applications for permit renewal or modification are to be submitted to:
NYSDEC Regional Permit Administrator, Region 1 , SUNY Bldg #40, Stony Brook, NY 11790-2356
General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension or revocation include:
a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions
of the ECl and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materialiy
changed since the permit was issued,

(TIDAL WETLANDS)
1. If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage. .
3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent
or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services
or local government which may be required.
4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other enVIronmentally
deleterious materials associated with the project
5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks ofa waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.
7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed. the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
8. If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met

portion of the enclosed notification form certifying thal'lhey are fully aware of and understand all terms and
conditions of this permit Within 30 days of completion of project, the bottom portion of the form must also be

10. All activities authorized by this permit must be,in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application,

SPECIAL CONDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected
buffer areas.
2. All fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris).
3. All fill must be graded to match the elevation of the land immediately adjacent to the bulkhead.
4. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
5. The new bulkhead shall be cOAstructed within a maximum of 18" seaward of the structure, measured from face of
old sheathing to face of new sheathing (as shown on the approved x-section).
6. Bulkhead constructed directly adjacent to vegetated tidal wetlands shall be jetted in with no disturbance to the tidal
wetland. Trenching is strictly prohibited.
7. All repairs to existing structures shall be confined to replacement of existing elements with no change in design,
dimension, or materials, unless specifically authorized herein.

of Environmental Conservation as of Dec. 6 per, John Wieland)
Dear Mr. Krupski:
I am writing in response to the notification from EN Consultants, Inc. advising me of the plan
to build a bulkhead on the Osler property on the Great Peconic Bay, which is adjacent to and
west of my property.
I am extremely concemed that if the new Osler bulkhead is built as much as 18 inches farther
out past the original bulkhead as the plans now indicate, it will cause an eddy where it meets
my bulkhead resulting in an erosion of sand and a weakening of the west comer of my
bulkhead. Pilings installed in that comer as had been suggested will not prevent sand
erosion and the necessary attachments will also weaken my new bulkhead.
I suggest that the Osler bulkhead be built in line with mine - as I had mine built in line with my
neighbors when it was built three years ago. That would mean removing the old bulkhead,
or at the very minimum, cutting it down as far as possible to allow proper alignment of the
new bulkhead with my bulkhead.
The plan now indicates that the original bulkhead from the middle of the Osler property to the
west is going to be removed. Why can't the original Osler bulkhead to the east, abutting my
property, be removed so that the new bulkhead does not extend beyond mine?
In summary, my main concern is that this new construction does not result in the shortening
of the life of my recently built bulkhead. I look forward to hearing your response. Thank you.
