Reilly, Esq. 111 Smithtown Bypass Suite 224 Hauppauge, NY 11788 Re: Reilly/Brittman Lot Line Change SCTM#1000-78-2-10,11,12 Dear Mr. Reilly: The Planning Department is in receipt of your application for a lot line change involving the above-referenced properties, which was reviewed by the Planning Board at their work session on March 21, 2005. While the Planning Board has no objections to your application, this proposal requires variances from the Zoning Board of Appeals. The Planning Board will not be able to process this application for approval until the ZBA grants the necessary relief. The Building Department has taken the position that even though the lots will be more conforming than they are now, the new lot areas are still less than what is required under the Zoning Code, thereby requiring variances from the ZBA. You should submit a request and obtain a Notice of Disapproval from the Building Department in order to initiate the ZBA process. Once the ZBA renders a decision, the Planning Board will be able to continue processing your application. If you have any questions or need further assistance, please feel free to contact the undersigned. *Anthon . L zz7 SeniorPlanner w Town of Southold Planning Department Staff Report Subdivisions I. VI: Staff Recommendations The Planning Department offers the following comments and recommendations at this time: 1) The applicants are commended for eliminating a lot that was approved by Planning Board in 1963. This area is ecologically sensitive and any reduction in potential density is good for the environment. 2) This project requires variances from the Zoning Board of Appeals. Although the degree of nonconformity is not increasing, the Building Department has been issuing Notices of Disapproval on similar applications. 3) The Planning Board cannot approve this application until the ZBA renders a decision. 4) The applicant should obtain a Notice of Disapproval from Building Department and file a variance application with the ZBA.
