THIS INDENTURE made the ~\~ day of Ootober, Nineteen

BETWEEN ALFRED N. LUCE, residing at Orient, Town of Southold,
County of Suffolk and State of New York, party of the first part,
and N. ALFRED LUCE, residing at Orient, Town of South01d, County

t WHEREAS Russel Tabor and May Tabor, by indenture or mortgage

bearing date the 28th day of January 1928, and reoorded in the

offioe of the Clerk of the County of Suffolk, in Liber 745 of
mortgages at page 594 on the 28th day of August 1929 for the
i oonsideration therein mentioned and to seoure the payment of the
I money therein speoified, did oonvey oertain lands and tenements

I of whioh the lands thereinafter desoribed are part, unto The

f Peoples National Bank of Greenport, New York, whioh said mortgage
r was assigned by The Peoples National Bank of Greenport, New York,

I to Alfred N. Luoe, by assignment dated September 1st 1936, reoord-
ed in Suffolk County Clerk's offioe in Liber 997 of mortgages at
\ page 543 on September 2nd 1936.
AND WHEREAS the party of the first part, at the request of

the party of the seoond part, has agreed to give up and surrender
the lands hereinafter desoribed unto the party of the seoond part
and to hold and retain the residue of the mortgaged lands as
seourity for the money remaining due on said mortgage,
NOW THIS INDENTURE WITNESSETH, tht,t the party of the first
part, in pursuanoe of said agreement and in oonsideration of the
sum of One and OO/lOoths '#1.00) dollars, lawful money of the
United States, paid by the party of the seoond part, does grant,
release and quitolaim unto the party of the seoond part for the
purpose of a highway, all that part of said mortgaged lands des-
oribed as follows:-

of New York, lying between the lines hereinafter desoribed, th
westerly line begins at a point on the northerly line of

State Street at the southeasterly corner of land of
Mrs. E. W. Webb, formerly of Eugene Conklin; running
I thence along the easterly line of said land of Webb

I and continuing on the same course along the easterly

, line of land of George H. Cibell and thence through
other land of said N. Alfred Luce, N. 280 13' E.-1032
feet, more or less, to the southerly line of Main or
State Road. The easterly line of said proposed highwa,
being 49.5 feet easterly from said westerly line above
i described, measured at right angles thereto.
TOGETHER with the hereditaments and appurtenances thereunto
belonging and all the right, title and interest of the party of
the first part of, in and to the same, to the intent that the
lands hereby conveyed may be discharged from said mortgage and
that the rest of the land in said mortgage specified may remain
to the party of the first part as heretofore.
TO HAVE AND TO HOLD the lands and premises hereby released

and assigns, to their own proper use, benefit and behoof, forever
free, clear and discharged of and from all lien and claim under
