THIS INDENTURE, made the 1/-11. day of -JQnUIL/V, 2002

BETWEEN the COUNTY OF SUFFOLK, a municipal corporation of
the State of New York, having its principal office at the
Suffolk County Center, Center Drive, Riverhead, New York 11901,
party of the first part, and
TOWN OF SOUTHOLD, a municipal corporation of the State of
New York, having its principal offices at Post Office Box 1179,
53095 Main Road, Southold, New York 11971, party of the second
part,
WITNESSETH, that the party of the first part, pursuant to
Resolution Number 1081-2001 adopted by the Suffolk County
Legislature on November 20,2001 and, thereafter, approved by
the County Executive on November 26,2001, in consideration of
ten dollars paid by the party of the second part, does hereby
remise, release, and quitclaim unto the party of the second
part, the heirs or successors and assigns of the party of the
second part forever,

buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 079.00,
Block 07.00, Lot 041.000, and acquired by Tax Deed on April
19,1988, from Jean H. Tuthill, the County Treasurer of Suffolk
County, New York and recorded on April 19,1988, in Liber 10585,
CP 62, and otherwise known as and by Town of Southold, Leeward
Acres at Bayview, Map No. 5599, Lot designated as Park,
Recreation and Drainage area, filed in the Office of the Clerk
of Suffolk County on June 4,1971,
PARCEL II
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 084.00,
Block 01.00, Lot 006.018, and acquired by Tax Deed on February
19,1988, from Jean H. Tuthill, the County Treasurer of Suffolk
County, New York and recorded on February 19,1988, in Liber
10544, CP 113, and otherwise known as and by Town of Southold,
Sylovet Estates, Map No. 6390, Lot designated as Park and
Playground, filed in the Office of the Clerk of Suffolk County
on June 8,1976,
PARCEL III
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 095.00,
Block 04.00, Lot 018.041, and acquired by Tax Deed on February
19,1988, from Jean H. Tuthill, the County Treasurer of Suffolk
County, New York and recorded on February 19,1988, in Liber
10544, CP 113, and otherwise known as and by Town of Southold,
Oregon View Estates, Map No. 6241, Lot designated as Park and
Recreation area, filed in the Office of the Clerk of Suffolk
County on April 4,1975,
PROVIDED, however, that the Town of Southold will be
restricted in its use of the subject premises and will use said
premises solely and exclusively for municipal purposes; with all
right title and interest reverting to the party of the first part
in the event that the Town of Southold, at any time, uses or
in the event that the Town of Southold, at any time, uses or
attempts to use said subject premises for other than municipal
purposes or attempts to sell, transfer or otherwise dispose of
said subject premises without said premises being used thereafter
for municipal purposes. This covenant and restriction will run
with the land and shall bind the heirs or successors and assigns
of the party of the second part,
TOGETHER with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
SUBJECT to the condition that neither Grantee nor any
Municipality shall bill or charge back to Grantor any cost
incurred or projected to be incurred for the cleaning up of any
debris on said property. In the event that such charge back or
bill is rendered to the Grantor this Deed shall be void ab initio
and the realty shall revert to the Grantor.
AND the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost ot the improvement before using any part of
the total of the same for any other purpose.
THE WORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and year first above written.
