Dear Ms. Moore:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, February 12, 2007:
WHEREAS, this proposed subdivision is for 4 lots on 40.56 acres where Lot 1 equals
99,316 sq. ft.; Lot 2 equals 103,823 sq. ft.; Lot 3 equals 80,000 sq. ft. and Lot 4 equals
34.06 acres upon which the Development Rights on 33.16 acres have been sold; and
WHEREAS, on August 22, 2005, the Southold Town Planning Board granted final
approval upon the plat prepared by John T. Metzger, L.S. dated July 23, 2000 and last
revised on April 16, 2005 and authorized the Chairperson to endorse the maps; and
WHEREAS, by letter dated January 31, 2007, the agent for the applicant informed the
Planning Board that the approved map was not filed within the required timeframe
because the County Clerk would not accept the maps until the tax bill was paid in full;
and
WHEREAS, the Planning Board discussed this matter at their work session on February
5, 2007 and agreed that they would re-issue the final approval and re-endorse the maps
because there are no changes from the original approval; be it therefore
RESOLVED, the Southold Town Planning Board hereby re-issues final approval upon
the plat prepared by John T. Metzger, L.S. dated July 23, 2000 and last revised on April
16, 2005 and authorizes the Chairperson to endorse the maps.

Upon endorsement by the Chairperson, the mylars and paper prints must be picked up
at this office and filed in the Office of the Suffolk County Clerk. Any plat not so filed or

DECLARATION OF COVENANTS AND RESTRICTIONS
THIS DECLARATION made by Doroski Family Limited Partnership LLC.
doing business at 38400 County Road 48, Southold, New York this 21 day
of June, 2005, hereinafter referred to as the DECLARANT, as the owner
of premises described in Schedule "A" annexed hereto (hereinafter
referred to as the PREMISES) desires to restrict the use and enjoyment
of said PREMISES and has for such purposes determined to impose on
said PREMISES covenants and restrictions and does hereby declare that
said PREMISES shall be held and shall be conveyed subject to the
following covenants and restrictions:
1 . DECLARANT has made application to the SOUTHOLD TOWN PLANNING
BOARD (hereinafter referred to as the PLANNING BOARD) for
approval of a conservation subdivision on the PREMISES. These
Covenants to not apply to lot 4 (33 . 16 acres) which Town of
Southold has purchased Development Rights .
2 . This subdivision and the owner of each lot shall comply with
the New York State Pollution Discharge Elimination System
(SPEDES) requirements . The SPEDES permit requires, at a
minimum, that an erosion and sediment control plan be prepared
for any construction activity that disturbs one or more acres.
The Storm-water Pollution Control Plan requires erosion
control planning, site management and sediment control by all
landowners . Prior to any construction activity (GP-02-01)
administered by the New York State Department of Environmental
Conservation (DEC) under the Phase II State Pollution
Discharge Elimination System (SPEDES) Program.
3 . As a condition of approval by the PLANNING BOARD of the
subdivision or development application, the DECLARANT
covenants that a 50 foot Natural & Undisturbed Vegetative
Retention Buffer runs along lot 1, lot 2 , and lot 5 which is
depicted on the subdivision plat. It is hereby understood
that the Natural & Undisturbed Vegetative Retention Buffer is
intended to preserve the existing trees and natural growth and
provide a natural habitat. No Clearing is permitted in the
Natural & Undisturbed Vegetation Buffer, except ordinary and
proper maintenance and removal of diseased, decayed or dead
vegetation, and obnoxious plant, provided that the area in
which maintenance activity is conducted will be re-vegetated
in accordance with an approved plan by the Southold Town
Planning Board with species native to the State of New York.
Notwithstanding the above, the Natural & Undisturbed
Vegetative Retention Buffer may be supplemented with
additional native vegetation.
4 . As a condition of approval by the PLANNING BOARD of the
conservation subdivision, the DECLARANT covenants that
on lots 1 through 3 clearing shall be limited to the
following: lot one is limited to 35% of the total lot
size; lot two is limited to 25% of the total lot size;
lot 3 is limited to 25% of the total lot size .
5 . The location of the clearing shall be at the discretion
of the owner as long as the aggregate land area cleared
does not exceed the limit of clearing. The limitation on
clearing and cutting shall not prohibit the proper
landscaping and maintenance of the vegetation, including
but not limited to removal of diseased, decayed or dead
material and obnoxious plant species . Specifically
permitted throughout the entire property is the planting
of additional native plants, or replacing trees and other
vegetation with comparable native species .
6 . The lots are located adjacent to an agricultural reserve
and these lots may be subject to the noise and fugitive
dust normally associated with agricultural activities .
Farming practices and activities are protected pursuant
to Article XXII, Farmland Bill of Rights [Added 5-27-1997
by L.L. No 11-1997] Section 100-220 . Right to Farm of
the Town of Southold Town Code.
7 . No new residential structure (exclusive of driveway and
dry wells) or sanitary disposal facility shall be
constructed or otherwise located less than 100 feet from
the most landward limit of freshwater wetland.
8 . No stormwater runoff resulting from development and
improvement of the subdivision or any of its lots shall
be discharged into the freshwater wetlands on site.
9 . A conservation or scenic easement having a minimum width
of 75 feet shall be established landward of the edge of
freshwater wetland vegetation. Such clearing and cutting
within the 75 feet shall be subject to review by the Town
of Southold to insure proper maintenance and preservation
of the natural buffer.
10 . All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall
be retianed on the site by adequate drainage structures
so that it will not flow out onto the right-of-way of CR
48 .
11 . All of the covenants and restrictions contained herein
shall be construed to be in addition to and not in
derogation or limitation upon any provisions of local,
state, and federal laws, ordinances, and/or regulations
in effect at the time of execution of this agreement, or
at the time such laws, ordinances, and/or regulations may
thereafter be revised, amended, or promulgated.
12 . The aforementioned Restrictive Covenants shall be
enforceable by the Town of Southold, State of New York,
by injunctive relief or my any other remedy in equity or
at law. The failure of said agencies or the Town of
Southold to enforce the same shall not be deemed to
affect the validity of this covenant nor to impose any
liability whatsoever upon the Town of Southold or any
officer or employee thereof .
9 . These covenants and restrictions shall run with the land
and shall be binding upon the DECLARANT, its successors
and assigns, and upon all persons or entities claiming
under them, and may be terminated, revoked or amended
only with the written consent of the PLANNING BOARD.
10 . If any section, subsection, paragraph, clause, phrase or
provision of these covenants and restrictions shall, by a
Court of competent jurisdiction, be adjudged illegal,
unlawful, invalid, or be held to unconstitutional, the
same shall not affect the validity of these covenants as
a whole, or any other part or provision hereof other than
the part so adjudged to be illegal, unlawful, invalid, or
unconstitutional .

Dear Mr. Treiber:
The Land Preservation Committee members, in accordance with Section
25-50 C. (2) [3] of the Town Code, reviewed your request for the installation of
deer fencing and gates at its meeting held on September 2, 2014.
The recorded easement for this property allows land within the easement
to be used for the purpose of agricultural production. Section 25-50-C. (2) [3]
requires that the Committee serve as a review board for the granting of permits
for the construction, reconstruction and additions of and to structures in or on
agricultural lands in which the development rights have been acquired by the
Town.
The Committee is approving your request, as listed and clarified below, to
be allowed within the development rights easement area. The Committee's
approval does not mean that you can proceed with the installation. Such
improvements are subject to all applicable Town Code requirements.
• Deer fencing and gates installed in vicinity of lines as sketched upon
survey dated April 22, 2014 of the subject property (see attachment)
Please note that the Committee's approval of this installation within the
easement does not mean that such fencing will be approved or permitted by
other Town departments or agencies. The Committee's approval allows you to
proceed with pursuing any applicable approvals that are required by Town Code.

Dear Ms Woodhouse:
We respectfully request that you adopt a resolution at the next Planning Board meeting
renewing the approval of the above referenced maps which received final map approval on August
8, 2005. The development rights were sold and the subdivision remains unchanged.
In accordance with standard map filing procedures,the signed maps were forwarded to the
title company for filing with the Suffolk County Clerk,however, a title problem was discovered in
the chain of title and the title company was unable to file the map within 62 days. The Suffolk
County Clerk can not file the maps without an updated approval from the Health Department and
Planning Board.
The original signed maps have been returned to the Health Department for renewal of the
approval and as soon as we receive the re-dated maps from the Health Department I will return them
to your office so Ms. Woodhouse can resign the maps with the new date.
I thank you for your courtesies and I apologize for the inconvenience.If you wish to discuss

With reference to the above and pursuant to the conversation had with Anthony, enclosed
please find the above maps which we were unable to file with the County Clerk.
The maps were presented to the Clerk for recording in December, however, the Clerk was
not accepting maps for recording until the tax bills were mailed out and receipt of the taxes being
paid in full was received. Unfortunately, by the time we received the tax bill receipt, we were just
days past the 62 day requirement for filing.
Would you please review and advise how we can best resolve this issue.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, October 16, 2006:
WHEREAS, this proposed subdivision is for 4 lots on 40.56 acres where Lot 1 equals
99,316 sq. ft.; Lot 2 equals 103,823 sq. ft.; Lot 3 equals 80,000 sq. ft. and Lot 4 equals
34.06 acres upon which the Development Rights on 33.16 acres have been sold; and
WHEREAS, on August 22, 2005, the Southold Town Planning Board granted final
approval upon the plat prepared by John T. Metzger, L.S. dated July 23, 2000 and last
revised on April 16, 2005 and authorized the Chairperson to endorse the maps; and
WHEREAS, by letter dated October 6, 2006, the agent for the applicant informed the
Planning Board that the approved map, which was to be filed with the Office of the
County Clerk within 62 days of the final approval, was not filed due a problem with the
title company; and
WHEREAS, the agent for the applicant also indicated that the Health Department
approval expired as a result of the time lapse and therefore the maps need to be re-
stamped by the Health Department in order to file the maps in the Office of the County
Clerk; and
WHEREAS, the Planning Board discussed this matter at their work session on October
10, 2006 and agreed that they would re-issue the final approval and re-endorse the
maps because there are no changes from the original approval; be it therefore

RESOLVED, the Southold Town Planning Board hereby re-issues final approval upon
the plat prepared by John T. Metzger, L.S. dated July 23, 2000 and last revised on April
16, 2005 and authorizes the Chairperson to endorse the maps.
Upon endorsement by the Chairperson, the mylars and paper prints must be picked up
at this office and filed in the Office of the Suffolk County Clerk. Any plat not so filed or
recorded within sixty-two (62) days of the date of map signing shall become null and
void.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a projec
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determin:
significance may have little or no formal knowledge of the environment or may be technically expert in environmenta
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affectin,
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project

The sketch plan was referred to the Southold Fire District by the Planning Board,the
Fire District had determined that a fire well was not required and the Board accepted the
findings on April 15, 2003. There has been no substantial change between the sketch and
final map approval. Therefore, this issue should not delay our final map approval.
In accordance with our telephone conversation,the NYSDEC Freshwater Regulations
(Article 24) do not apply to subdivision of land. The driveways are already improved and
the building envelopes are more than 100 feet from the wetlands. Please proceed with final
map approval.

SOUTHOLD TOWN PLANNING BOARD
DECLARATION OF COVENANTS AND RESTRICTIONS
THIS DECLARATION made by Doroski Family Limited Partnership LLC.
doing business at 38400 County Road 48, Southold, New York this 21 day
of June, 2005, hereinafter referred to as the DECLARANT, as the owner
of premises described in Schedule "A" annexed hereto (hereinafter
referred to as the PREMISES) desires to restrict the use and enjoyment
of said PREMISES and has for such purposes determined to impose on
said PREMISES covenants and restrictions and does hereby declare that
said PREMISES shall be held and shall be conveyed subject to the
following covenants and restrictions:
1 . DECLARANT has made application to the SOUTHOLD TOWN PLANNING
BOARD (hereinafter referred to as the PLANNING BOARD) for
approval of a conservation subdivision on the PREMISES. These
Covenants to not apply to lot 4 (33 . 16 acres) which Town of
Southold has purchased Development Rights.
2 . This subdivision and the owner of each lot shall comply with
the New York State Pollution Discharge Elimination System
(SPEDES) requirements. The SPEDES permit requires, at a
minimum, that an erosion and sediment control plan be prepared
for any construction activity that disturbs one or more acres .
The Storm-water Pollution Control Plan requires erosion
control planning, site management and sediment control by all
landowners. Prior to any construction activity (GP-02-01)
administered by the New York State Department of Environmental
Conservation (DEC) under the Phase II State Pollution
Discharge Elimination System (SPEDES) Program.
3 . As a condition of approval by the PLANNING BOARD of the
subdivision or development application, the DECLARANT
covenants that a 50 foot Natural & Undisturbed Vegetative
Retention Buffer runs along lot 1, lot 2, and lot 5 which is
depicted on the subdivision plat. It is hereby understood
that the Natural & Undisturbed Vegetative Retention Buffer is
intended to preserve the existing trees and natural growth and
provide a natural habitat. No Clearing is permitted in the
Natural & Undisturbed Vegetation Buffer, except ordinary and
proper maintenance and removal of diseased, decayed or dead
vegetation, and obnoxious plant, provided that the area in
which maintenance activity is conducted will be re-vegetated
in accordance with an approved plan by the Southold Town
Planning Board with species native to the State of New York.
Notwithstanding the above, the Natural & Undisturbed
Vegetative Retention Buffer may be supplemented with
additional native vegetation.
4. As a condition of approval by the PLANNING BOARD of the
conservation subdivision, the DECLARANT covenants that
on lots 1 through 3 clearing shall be limited to the
following schedule: lot size 60, 001 sq. ft. To 90, 000
sq. ft . Clearing up to 35% of the total lot size; 90, 001
sq. ft . to 140, 000 sq. ft . Clearing up to 25% of the total
lot size.
5 . The location of the clearing shall be at the discretion
of the owner as long as the aggregate land area cleared
does not exceed the limit of clearing. The limitation on
clearing and cutting shall not prohibit the proper
landscaping and maintenance of the vegetation, including
but not limited to removal of diseased, decayed or dead
material and obnoxious plant species . Specifically
permitted throughout the entire property is the planting
of additional native plants, or replacing trees and other
vegetation with comparable native species .
6 . The lots are located adjacent to an agricultural reserve
and these lots may be subject to the noise and fugitive
dust normally associated with agricultural activities .
Farming practices and activities are protected pursuant
to Article XXII, Farmland Bill of Rights [Added 5-27-1997
by L.L. No. 11-19971 Section 100-220 . Right to Farm of
the Town of Southold Town Code.
7 . No new residential structure (exclusive of driveway and
dry wells) or sanitary disposal facility shall be
constructed or otherwise located less than 100 feet from
the most landward limit of freshwater wetland.
8 . No stormwater runoff resulting from development and
improvement of the subdivision or any of its lots shall
be discharged into the freshwater wetlands on site.
9 . A conservation or scenic easement having a minimum width
of 75 feet shall be established landward of the edge of
freshwater wetland vegetation. Such clearing and cutting
within the 75 feet shall be subject to review by the Town
of Southold to insure proper maintenance and preservation
of the natural buffer.
10 . All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall
be retianed on the site by adequate drainage structures
so that it will not flow out onto the right-of-way of CR
48 .
11 . All of the covenants and restrictions contained herein
shall be construed to be in addition to and not in
derogation or limitation upon any provisions of local,
state, and federal laws, ordinances, and/or regulations
in effect at the time of execution of this agreement, or
at the time such laws, ordinances, and/or regulations may
thereafter be revised, amended, or promulgated.
12 . The aforementioned Restrictive Covenants shall be
enforceable by the Town of Southold, State of New York,
by injunctive relief or my any other remedy in equity or
at law. The failure of said agencies or the Town of
Southold to enforce the same shall not be deemed to
affect the validity of this covenant nor to impose any
liability whatsoever upon the Town of Southold or any
officer or employee thereof .
9 . These covenants and restrictions shall run with the land
and shall be binding upon the DECLARANT, its successors
and assigns, and upon all persons or entities claiming
under them, and may be terminated, revoked or amended
only with the written consent of the PLANNING BOARD.
10 . If any section, subsection, paragraph, clause, phrase or
provision of these covenants and restrictions shall, by a
Court of competent jurisdiction, be adjudged illegal,
unlawful, invalid, or be held to unconstitutional, the
same shall not affect the validity of these covenants as
a whole, or any other part or provision hereof other than
the part so adjudged to be illegal, unlawful, invalid, or
unconstitutional.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, June 13, 2005:
WHEREAS, this proposal is to subdivide a 40.56-acre parcel into four lots where Lot 1
equals 99,316 sq. ft., Lot 2 equals 103,823 sq. ft., Lot 3 equals 80,000 sq. ft. and Lot 4
equals 34.06 acres upon which the Development Rights on 33.16 acres have been sold
to the Town of Southold; and
WHEREAS, the Southold Town Planning Board hereby granted an extension of time for
conditional sketch approval until October 15, 2005; and
WHEREAS, the Board of Trustees issued a permit (Number 5972) for the action on
August 18, 2004; and
WHEREAS, the Planning Board is in receipt of the response from the County of Suffolk
Department of Planning, dated June 4, 2003; and
WHEREAS, Conditions 2, 3, 4, 5, 6 and 8 must be included within Draft Covenants and
Restrictions to be submitted to this office; therefore, be it
RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the plat, dated as revised April 16, 2005, subject to the following conditions. The
conditions must be met within six (6) months of the resolution:
1. Submit a Letter of Water Availability from the Suffolk County Water Authority.

5. Include the following clause in the Draft Covenants and Restrictions:

WHEREAS, this proposed subdivision is for 4 lots on 40.56 acres located south of
Sound View Avenue, + 170'west of Hope Lane, Southold where Lot 1 equals 99,316 sq.
ft.; Lot 2 equals 103,823 sq. ft.; Lot 3 equals 80,000 sq. ft. and Lot 4 34.06 acres; and
WHEREAS, the Town of Southold has purchased Development Rights on 33.16 acres of
Lot 4; and
WHEREAS, the Doroski Family Limited Partnership ('applicant") has made application
for a minor subdivision of land relating to SCTM#1000-69-01-09 (the "subject parcel");
and
WHEREAS, the applicant has recently sold the development rights to 33.16 acres of
land adjacent to the proposed subdivision, and the sale of such development rights was
made with the expectation that the applicant would later be permitted to realize a yield of
three (3) building lots on the subject parcel; and
WHEREAS, since the time of the applicant's sale of the development rights, the known
condition of the land in the subject parcel has changed, such that more of the subject
parcel is covered by wetlands, etc. than previously known; and
WHEREAS, pursuant to its statutory authority, the Planning Board follows a strict policy
and practice of requiring applicants to exclude lands defined as unbuildable lands when
determining lot yield of a parcel.
IT IS HEREBY RESOLVED THAT:

1. Strict compliance with the Planning Board's regulations, policy and
practice would result in a limitation of the applicant's yield to two (2) lots.
2. Pursuant to Town Code §A106-50, strict compliance with such
regulations, policy and practice would subject the applicant to
extraordinary hardship.
3. The extraordinary hardship to be suffered by applicant is established,
insofar as:
(a) The applicant has made a succession of past decisions including the
sale of development rights upon +33.16 acres based upon an
expected three lot yield.
(b) The area of wetlands on the property was underestimated.
Correspondingly, site hydrology was altered post the development
right sale due to the construction of a right-of-way on neighboring
property to the west of the property line. The construction of the
right of way affected the hydroperiod on-site.
4. Finding sufficient cause related to the specific,ind extraordinary
circumstances of this application, the Planninrf Board determines
pursuant to Town Code §A106-50 that stria compliance with the
subdivision regulations, policy and practice is hereby varied for this
application only, to the limited extent that applicant is hereby permitted by
the Planning Board to realize a yield of three (3) building lots on the
subject parcel.
5. Applicant must satisfy all other regulations, policies and procedures in
\effect with respect to this application, including, without limitation, all
other requirements of the Town Code and other local, county and state
agencies.

Dear Ms Woodhouse:
I have been retained by the Doroski Family Limited Partnership with regard
to their subdivision application. The Doroski family sold the development rights and
reserved a parcel for development of three lots, each lot exceeding two acres in size.
The subdivision had been designed with identified wetlands in 2002. However, the
adjacent developer re-graded their property and water runoff was diverted onto the
Doroski property causing an increase in the area of wetlands in 2004. After re-
flagging of the property, the Planning Board deducted the wetlands from the lot area
and determined that the owner would need to seek a ZBA variance in order to obtain
the 3 lots previously planned.
After review of the map by the building department,they question the need for
a variance where the parcel exceeds the minimum lot size and can meet all of the
regulatory setbacks of other agencies. I concur with the building department that the
lots meet the zoning ordinance, therefore no variances should be required. The
subdivision regulations do not prohibit the creation of a lot with wetlands and the
wetlands are not deducted from the lot area determination.
The zoning code of this town defines "lot" as "any parcel of land...", and "lot
area" as " the area of a lot taken at its perimeter, exclusive of any portion within a
public or private street right-of-way". In application of the subdivision regulations
" buildable land" is not the same as a "lot". The "lot' must be in compliance with
zoning, a lot of 40,000 or 80,000 square feet is in compliance which the applicable
zoning designation. The only deduction authorized in the zoning code is 100-239,
lands under water are not used toward lot size. Nevertheless, there is no
requirement in the zoning code or the subdivision regulations that 100% of a lot be
"buildable land".
Specifically, at Code Section A106-35A,the code requires lots to be designed
to "avoid foreseeable difficulties"by making sure the lots are arranged so that they
can be built on, and A106-38 requires the Planning Board consider the natural
features in the design of a lot to "encourage preservation of natural features". Lots
on the Sound and Bay may contain slopes and wetlands in the lot area calculation
provided that a reasonable sized building envelope is established.
In conclusion, please be advised that the Planning Board is not authorized to
deduct wetlands, slopes, easements, etc. from lot yield.

The subject parcel contains fresh water wetlands at the north end of the site along Sound View
Avenue. These wetlands are not mapped by the U.S.Fish and Wild life Service or the N.Y.S.D.E.C.
Commission staff site inspections, however, reveal pockets of wetlands along the road frontage
characterized by extensive stands of maple, highbush blueberry and swamp azalea. While the
submitted map indicates wetlands delineated by Suffolk Environmental Consulting Inc. (10/29/02),
t` staff in the field located few flags and the wetlands appear to be more extensive in actuality than
indicated on the submitted map. Moreover,the wetlands were flagged in October and it may have
been problematic to identify indicator plant species.
The most landward limit of freshwater wetland shall be re-flagged in the field by a qualified expert,
verified by the appropriate regulatory agency and shown on all future surveys, maps, plans, plats or
sketches.

less than 100 feet from the most landward limit of freshwater wetland.

The applicant proposes to subdivide 40.56 acres into 4 lots, where Lot 1 equals 99,316
sq. ft.; Lot 2 equals 103,823 sq. ft.; Lot 3 equals 80,000 sq. ft. and Lot 4 equals 34.06
acres. The Town of Southold has purchased Development Rights on Lot 4.
A freshwater wetland is located on-site. All proposed development is outside of the
required 100' buffer. Consequently, the action is outside of the New York State
Department of Environmental Protection and the Town of Southold Town Trustees
jurisdictions.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed. Jurisdictional
freshwater wetlands exist on site. However, all proposed development is proposed
outside of the 100' required buffer from the wetland.
The determination was based upon the following:
No substantial adverse change in existing air quality, ground
or surface water quality or quantity, traffic or noise levels; a
substantial increase in solid waste production; a substantial
increase in potential for erosion, flooding, leaching or
drainage problems are expected to occur if the propose
action is implemented as planned. Note, however that the
area soils are predominately composed of clay and some
minor drainage problems are expected to occur. In addition,
the Department of Health approval has not been issued,
therefore, the feasibility of a septic system and associated
impacts (if any) have cannot been fully evaluated.
The applicant has stated in the EAF that 0 acres of
vegetation will be removed from site. This is incorrect; three
homes and associated driveways will be developed and
clearing will occur. The Town of Southold Planning Board
has advised the applicant to retain the large trees on site,
vegetation on slopes greater than 15% and vegetated
buffers along Sound View Avenue. Although clearing will
take place no significant removal or destruction of large
quantities of vegetation or fauna is expected to occur. No
substantial interference with the movement of any resident
or migratory fish or wildlife species; impacts on a significant
habitat area; substantial adverse impacts on a threatened or
endangered species of animal or plant, or the habitat of such
a species; or other significant adverse impacts to natural
resources will occur.
The project is not located adjacent to a Critical
Environmental Area as designated pursuant to subdivision
617.14(g).
The proposed action will not result in the loss of agricultural
lands are a significant area of open space. The proposed
action is not in a significant material conflict with a
community's current plans or goals as officially approved or
adopted.
The proposed action is not expected to impair the character
or quality of any known important historical, archaeological,

occur should the project be implemented as planned.

The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, April 14, 2003:
WHEREAS, this proposed subdivision is for 4 lots on 40.56 acres located south of
Sound View Avenue, ± 170' west of Hope Lane, Southold where Lot 1 equals 99,316
sq. ft.; Lot 2 equals 103,823 sq. ft.; Lot 3 equals 80,000 sq. ft. and Lot 4 34.06 acres;
and
WHEREAS, the Town of Southold has purchased Development Rights on 33.16 acres
of Lot 4; and
WHEREAS, the Southold Town Planning Board, pursuant to Part 617, Article 6 of the
Environmental Conservation Law acting under the State Environmental Quality Review
Act, initiated the SEQR coordination process for this Unlisted Action; and
WHEREAS, the Southold Fire District is not requiring a firewell for the action; and
WHEREAS, the Southold Town Board of Trustees issued a letter of non-jurisdiction on
July 22, 2002; and
WHEREAS, due to a discrepancy between two versions of the survey showing
wetlands, the Planning Board required that the wetlands be flagged to better assess any
potential adverse impacts; and

WHEREAS, the wetlands have been flagged, confirmed and surveyed; therefore be it
RESOLVED, that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act established itself as lead agency, and as lead
agency, makes a determination of non-significance and grants a Negative Declaration;
and be it
FURTHER RESOLVED, that the Southold Town Planning Board grant conditional
sketch plan approval on the maps, dated as revised February 6, 2003, subject to the
following condition:
1. Add the term 'blustered" to the plat title.
Sketch plan approval is conditional upon the submission of final maps within six months
of the date of sketch plan approval unless an extension of time is requested by the
applicant and granted by the Planning Board. The final plats, eight (8) paper prints and
three (3) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.
The Planning Board has reviewed the property and has decided that it is inadequate for
a reservation of land for park and playground use. Therefore, a cash payment in lieu of
land reservation will be required. The amount to be deposited with the Town Board
shall be $15,000 ($5,000 per vacant residential lot in the subdivision). Payment is
required prior to the final endorsement of the map.
The sketch plans have been referred to the Suffolk County Planning Commission for
review and comment.
Once we are in receipt of the above requested information, the application will be
scheduled for an upcoming work session.
Enclosed please find a copy of the Negative Declaration for your records.

Please find enclosed 7 copies of the revised site plan. This revision has the 15% slopes noted on the plan
and those areas deducted from the lot sizes.
The proposed home locations as shown on the map were included at the request of the Board. The
houses located on the plan are in no way a final location if the proposed homes. As you can see from the
subdivision map,the homes have great latitude for final placement within the setback lines. During the
Building Permit process the homes will be having there final placement, which will comply with all the
Town's zoning requirements. If showing the location of the homes on the map now causes a problem
with the Planning Board, we will exclude them in final maps.
Mr. Bruce Andersen of Suffolk Environmental Services flagged the wetlands on the property and they
are shown on the enclosed map.
I would hope that the present maps will be sufficient to schedule the public meeting. If you have any

As you are aware, the Planning Board reviewed the above referenced project at the
August 26, 2002 work-session and due to some discrepancies once again at the
September 3, 2002 worksession. The following determinations were made:
1. Due to site topography, expected water runoff and erosion; the site of the
home on Lot I is a concern. The home is sited at the bottom of a 33% slope.
Please identify all slopes greater than 15% in order to determine the amount of
buildable land as defined in the Town of Southold Town Code as:
BUILDABLE LAND -- The net area of a lot or parcel after deducting
wetlands, streams,ponds, slopes over fifteen percent (15%), underwater land,
easements or other restrictions preventing use of such land for construction of
buildings or development
Correspondingly, the Planning Board's environmental consultants could not
adequately assess or verify the wetland areas. Please have the wetland areas
delineated and flagged in order for the consultant to better verify the wetlands
on-site. As you are aware, any action within 100 feet of a wetland would
require a permit from the Town Trustees and the New York State Department
of Environmental Conservation
2. Numerous large trees exist on site. The Planning Board has requested that the
trees and vegetation be retained to the maximum extent possible.

I completed the site inspection of the Dobreski property in Southold (SCTM*1000-69-1-9) this
morning in order to review the submitted subdivision application. As you are aware, the site
contains several areas of freshwater wetlands, one of which is located in the northwest corner of
the site. This feature is depicted on the subdivision plan as extending off site to the west through
an "easement", better identified as SCUM#1000-59-084.1. Recent clearing and grading of tax
lot 4.1 has occurred presumably to allow for road construction and the majority of tax lot 4.2 to
the south has also been cleared and a leaching structure has been installed. Construction of the
din road to the Dobreski's western property boundary has resulted in partial fill of this
freshwater wetland.

The Planning Board has reviewed the above referenced project at the May 6,2002 work-
session. The following outstanding issues and concerns have been identified:
1. The map submitted to the Planning Board dated March 13, 2001 shows two
depressional wetlands on Lot 1. The revised map dated January 2, 2002
excludes the wetlands shown on the previously submitted maps. The 1999,
aerial map shows wetland signatures on the parcel that are not shown on the
map. Please show all wetlands,regardless of size, on the revised maps.
2. Due to site topography, home siting and erosion are a concern. The building
envelopes have been removed from the latest submitted map dated January 2,
2002. Please include building envelopes with all appropriate setbacks to
regulated natural resources (wetlands, slopes) and lot-lines.
3. Please identify proposed access to each lot. Please note that the Planning
Board is not in favor of creating more than one access from Sound View
Avenue to serve the lots.
4. Our Environmental Consultant has informed this department that the price of
all Environmental Reviews conducted in 2002 have increased to $750.00. We
have received a check for$500.00 on January 15, 2002. Please remit the
$250.00 difference at your earliest convenience.
Once we are in receipt of the revised maps, the application will be scheduled for an
