RESOLVED amends resolution 2006-
that the Town Board of the Town of Southold hereby
306, adopted at the March 28, 2006 regular Town Board meeting to read as follows:
RESOLVED that the Town Board of the Town of Southold hereby authorizes the acceptance of
six (6)
residential leaves and brush at the Southold Town Compost facility, free of charge, for
weeks in connection with the Spring Cleanup for the year 2006 starting Saturday, April 15,

through Sunday, May ; and be it
FURTHER RESOLVED that the Town Board hereby extends the waiver of such fees to
commercial entities carrying leaves and brush from residential properties within the Town only,
during that period; and be it
FURTHER RESOLVED, that the Highway Department Spring Cleanup will commence on April
17, 2006, in Laurel.

WHEREAS
, the Town Board of the Town of Southold wishes to purchase a development rights
easement on a certain parcel of property owned Thomas L. Shalvey, Jr. and Catherine S. Russo,

as Executors of the Estate of Thomas L. Shalvey, Sr., Dorothy Shalvey and Frank Blados, Jr.,
pursuant to the provisions of Chapter 6 and Chapter 25 of the Code of the Town of Southold.
Said property is identified as part of SCTM #1000-84-2-2.1. The address is 5200 Bridge Lane,
Cutchogue, New York, and is located on the northeast corner of Bridge Lane and County Road
48, extending approximately 1687 feet northerly along Bridge Lane and approximately 124 feet
easterly along County Road 48 in Cutchogue in the A-C zoning district. The proposed
acquisition is for a development rights easement of approximately 16.5 acres (subject to survey)
on the 20.0 acre parcel. The exact area of the development rights easement is subject to a Town-
provided survey acceptable to the Land Preservation Committee. The purchase price for the
easement is $52,000 (fifty-two thousand dollars) per buildable acre; now, therefore, be it

by the Town Board of the Town of Southold that this action be classified as an
Unlisted Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; be it
further
RESOLVED
by the Town Board of the Town of Southold that the Town of Southold is the only
involved agency pursuant to SEQRA Rules and Regulations; be it further
RESOLVED
by the Town Board of the Town of Southold that the Short Environmental Form
prepared for this project is accepted and attached hereto; and, be it further
RESOLVEDfinds no significant impact
that the Town Board of the Town of Southold hereby

WHEREAS
the management of records and information is critical to every business,
organization and government agency in facing the complexities of competition, customer service
and globalization; and
WHEREAS
technologies for storing information are expanding the amount of information that
can be acquired, with increased longevity; and
WHEREAS
the need to use information to create value and plan strategically is a driving force
in today's world; and
WHEREAS
control of records and information is necessary for reduction of risk and liability as
well as for compliance with global standards; and
WHEREAS
the citizens of the Town of Southold, Southold, New York should recognize the
important service performed by records and information professionals;

service earlier than planned for extensive scheduled maintenance; and

part of the maintenance period in order to meet the Spring demand of local residents and

WHEREAS
the Town of Southold received donations in 2001 from several sources for the
construction of an Animal Shelter which were deposited into the Town’s Agency and Trust

WHEREAS
Animal Shelter donations were deposited to the Town’s Agency & Trust Fund
Public NOW account and have earned interest at various rates ranging from .25% to 1.01% per
annum for a total of $5,490.98, with said interest credited to the Town’s General Fund, and
WHEREAS
theTown Board of the Town of Southold appropriated amounts from the Animal
Shelter donations in 2001, 2002 and 2004 for engineering and design services in connection with
the construction of a new Animal Shelter, the total of which aggregated $21,250.59 and which
was transferred from the Town’s Agency and Trust Fund and into the Town’s General Fund, and
WHEREAS
the Town Board of the Town of Southold has recently considered and deliberated
on the use of said donations in 2001, 2002 and 2004 for the design of an Animal Shelter, and has
determined to restore said funds including all earned interest to the Town’s Agency & Trust
Fund to be used for construction only at such time as construction has commenced on said
shelter, now therefore be it
RESOLVED orders and directs that the
that theTown Board of the Town of Southold hereby
sum of $26,741.57 be transferred from the General Fund Whole Town into the Agency &
Trust Fund, and that said transfer should be charged against the General Fund Whole
Town 2006 Revenue budget
as follows: $21,250.59 to Gifts & Donations (A.2705.40) and
$5,490.98 to Interest and Earnings (A.2401.00).

proposed acquisition is for open space and is approximately 11.0 acres (subject to survey) that
borders on Pipes Creek.
The proposed acquisition is for fee title to the entire open space parcel. The purchase price is
$637,500.00 (six hundred thirty-seven thousand five hundred dollars).
The property is listed on the Town?s Community Preservation Project Plan as property that
should be preserved and falls under multiple purposes of the Community Preservation Project
Plan, including, but not limited to, preservation and protection of open spaces and scenic values,
protection of wetlands, and undeveloped shorelines, and protection of unique and threatened
ecological areas.
The subject property is within the Pipes Cove area. The Town has identified the Pipes Cove area
as a priority area for preservation as this area is one of the few remaining undeveloped areas of

Section 2. Code Amendment
. Based on the goals and identified housing needs of the Town, and
upon our consideration of the recommendations of the Town Planning Board, the Suffolk
County Planning Commission, the environmental consultant retained by the Town Board,
and the public comment taken at the public hearing and otherwise, we hereby amend the
official Zoning Map of the Town of Southold as adopted by Section 100-21 of the Town
Code to change parcel #1000-122-2-23.1 from R-80 to AHD. The property is
approximately 7.4 acres and is located off of Factory and Sound Avenues in the Town of
Southold.

Development Corporation of Long Island (CDCLI) on March 2, 2006 seeking transfer of 12
credits to the property known as SCTM# 1000-122-2-23.1 located on Sound Avenue and Factory
Avenues in Mattituck, in the Mattituck-Cutchogue school district; and
WHEREAS
the applicant seeks to utilize the credits on land designated as Affordable Housing
District (AHD) to create affordable homes that will remain affordable in perpetuity, pursuant to
Town Code Sections 100-50 et al, and Chapter 87; and

the applicant seeks to utilize the credits on land within a designated receiving area;
and it is hereby
WHEREAS
the Town Board held a public hearing on the action on March 28, 2006, at which

the applicant modified its application and now seeks the transfer of 10 credits, to
create a development of 22 affordable homes on the aforementioned property; and
WHEREAS
the Town Board conducted a coordinated SEQRA review of the action, and issued
a Negative Declaration on April 11, 2006; and it is hereby
RESOLVED
that the Town Board has evaluated the effects of the proposed transfer and finds
that the district contains adequate resources, environmental quality and public facilities,
including adequate transportation, water supply, waste disposal and fire protection, and further
finds that that there will be no significant environmentally damaging consequences and that such
development is compatible with the comprehensive planning efforts of the Town, and the Town
Board incorporates the report of the Planning Board dated April 10, 2006 regarding the same;
