SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 46,174 sq. ft. parcel is shown as Lot 6 on the Map of Honeysuckle Hills, with 133.30 feet along Lloyd's Lane, 340 ft. of depth, and 143.63 feet along the bluff adjacent to the Long Island Sound. The property is improved with a two-story frame house with decks, shown on the October 2, 2004 survey prepared by David H. Fox, L.S. BASIS OF APPLICATION: Building Department's April 19, 2004 Notice of Disapproval, amended May 18, 2004, citing Section 100-239.4A, in its denial of a building permit to construct a deck addition (and swimming pool built within the new deck construction). The reason stated for the disapproval was that the deck addition is located less than the 100 ft. minimum code requirement from the top of the bluff or bank. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 22, 2004, August 19, 2004, and October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant APPLICANTS' REQUEST FOR AREA VARIANCE RELIEF: In the April 15, 2004 application for a building permit and variance, the applicants requested setback relief for: (a) replacement of 770 square feet of the existing wooden deck behind the dwelling on the north side, and (b) construction of a new 860 sq. ft. raised deck addition with 15' x 24' oval swimming pool built within, as shown on the April 6, 2002 survey prepared by Francis X. Karl, L.S., amended May 14, 2004. The deck replacement will be 91.4 feet from the top of the bluff, and the new deck construction with pool was originally requested at 85 feet from the top of the bluff and 21 ft. from the easterly side yard. During this hearing, the applicants were requested to consider an alternative plan. In addition, the applicants' agent requested an extension of time for submission of alternative(s) and to offer an engineering plan for conal�era`ftlori. "On October 7; ff04 Fe__applicants su6mitled ani ernativee pfan'For a" UT—q. fiT-- - gunite pool at a minimum of 80 feet to the top of the bluff, after removing and cutting back the northeast corner of the existing deck and stairs. The pool also was redesigned to be mostly in- ground, rather than a fully above-ground pool and built into the deck construction and a minimum 21.6 ft. setback from the easterly side property line remains the same. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1" Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. After considering testimony during the hearings, the applicants reduced the size of the construction by the pool to an in-ground design and changing the location. Much of the front yard is paved with the driveway and the topography is rolling and established with trees and front yard location of the sanitary system. The rear yard deck construction is in-kind, in-place, with new conforming structural supports. In conjunction with that, the applicants are extending the one-story deck easterly, flush with the pool, and elevating the top of deck 5 to 6 ft. from ground, depending on the contour of the ground. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The location of the dwelling, exclusive of the existing rear deck, is 100+- feet from the top of the bluff, andwith the existing rear deck, 91 A feet from the top of the bluff. The setback from the attached garage to the easterly side yard is 16.8 feet at its closest point- There will be no clearing of trees for the proposed construction activity. 3. The variance granted is substantial, representing 20% reduction from the code required minimum of 100 feet from the top of the bluff. 4. The difficulty has not been self-created since the deck and dwelling have been in place for many years, and the new deck is an extension of same with a swimming pool. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.
