DECLARANT has made application to the SOUTHOLD TOWN PLANNING BOARD (hereinafter referred to as the PLANNING BOARD) for approval of a conservation subdivision on the PREMISES. These Covenants to not apply to lot 4 (33 . 16 acres) which Town of Southold has purchased Development Rights . 2 . This subdivision and the owner of each lot shall comply with the New York State Pollution Discharge Elimination System (SPEDES) requirements . The SPEDES permit requires, at a minimum, that an erosion and sediment control plan be prepared for any construction activity that disturbs one or more acres. The Storm-water Pollution Control Plan requires erosion control planning, site management and sediment control by all landowners . Prior to any construction activity (GP-02-01) administered by the New York State Department of Environmental Conservation (DEC) under the Phase II State Pollution Discharge Elimination System (SPEDES) Program. 3 . As a condition of approval by the PLANNING BOARD of the subdivision or development application, the DECLARANT covenants that a 50 foot Natural & Undisturbed Vegetative Retention Buffer runs along lot 1, lot 2 , and lot 5 which is depicted on the subdivision plat. It is hereby understood that the Natural & Undisturbed Vegetative Retention Buffer is intended to preserve the existing trees and natural growth and provide a natural habitat. No Clearing is permitted in the Natural & Undisturbed Vegetation Buffer, except ordinary and proper maintenance and removal of diseased, decayed or dead vegetation, and obnoxious plant, provided that the area in which maintenance activity is conducted will be re-vegetated in accordance with an approved plan by the Southold Town Planning Board with species native to the State of New York. Notwithstanding the above, the Natural & Undisturbed Vegetative Retention Buffer may be supplemented with additional native vegetation. 4 . As a condition of approval by the PLANNING BOARD of the conservation subdivision, the DECLARANT covenants that on lots 1 through 3 clearing shall be limited to the following: lot one is limited to 35% of the total lot size; lot two is limited to 25% of the total lot size; lot 3 is limited to 25% of the total lot size . 5 . The location of the clearing shall be at the discretion of the owner as long as the aggregate land area cleared does not exceed the limit of clearing. The limitation on clearing and cutting shall not prohibit the proper landscaping and maintenance of the vegetation, including but not limited to removal of diseased, decayed or dead material and obnoxious plant species . Specifically permitted throughout the entire property is the planting of additional native plants, or replacing trees and other vegetation with comparable native species . 6 . The lots are located adjacent to an agricultural reserve and these lots may be subject to the noise and fugitive dust normally associated with agricultural activities . Farming practices and activities are protected pursuant to Article XXII, Farmland Bill of Rights [Added 5-27-1997 by L.L. No 11-1997] Section 100-220 . Right to Farm of the Town of Southold Town Code. 7 . No new residential structure (exclusive of driveway and dry wells) or sanitary disposal facility shall be constructed or otherwise located less than 100 feet from the most landward limit of freshwater wetland. 8 . No stormwater runoff resulting from development and improvement of the subdivision or any of its lots shall be discharged into the freshwater wetlands on site. 9 . A conservation or scenic easement having a minimum width of 75 feet shall be established landward of the edge of freshwater wetland vegetation. Such clearing and cutting within the 75 feet shall be subject to review by the Town of Southold to insure proper maintenance and preservation of the natural buffer. 10 . All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retianed on the site by adequate drainage structures so that it will not flow out onto the right-of-way of CR 48 . 11 . All of the covenants and restrictions contained herein shall be construed to be in addition to and not in derogation or limitation upon any provisions of local, state, and federal laws, ordinances, and/or regulations in effect at the time of execution of this agreement, or at the time such laws, ordinances, and/or regulations may thereafter be revised, amended, or promulgated. 12 . The aforementioned Restrictive Covenants shall be enforceable by the Town of Southold, State of New York, by injunctive relief or my any other remedy in equity or at law. The failure of said agencies or the Town of Southold to enforce the same shall not be deemed to affect the validity of this covenant nor to impose any liability whatsoever upon the Town of Southold or any officer or employee thereof . 9 . These covenants and restrictions shall run with the land and shall be binding upon the DECLARANT, its successors and assigns, and upon all persons or entities claiming under them, and may be terminated, revoked or amended only with the written consent of the PLANNING BOARD. 10 . If any section, subsection, paragraph, clause, phrase or provision of these covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid, or be held to unconstitutional, the same shall not affect the validity of these covenants as a whole, or any other part or provision hereof other than the part so adjudged to be illegal, unlawful, invalid, or unconstitutional . All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retianed on the site by adequate drainage structures so that it will not flow out onto the right-of-way of CR 48 . 11 . All of the covenants and restrictions contained herein shall be construed to be in addition to and not in derogation or limitation upon any provisions of local, state, and federal laws, ordinances, and/or regulations in effect at the time of execution of this agreement, or at the time such laws, ordinances, and/or regulations may thereafter be revised, amended, or promulgated. 12 . The aforementioned Restrictive Covenants shall be enforceable by the Town of Southold, State of New York, by injunctive relief or my any other remedy in equity or at law. The extraordinary hardship to be suffered by applicant is established, insofar as: (a) The applicant has made a succession of past decisions including the sale of development rights upon +33.16 acres based upon an expected three lot yield. (b) The area of wetlands on the property was underestimated. Correspondingly, site hydrology was altered post the development right sale due to the construction of a right-of-way on neighboring property to the west of the property line. The construction of the right of way affected the hydroperiod on-site. 4. The Doroski family sold the development rights and reserved a parcel for development of three lots, each lot exceeding two acres in size. The subdivision had been designed with identified wetlands in 2002. However, the adjacent developer re-graded their property and water runoff was diverted onto the Doroski property causing an increase in the area of wetlands in 2004. After re- flagging of the property, the Planning Board deducted the wetlands from the lot area and determined that the owner would need to seek a ZBA variance in order to obtain the 3 lots previously planned. After review of the map by the building department,they question the need for a variance where the parcel exceeds the minimum lot size and can meet all of the regulatory setbacks of other agencies. I concur with the building department that the lots meet the zoning ordinance, therefore no variances should be required. The subdivision regulations do not prohibit the creation of a lot with wetlands and the wetlands are not deducted from the lot area determination. The zoning code of this town defines "lot" as "any parcel of land...", and "lot area" as " the area of a lot taken at its perimeter, exclusive of any portion within a public or private street right-of-way". In application of the subdivision regulations " buildable land" is not the same as a "lot". The "lot' must be in compliance with zoning, a lot of 40,000 or 80,000 square feet is in compliance which the applicable zoning designation. The only deduction authorized in the zoning code is 100-239, lands under water are not used toward lot size. Nevertheless, there is no requirement in the zoning code or the subdivision regulations that 100% of a lot be "buildable land". Specifically, at Code Section A106-35A,the code requires lots to be designed to "avoid foreseeable difficulties"by making sure the lots are arranged so that they can be built on, and A106-38 requires the Planning Board consider the natural features in the design of a lot to "encourage preservation of natural features". Lots on the Sound and Bay may contain slopes and wetlands in the lot area calculation provided that a reasonable sized building envelope is established. In conclusion, please be advised that the Planning Board is not authorized to deduct wetlands, slopes, easements, etc. from lot yield. Jurisdictional freshwater wetlands exist on site. However, all proposed development is proposed outside of the 100' required buffer from the wetland. The determination was based upon the following: No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels; a substantial increase in solid waste production; a substantial increase in potential for erosion, flooding, leaching or drainage problems are expected to occur if the propose action is implemented as planned. Note, however that the area soils are predominately composed of clay and some minor drainage problems are expected to occur. In addition, the Department of Health approval has not been issued, therefore, the feasibility of a septic system and associated impacts (if any) have cannot been fully evaluated. The applicant has stated in the EAF that 0 acres of vegetation will be removed from site. This is incorrect; three homes and associated driveways will be developed and clearing will occur. The Town of Southold Planning Board has advised the applicant to retain the large trees on site, vegetation on slopes greater than 15% and vegetated buffers along Sound View Avenue. Although clearing will take place no significant removal or destruction of large quantities of vegetation or fauna is expected to occur. No substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species; or other significant adverse impacts to natural resources will occur. The project is not located adjacent to a Critical Environmental Area as designated pursuant to subdivision 617.14(g). The proposed action will not result in the loss of agricultural lands are a significant area of open space. SEQR Negative Declaration - Page Two Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. Jurisdictional freshwater wetlands exist on site. However, all proposed development is proposed outside of the 100' required buffer from the wetland. The determination was based upon the following: No substantial adverse change in existing air quality, ground or surface water quality or quantity, traffic or noise levels; a substantial increase in solid waste production; a substantial increase in potential for erosion, flooding, leaching or drainage problems are expected to occur if the propose action is implemented as planned. Note, however that the area soils are predominately composed of clay and some minor drainage problems are expected to occur. In addition, the Department of Health approval has not been issued, therefore, the feasibility of a septic system and associated impacts (if any) have cannot been fully evaluated. The applicant has stated in the EAF that 0 acres of vegetation will be removed from site. This is incorrect; three homes and associated driveways will be developed and clearing will occur. The Town of Southold Planning Board has advised the applicant to retain the large trees on site, vegetation on slopes greater than 15% and vegetated buffers along Sound View Avenue. Although clearing will take place no significant removal or destruction of large quantities of vegetation or fauna is expected to occur. No substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species; or other significant adverse impacts to natural resources will occur. As you are aware, the site contains several areas of freshwater wetlands, one of which is located in the northwest corner of the site. This feature is depicted on the subdivision plan as extending off site to the west through an "easement", better identified as SCUM#1000-59-084.1. Recent clearing and grading of tax lot 4.1 has occurred presumably to allow for road construction and the majority of tax lot 4.2 to the south has also been cleared and a leaching structure has been installed. The following outstanding issues and concerns have been identified: 1. The map submitted to the Planning Board dated March 13, 2001 shows two depressional wetlands on Lot 1. The revised map dated January 2, 2002 excludes the wetlands shown on the previously submitted maps. The 1999, aerial map shows wetland signatures on the parcel that are not shown on the map. Please show all wetlands,regardless of size, on the revised maps. 2. Due to site topography, home siting and erosion are a concern. The building envelopes have been removed from the latest submitted map dated January 2, 2002. Please include building envelopes with all appropriate setbacks to regulated natural resources (wetlands, slopes) and lot-lines. 3. Please identify proposed access to each lot. Please note that the Planning Board is not in favor of creating more than one access from Sound View Avenue to serve the lots. 4. Our Environmental Consultant has informed this department that the price of all Environmental Reviews conducted in 2002 have increased to $750.00. We have received a check for$500.00 on January 15, 2002. Please remit the $250.00 difference at your earliest convenience.
